Managing Outsourced Administrative Discretion

An entire body of administrative law exists to guide the administrative discretion of public administrators. Although an increasing share of public services is being outsourced to the private sector, much of administrative law is not applicable to governments’ contracted agents. Alternatively, contracting agencies use the contract instrument to guide and constrain contractors’ exercise of delegated administrative discretion. This essay reports on a study of selected Florida local governments’ contracts for residential trash collection services. Although minimal discretion was placed in contractors’ hands, it still presented opportunities for abuse. The local governments used a variety of ways to manage the administrative discretion, including the imposition of public service ethics and transparency requirements. Upon analysis of contractual grants of and constraints upon administrative discretion, some suggestions are offered for enhancing contractual management of delegated administrative discretion.

Given the enduring importance of the United States and its superpower status, American foreign policy represents a suitable topic for a detailed analysis. The focusing on Poland and the U.S. foreign policy related to it enables to find factors influencing the process of foreign policy-making and to examine the level of their impact. Selecting Poland can be explained by its great potential and rising importance within European politics as well as the long-lasting partnership between Poland and the United States that has been developed over the years. The characterization of factors influencing the formulation of the U.S. foreign policy enables understanding of tendencies and changes in the U.S. approach towards Poland. Contemporary foreign policy is not solely affected by current developments, but also the historical context and circumstances can have impact on its formulation and current shape. The formation of the American approach towards Poland is not completely isolated from other processes and therefore its final outcome depends on subsequent variables such as general American foreign orientation, the relations with Russia or the course of the general security situation. Distracted U.S. Foreign Policy Sector: the Effects of Strategic Prioritization Towards a Rising Chinese State in East Asia

The question of the stability of American hegemony has consumed U.S. International Relations discourse since the Post-Cold War narrative. With the rapid changes in the international realm and the countless U.S. humanitarian and military operations around the globe, it is no surprise that many well-known researchers have taken the time to look at the impact of American hegemony under strict observation. However, more analysis must be made of these operations' strategic purpose and success. This thesis strives to fill this gap by conducting in-depth case studies on various U.S. military operations from the early 2000s to the present in the Middle East, Eastern Europe, and East Asia. These case studies were selected with the research tool "Comparative Case Study" method to limit any bias in which country or historical event to include in the case study chosen section. With the aid of Structured Analytical Techniques (SATs), an analysis is made using the historical information gathered by the case studies to determine whether the success and impact of U.S. presence in these regions are secure enough to go against a rising Chinese state. Contrary to the resources and attention given to these military operations, the lack of agreement among American presidential administrations on a strategy could have deteriorated American hegemonic presence abroad.

The diploma thesis describes and analyses relations between the Czech state and the Kingdom of Denmark. It is focused on the time period from the Middle Ages till today, however the key part examines the 20th century. The diploma thesis comprises several areas of the Czech-Danish relations, mainly deals with the political and diplomatic affairs and focuses also on economic and cultural connections. Due to lack of printed sources the thesis draws from the materials of the Archive of the Ministry of Foreign Affairs of the Czech Republic and is therefore the first comprehensive overview of the relations between these two states.
