South African indigenous courts : challenge for the future

The purpose of this study is to access the viability of traditional African courts in a future legal dispensation in South Africa. The research method used is a study of literature, court decisions and relevant statutes. The development of indigenous courts in South Africa is broadly outlined. As an analogy to the South African court system, the courts of Lesotho, Swaziland and Botswana are used to illustrate the dual systems of courts. Rapid urbanisation is discussed to illustrate that despite the increasing urbanisation, traditional values remain inherent to South African Blacks. The salient features of indigenous courts are analysed to facilitate the development of reform measures that have to be implemented so that the courts can meet the challenge of the future. / Constitutional, International and Indigenous Law / LL.M.

Legitimação e eficácia impeditiva da sentença acolhedora de súmula de Tribunal Superior

Sob a fundamentação de diminuir as barreiras existentes de acesso à justiça, e aplicar o princípio constitucional da duração razoável do processo, estão sendo operadas reformas ao Código de Processo Civil, sendo este instrumento de grande relevância para os operadores do direito e o cidadão comum, vez que rege as relações processuais no âmbito do judiciário. Tais reformas fortaleceram sobremaneira o controle realizado pelo STF e STJ. No bojo dessas alterações foi inserido o 1 do art. 518 do CPC, possibilitando ao juiz de primeiro grau não receber recurso de apelação quando sua decisão estiver de acordo com súmula do STJ e do STF. Tal dispositivo poderá trazer várias conseqüências jurídicas e vantagens ao judiciário que economizará tempo e recursos financeiros e humanos tão preciosos no sistema judiciário, bem como para o cidadão que terá preservado as garantias processuais do devido processo legal, direito de ação e defesa, terá previsibilidade do grau de seu direito em face da uniformização, bem como participará de um processo regido com base nos princípios da igualdade, segurança jurídica, duração razoável do processo. Assim, esse trabalho confirmou a suposição de que tais conseqüências jurídicas trazidas pela aplicação 1 do art. 518 do CPC, conhecido como súmula impeditiva de recurso, sentença impeditiva de recurso, ou ainda eficácia impeditiva de recurso, legitima a adoção do dispositivo à luz dos princípios constitucionais. A pesquisa foi do tipo descritiva com viés qualitativo para o levantamento dos dados obtidos através de entrevista a juízes, desembargadores, Ministros do STJ e STF, que proporcionou conhecer o desenvolvimento de seu processo decisório, bem como verificar o entendimento desses magistrados sobre as conseqüências que a súmula que fundamenta a sentença cujo efeito impede recurso impõe na vida do cidadão, parte na relação processual, à luz dos princípios garantidos constitucionalmente

Processo judicial eletrônico: a desconstrução do conceito de segurança jurídica e os riscos da sociedade da informação

O presente trabalho propõe-se a desconstruir o conceito do princípio da segurança jurídica a partir da teoria da desconstrução de Jacques Derrida e das ideias de Wittgenstein II sobre a designação de um significado a partir do uso de um termo em situações específicas, levando em consideração o contexto da cibercultura e os riscos técnicos atinentes à sociedade da informação. Para tanto, o estudo foi realizado a partir de uma revisão de literatura para definir o conceito de segurança jurídica que seria desconstruído, acrescido de uma pesquisa empírica com abordagem qualitativa e objetivo exploratório com pesquisa de campo para conhecimento de outros sistemas eletrônicos que faz parte do Judiciário brasileiro, bem como para conhecimento de casos de falhas de segurança dentro do sistema padrão de processo eletrônico brasileiro - PJe. Assim, a qualidade de uso da tecnologia foi considerada mais importante que a tecnologia propriamente dita quando da observação quanto ao comportamento negativo, referente a interação do homem com a tecnologia, foi colocado como fenômeno de comportamento social que não pode ser negado no momento da desconstrução. Dessa forma, como resultado, a pesquisa traz a percepção quanto à real necessidade de desconstrução do conceito do princípio da segurança jurídica para que esses comportamentos negativos advindos da cultura cracker sejam absorvidos pelo ordenamento jurídico brasileiro, fazendo com que a segurança jurídica seja vista como sinônimo da segurança da informação tendo em vista a realidade de um Judiciário virtualizado. / This research aim is deconstructing the concept of juridical security from the Jacques Derrida deconstruction theory and the ideas of Wittgenstein II about designation of a meaning from a term use in specific situations, considering cyberculture and the technical risks associated with information society. For that, this study was based on literature review to define a juridical security concept to be deconstructed, and an empirical research with qualitative approach and exploratory objective aiming to know others electronic systems that is part of the brazilian judicial system, and to know security failures cases relating with brazilian electronic process standard system (Pje). The technology quality use was considered more important than the technology itself after observing negative behaviors, referring how man interact with technology. This interaction was placed as a social phenomenon that cannot be denied at the deconstruction moment. As a possible result, this work brings a perception about the real need of deconstructing juridical security concept in order to make these negative behaviors arising from "cracker" culture be faced and absorbed by Brazilian legal system and juridical culture, making juridical security to be seen as a synonymous of information security.

The purpose of this thesis is to explore, as far as possible, the human element in the process of judicial administration. It attempts to include some aspects, and the environmental situation, of several social groupings including the skid row habitue and the professional criminal. To this extent it tries to get a perspective relative to the intent of the offender. The paper also tries to develop a scope that relates existing machineries of judicial administration as they relate to the various offenders. The primary purpose is, through a general survey, to create questions rather than answer them. It is hoped that future research can and will be done in order to clarify the pertinent queries made. Among the questions indicated as badly in need of an answer are the possibility of a total change in the administration to answer the specific needs of the skid row unemployed or unemployable who may be totally accepting the present judicial syndrome to get subsistence and the effects of the process of admission into the city or provincial jail which may restructure an individual's self-image so as to alienate him from his original society and create a possible recidivist as he adapts to the jail or prison sub-culture. / Arts, Faculty of / Social Work, School of / Graduate

The practice of polygamy among the Mormons during the nineteenth century was vigorously prosecuted by the federal government in response to the demands of those whose political and economic goals could best be served through exploitation of the national attitude toward polygamy. Hundreds of men served prison terms for practicing what they believed was their religious obligation. This study of the sentences from the prison admission records has focused on the comparative severity of the judges, examines age as an influencing factor in sentencing, and compares the sentences of the polygamists with those for crimes against person and property.The results show which judges were most severe; that some deference was shown the aged, and that judges who gave severe maximum sentences to polygamists did not give such sentences in equal proportion to those convicted of crimes against person and property. The major influence appears to be the selection of the judge in the first place, to be severe or lenient, in response to national attitude against, or influential sympathy for the Mormons.

Strategic Versus Sincere Behavior: The Impact of Issue Salience and Congress on the Supreme Court Docket

The theory proposed here is that the Supreme Court behaves in a strategic manner at the agenda-setting stage in order to vote sincerely on the merits. To test this, I measure the impact issue salience and ideological distance between Congress and the Supreme Court has on the agenda. The results indicate that whether the Supreme Court behaves either sincerely or strategically depends on the policy area. The strategic nature of the Supreme Court at the agenda-setting phase may be in large part why some research shows that the Court behaves sincerely when voting on the merits. By behaving strategically at the agenda-setting phase, the Court is free to vote sincerely in later parts of the judicial process.

I utilize cases involving the Republican and Democratic parties from 1966 to 1997 and examine the voting behavior of federal Courts of Appeal judges. I utilize both cross tabulations and a Logit regression model to determine the likelihood appellate judges will vote for their own party and against the opposition.

Esta dissertação teve por objetivo analisar a possibilidade de superar as barreiras físicas da competência territorial dos juízes, com a finalidade de se adequar às mudanças sociais e estruturais provenientes da nova era digital, no intuito de acompanhar as inovações tecnológicas e implementar uma prestação jurisdicional mais eficiente. O método indutivo e comparativo se mostrou mais viável para desvelar o desenvolvimento das tecnologias no âmbito do Poder Judiciário, especialmente sobre a utilização do processo judicial eletrônico na efetivação da tutela jurisdicional. A era digital trouxe nova definição sobre o espaço e tempo, iniciando um sistema de interação social totalmente dinâmico, rápido e desprendido das barreiras territoriais físicas. O processo judicial eletrônico também trouxe reflexos no âmbito da tutela jurisdicional, propiciando uma justiça mais célere e voltada para acompanhar os aspectos sociais decorrentes da era digital. O processo judicial eletrônico também possibilitou uma melhor gerência dos processos judiciais, permitindo o acompanhamento efetivo da atuação do judiciário. Com a possibilidade de atuação do magistrado desvinculado da barreira física da competência territorial, pretendeu-se demonstrar a possibilidade de um mesmo magistrado poder atuar em diversas comarcas distintas, sem que tal situação violasse o princípio do juiz natural, possibilitando a entrega da tutela de forma rápida e eficaz. Há necessidade de reorganização da distribuição de competências das unidades judiciárias, desinstalando comarcas e varas, a criação de unidades judiciárias para o Núcleo de Apoio às Comarcas, e o fortalecimento da Coordenadoria de Gestão Estratégica e Estatística e Projetos (COGES) com vista ao maior planejamento com relação à produtividade judiciária. / This dissertation aimed to analyze the possibility of overcoming as physical barriers to the territorial jurisdiction of judges, with the purpose of adapting as social and structural changes to the new digital era, with no intention to follow as technological innovations and to implement a more efficient. The inductive and comparative method proves to be more viable for the development of technologies without right to power, as well as for the use of the electronic judicial process in the execution of judicial protection. A digital age brought a new definition about space and time, initiating a system of social interaction that was totally dynamic, fast and detached from physical territorial barriers. The judicial process is also a problem of reflection, it is not the property of the judicial protection, providing a faster justice and directed to accompany the essential aspects of the digital era. The electronic judicial process also allowed a better management of judicial processes, allowing effective monitoring of the legal proceedings. With the possibility of a magistrate acting unconnected to the physical barrier of territorial jurisdiction, it was intended to demonstrate the possibility of a single magistrate being able to act in several distinct districts, without which this situation violates the principle of the natural judge, fast and effective. The need to reorganize the distribution of competencies of the judicial units, uninstalling areas and sticks, the creation of judicial units for the Nucleus of Support to the Counties, and the strengthening of the Coordination of Strategic Management (COGES) aiming at greater planning with respect to judicial productivity.
