論原住民身分之法律保障董孟忠 Unknown Date (has links)
本文從國際條約，內國法及美國法探討原住民之法律地位。第二章以國際條約及我國相關法規為例，說明原住民法律地位在國際上或我國之變遷。第三章援引國際法學者對原住民族之定義，將台灣原住民置於該定義下討論。就國際法言，民族自決是原住民法律地位的主要內涵，因此本文於第四章專述國際法上民族自決之內容與適用對象。原住民法律地位在台灣之發展，尚未能具有自決之權利或地位，相關的法律規範還在起步階段，目前實質之規範僅限對原住民身分之認定，第五章即討論此原住民身分之認定，與現行法律作用所產生之結果。因其影響大者為相關身分法之規定，本章遂以身分法為中心。原住民族於其所在國之法律地位之發展，並無一定公式可循，僅就我國現行規範言，其與原住民族的期待相較之下，仍有極大的落差。許多國家境內皆有其原住民族，其中印第安族法律地位在美國已有較完整的發展，況且其可為台灣原住民族所主張的自治模式，提供參考範例，遂於第六章論述美國印第安族法律地位之發展。

Federal government, states and tribal governments may invoke criminal jurisdiction over Indian country in the USA. The complexity of relationship of these entities creates legal vacuum, impression of lawlessness, which is harmful for the safety of American Indian women. Native American and Alaskan Native women are more than 2.5 times more likely to be raped than women in the USA in general.
