Australian estoppel and the protection of reliance

This thesis focuses upon recent Australian developments in the law of estoppel. It provides a justification and basis in principle for the doctrine of estoppel described in cases such as Waltons Stores (Interstate) Ltd v Maher (1987-1988) 164 C.L.R. 387 and Commonwealth of Australia v Verwayen (1990) 170 C.L.R. 394. This basis is found in the principle that we ought all to take reasonable steps to ensure the reliability of the assumptions that we induce in others. Ensuring the "reliability" of an induced assumption means ensuring that a party who relies upon the assumption does not thereby suffer harm: harm in the sense that he is worse off because the assumption has proved unjustified than he would have been had it never been induced. The thesis suggests a pattern for the development of the Australian law of estoppel reflecting that basis in principle. It further demonstrates the potential usefulness of the doctrine with specific reference to (i) pre-contractual negotiations and letters of intent, (ii) firm offers to contract, (iii) variations of contract unsupported by consideration, and (iv) the "battle of forms".

Assessment of Drug-Induced QTc Prolongation and Associated Risk Factors

Class of 2017 Abstract / Objectives: To assess the incidence of medication-induced corrected QT (QTc) interval in patients taking two or more QTc prolonging medications and to identify which risk factors are associated with QTc prolongation. Methods: This retrospective chart review examined QTc prolongation in adult patients admitted to Banner University Medical Center South Campus (BUMC South) received at least two QTc prolonging medications. Patients were assessed for risk factors of QTc prolongation, number of QTc prolonging drugs received, and presence of QTc prolongation. Results: Of the patients who received two, three, or four or more QTc prolonging drugs, 43.4%, 67.3%, and 45.5%, experienced QTc prolongation, respectively (p < 0.05). Those who received three QTc prolonging drugs had a greater incidence of QTc prolongation compared to those who received two (p = 0.0089) or four or more (p = 0.049) QTc prolonging drugs. There was no difference in incidence of QTc prolongation in those receiving two versus four drugs (p = 0.084). The incidence of QTc prolongation was associated with risk factors including a history of cardiovascular diseases, electrolyte disturbances, and being female (p < 0.05). Conclusions: An increase in the number of QTc prolonging drugs received was not associated with a corresponding increase in the incidence of QTc prolongation. Being female, having electrolyte disturbances, or a history of cardiovascular disease may increase the risk of QTc prolongation.

Impact of Olanzapine on Refractory Chemotherapy-Induced Nausea and Vomiting: a Retrospective Study

Class of 2013 Abstract / Specific Aims: To describe the outcomes of olanzapine in the treatment of refractory chemotherapy-induced nausea and vomiting (CINV). Methods: Data were collected regarding demographic information, chemotherapy regimen, CINV prophylaxis, rescue antiemetics, and olanzapine usage for subjects, age 18-79, who were admitted to the University of Arizona Medical Center for chemotherapy and received at least one dose of olanzapine for CINV between January 2008 and January 2012. The primary outcome measure was the number of rescue antiemetics required following the first dose of olanzapine (greater than 10 doses was considered treatment failure). Comparisons using chi square to determine if differences existed with respect to the level of chemotherapy emetogenicity and demographic information were conducted. Main Results: No statistical difference between chemotherapy regimens of high versus low-to-moderate emetogenicity was seen (P=0.79). However, 7 of 10 (70%) subjects receiving highly emetogenic chemotherapy achieved success and 15 of 23 (65%) subjects receiving low-to-moderately emetogenic chemotherapy achieved success. No statistical differences appeared when evaluating usage of 1 versus 2 or more prophylactic antiemetics (P=0.77), men versus women (P=0.08), and age over 50 versus 50 years or younger (P<0.99). Conclusion: This study demonstrated a trend towards greater emetic control with the addition of olanzapine in patients failing first-line antiemetic pharmacotherapy. Additionally, a trend towards greater emetic control was seen in women. The rates of success among all groups may suggest benefit to adding olanzapine to subjects experiencing refractory CINV. Due to the limited sample size and retrospective methodology of the study, the use of olanzapine in refractory CINV merits further research with large, prospective studies directly comparing addition of olanzapine to other appropriate antiemetics.
