Exploring the factors that contribute to the self-configuration process of juvenile sexual offenders

The problem that motivated the study was that the way in which juvenile sex offenders are configuring themselves, and the way that self-development is currently understood, potentially has negative implications for the way they may be treated in therapy. The Gestalt paradigm was the lens through which this phenomenon was explored. The research method was from a qualitative perspective and was an explorative and descriptive analysis of the factors that contribute to this self-configuration. Data was collected by way of unstructured and semi-structured interviews and systematically represented by the emergent themes. Results showed the factors that contribute to the self-configuration of the juvenile sex offender. Recommendations were made to the juveniles, their caretakers and the social workers. The researcher concluded that the Gestalt approach to self-configuration, with its emphasis on the field and relationships, provides a coherent lens through which to approach the phenomenon of juvenile sex offenders. / Social Work / M. Understanding and giving support to children in conflict with the law : a socio-ecological perspective

Many children in conflict with the law are not receiving the relevant education and services to which they are entitled. Convention on the Rights of the Child, proclaim that the convicted child‟s needs of persons of their age, like the right to appropriate education must be addressed as a matter of urgency. In addition, there is a serious lack of properly trained personnel who might be causing more impairment to children in conflict with the law, but who remain in the system. The appointment of relevant and appropriate staff in correctional facilities is definitely required. For instance, many young offenders lacked a decent education, social skills and occupational skills and involvement of parents, peers and the community. If essential programmes become successful, this will not only improve the livelihood of children in conflict with the law, but will also reduce recidivism rates. Qualified teachers and caregivers are required because the children in conflict with the law require specialised programmes like Individual Education Plan (IEP). The IEP is a basic aspect in providing quality special education services to help a particular learner attain his or her maximum learning potential. The aim of this study was to develop socio-ecological framework in understanding and giving support to children in conflict with the law. Bronfenbrenner‟s ecological model was used as a conceptual framework. Qualitative research design and phenomenology as a mode of enquiry were employed in this study. Interpretivism was used a philosophical paradigm. Population was learners, between ages of eleven and seventeen, from three correctional facilities. Purposive sampling was used as a method of sample selection. The findings in this study indicated that the children in conflict with the law resented the teachers showing signs of being judgemental, for failing to acknowledge their efforts and for being unresponsive to their needs. Initial desires to succeed in the classroom were replaced by frustration, anger, hopelessness and disappointment following failure. There is a growing sense of apathy and lack of focus amongst the youth, which contributes to the threat of social integration. Constructive alternatives are therefore needed to curb gangsterism, drug abuse and other criminal activities among youth at risk. It has become imperative to challenge the present situation in which crime has become one of the most attractive options facing our youth. Through a programme of contructive engagement, a substantial difference can be made in their rehabilitation and ultimately their active participation in building a safer society. A strong emphasis should be placed on the development and implementation of effective restorative justice principles, alternative sentencing and community-based rehabilitation programmes, particularly for young people in marginalised communities.

Effects of Immaturity on Juveniles’ Miranda Comprehension and Reasoning

Over the last several decades, researchers have documented how impaired reasoning by adult offenders impeded the intelligent waiver of Miranda rights. Logically, it stands to reason that juveniles – who are developmentally less mature and have less life experience than their adult counterparts – would possess even greater impairment, thereby heightening their risk for invalid Miranda waivers. Juvenile Miranda research supports this notion; with some researchers finding that psychosocial maturity, among other factors, affect a juvenile’s understanding of their rights. Yet, relatively few studies have examined its relation to Miranda reasoning and decision-making. Thus, the current study investigated the specific role of maturity in juveniles’ Miranda comprehension and reasoning. Participants included 236 legally-involved juveniles recruited from either a juvenile detention center or a juvenile justice alternative education program. The effects of psychosocial maturity were examined on a variety of Miranda-related measures and assessed a broad range of Miranda abilities. It was found that, in general, immature juveniles performed more poorly on all Miranda measures as compared to their mature counterparts. However, the impact of maturity varied considerably depending on the ability. Specifically, maturity was most important in the context of Miranda reasoning. As a novel addition to the literature, the current study also investigated the effects of developmental timing on maturity (i.e., immaturity-delayed versus immaturity-expected) on Miranda abilities.

Adolescent Psychopathy in an Adjudicated Male Population: The Role of Sensation Seeking, Impulsivity, and Externalizing Disorders

Psychopathy, as conceptualized by Cleckley (1941), describes a constellation of psychological and behavioral correlates including superficial charm, untruthfulness, lack of remorse or shame, poor judgment, and failure to learn from experience. Based on Cleckley's initial work, Hare (1991) developed a two-factor model of psychopathy. The purpose of this study was to investigate the roles that sensation seeking, impulsivity, ADHD, conduct disorder, and oppositional defiant disorder have on adolescents classified as psychopaths. The participants consisted of 79 adjudicated male adolescents in a maximum-security facility. As hypothesized, adolescent male psychopaths had higher levels of sensation seeking, impulsivity, conduct disorder and oppositional defiant disorder. A discriminant function analysis found that sensation seeking, impulsivity, ADHD, Conduct Disorder, and Oppositional Defiant Disorder was moderately useful in classifying adolescent psychopathy. The results suggest that behavioral dysregulation is an important aspect of adolescent psychopathy. The relationship of these data to theories of adolescent psychopathy is discussed.
