1 Principle of flexicurity in legal regulation of transfer of rights and obligations from the employment-law relations Abstract In her PhD thesis, the author deals with the legal regulation of transfer of rights and obligations arising from employment-law relations in the Czech Republic, in the context of the European union law, from the point of view of the concept of flexicurity in the employment-law relations. This concept includes, on the one hand, elements of flexibility in the realization of employment-law relations, and, on the other hand, security (protection) of employees in these relations which is manifested in particular by the transfer of rights and obligations from their employment-law relations to the new employer itself. At present, when changes in the employers' organizational structure, transfers of activities or tasks, mergers, the purchase of a business or a business lease, but also so called outsourcing, insourcing, and change of suppliers are becoming more and more common in companies, the issue of change of the employer, and consequently, safeguarding and protection of the rights of employees, in particular safeguarding of their employment-law relations, is becoming more up to date. La réécriture du droit social maritime au sein du code des transports / The rewriting of the social maritime law rules into the transport code

Le code des transports accueille désormais les règles de droit social maritime. Le gouvernement a été habilité à procéder, en 2010, à une recodification à droit constant de ses dispositions éparses, notamment contenues dans le code du travail et le code du travail maritime. Alors que cette opération devait intervenir sans modification de l’état du droit, une certaine inconstance s’est révélée. La structure de la matière a été bouleversée. Elle démontre une ambivalence : le code des transports est exhibé comme instrument du progrès social, mais il peut également devenir un outil de dérèglementation. D'autant que sa partie réglementaire reste très incomplète. L'articulation du nouveau code avec le code du travail interroge également, notamment sous l'angle des rapports entre le droit commun et le droit spécial. Cette réécriture a, de surcroît, subit l'influence du droit international. L’intégration de la convention du travail maritime de l’Organisation internationale du travail a permis de réaffirmer les principes directeurs au fondement de la matière ainsi que la spécificité du droit applicable aux gens de mer. Pour autant, ces dynamiques normatives ont des effets paradoxaux car le droit international participe tour à tour à la destruction et à la reconstruction des droits nationaux. Aussi, la réécriture de la matière au sein du code des transports pourrait être annonciatrice d’un alignement du fond du droit social maritime sur les standards internationaux qui, à l'échelle du droit national français, ne sont pas nécessairement plus protecteurs. Ce mouvement du droit s'explique par une rude concurrence internationale propice à l'expression du dumping social / The transport code now hosts social maritime law rules. The government was empowered to proceed, in 2010, to a recodification on the basis of established law of its disparate provisions, including those contained in both the labour code and the maritime labour code. Although this operation was to take place without changing the rule of law, a certain instability became obvious. The subject matter's structure was dramatically altered. It reveals an ambivalence : the transport code is exhibited as an instrument of social progress, yet it may also become a deregulation tool. To compound matters, its regulatory aspect remains very incomplete. The articulation of the new code with the labour code is equally perplexing, most notably with regard to the relationship between common law and special law. This rewriting has, in addition, undergone the influence of international law. The integration of the International labour organization's maritime labour convention made it possible to reaffirm the foundational guidelines of this topic as well as the specificity of laws applicable to seafarers. Moreover, these normative dynamics have paradoxical effects. In fact, international law contributes alternately to the destruction and reconstruction of national rights. Thus, the rewriting of the topic within the transport code could be the harbinger of an alignment of maritime social legal foundations with international standards, which, when compared with french law, are not necessarily more protective. This legal evolution reflects is due to a ruthless international competition that enables social dumping conditions

Another focus is to present health and safety coordinator in relation with the institute of work inspection. I would like to draw from practical experience gained at work so I will visit construction sites with a coordinator and an inspector from the institute and consequently I will try to evaluate these inspections. At the end of the thesis I will focus on risk precautions where I will apply one method with which I will solve a practical example.

In her PhD thesis, the author deals with the legal regulation of transfer of undertaking (and the passage of the employees' rights and obligations it involves) and the frequent collective redundancy related to such transfers. Both sets of provisions dealing with these topics are embodied in the Czech Labour Code and are harmonised with the EU directives pertaining to these fields, specifically Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses (originally, Council Directive 77/187/EEC of 14 February 1977 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of businesses) and Council Directive 98/59/EC of 20 July 1998 on the approximation of the laws of the Member States relating to collective redundancies. The two directives mentioned above were already transposed to the Czech Labour Code in 2001 by means of an amendment adopted under No. 155/2001 Coll. The task of the dissertation is an analyse and a summary of problematic of increasing and widespreading of training in the concrete enterprise. The starting point for analyse is the finding out of the basic indicators. The analyses of all system connected with this problematic is followed by the assessment of the found data from the area of education -including improving and widespreading of training , personal planning and care of emploeeyes. Along with all above mentioned , the target of my dissertation is to make some suggestion and to take some measures for possible changes connected with education or social issues. The result of this survey is an improving suggestion related to assessment of effectivness of the gained knowledge - and their using in practice. I have made two assessment forms (they have form of survey) . The next part of my dissertation considers about the state policy of employment. There is (except of role of Labour Bureau, tools of active policy of employment, information about programmes for support of new labour places) also a mention about the financial state support. For this task (and for meeting of each of these targets) I have chosen the enterprise with headquarters in České Budějovice, called Jihočeská plynárenská, joint stock company.

The thesis deals with the topic of employee benefits in the Czech Republic. At first, the thesis sets employee benefits to specific area of the company, which is an in-house social policy of the company. Following part deals with the legislative framework, which regulates the providing of these benefits in 2015. The thesis includes a chapter describing the employee benefits, their structure and their various distribution systems. Analysis of the trends in the provision of employee benefits creates another part of the thesis. Three types of employee benefits are analyzed in detail: meal allowances, educational allowances and contributions to employees' pension savings. In the conclusion of thesis is explored the whole system of employee benefits used in the company Siemens Ltd., where are analyzed its individual benefits and includes evaluation of a questionnaire.

Srovnání českého a slovenského pracovního práva / The comparison of Czech and Slovak labour law

The topic of my master thesis is the comparison of Czech and Slovak labour law. The goal of the paperwork is to compare structure and of content Czech and Slovak labour code, describe the most significant differences in chosen parts and analyse rights and obligations of employees and employers in both countries. At first the basic concept of labour law, his functions and position in legal system are defined. It continues with description of the history of labour law with focus on development of legislation after separation of the Czechoslovak Republic. Thesis analyses main three instituts of Czech and Slovak labour code: commencement of an employment relationship, his termination including financial and others entitlement of employees and agreements of work performed outside an employment relationship. The conclusion containts the partial summaries with emphasis on the biggest differences and evaluation of the hypotesis given at the beginning of the work.
