As decisões judiciais entendem que os médicos já dispensados aos 18 anos se livraram do dever militar. Essas dispensas judiciais atingem o efetivo militar, tendendo a inviabilizar várias atividades das Forças Armadas, mormente as Ações Cívico- Sociais. Primeiramente, levanta-se o papel dos deveres fundamentais na literatura constitucional atual, quando os deveres se apresentarão como um falso convite às ditaduras. Por outro lado observa-se que um excesso de direitos sem a devida responsabilidade tende prejudicar o próprio Direito. Aponta-se a solidariedade, a fraternidade e a cidadania como fonte de deveres fundamentais e alicerce na figura da dignidade do outro. Martin Buber e sua dialética do eu/tu aponta que o ser não é ser se não contar com o outro ser, e assim os direitos serão ligados aos deveres e vice e versa, numa ética da alteridade e na ideia de fraternidade, solidariedade e cidadania Em seguida, o alistamento do médico militar é exposto junto à questão das Forças Armadas na história brasileira. São levantadas as razões que levaram o Poder Constituinte a optar pelo serviço militar obrigatório e o enquadramento do médico nesse contexto. O ethos profissional é cotejando às atividades militares. Na última etapa de objetivos, é verificado o serviço militar para médicos como forma de resguardo de direitos fundamentais e seus limites. O serviço médico militar será de fato um dever fundamental quando estiver atrelado à promoção de direitos fundamentais ligados às Forças Armadas. Em situações de defesa nacional ou de garantia de atendimento à saúde em situações extraordinárias quando os médicos civis não são habilitados à atuar. Este dever será imposto à todos os médicos independente de terem ou não custeado seus estudos e sua subordinação militar deverá antes de tudo atender ao código deontológico profissional para depois voltarse ao comando militar. / The research in the line of Democracy, Fundamental Rights and Citizenship addresses, using the dialectical methodology, layoffs judicial incorporation of doctors to compulsory military service in peacetimes face fundamental duties. These are the reasons raised the constituent power to opt for compulsory military service and the framework of the physician in this context. The professional ethos is comparing military activities. In the last stage of objectives, is verified military service to physicians as a way of safeguarding the fundamental rights and their limits. The military medical service is in fact a fundamental duty when linked to the promotion of fundamental rights related to the Armed Forces. In situations of national defense or security of health care in extraordinary situations when the civilian doctors are not qualified to act.
