Assessing the feasibility of land reform farm equity schemes : a focus on capacity building and empowerment

This research was undertaken to determine the extent to which share equity schemes have been successful. The research also investigated the possible causes of failure of the established share equity projects and sought to determine the feasibility requirements that may be put in place to ensure success and sustainability of the ventures in support of land reform. The methodology used involved comparing the data gathered from business plans, valuation reports and other project documents from the Department of Land Affairs (DLA) with the information gathered through interviews and observations. The results revealed causes of failure to include the fact that beneficiaries of the investigated equity schemes did not participate in business plan development or implementation and therefore had no sense of ownership in the intended joint ventures. It was also found that none of the business plans included any form of training for capacity building and therefore no mechanism for empowering beneficiaries existed to participate effectively at all levels of the farming enterprise. Furthermore, original farm owners as the majority shareholders tended to re-invest profits into farm assets rather than paying dividends. It was concluded that the inclusion of a training programme in every business plan is crucial to the success of farm share equity ventures as this may enable beneficiaries to be sufficiently empowered to participate effectively at all levels of the business. / Thesis (M.Env.Dev.) - University of KwaZulu-Natal, Pietermaritzburg, 2006.

The communal land tenure system: an analysis of some trends in the Ditsobotla area of the North West province

Until recently, there have been different and sometimes conflicting views on whether or not the communal land tenure system (CLTS) has a positive or negative impact on rural economic welfare. This study analyses some trends associated with the CLTS in the Ditsobotla area of the NorthWest province, focusing on the implications for rural economic welfare. The results of the study suggest that the CLTS is extremely important in order to sustain the rural economy, and therefore this dissertation presents developmental, policy and research options for consideration by government and other affected stakeholders for the betterment of the livelihood of people in the Ditsobotla area. The study adopts participatory research techniques in the selected villages of Springbokpan and Mooifontein. It also reflects on land tenure experiences in other African countries. The dissertation concludes with a suggestion that the South African government should engage in in-depth research programmes prior to the implementation of the envisaged communal land tenure reform legislation and that, the state should secure sufficient funding to boost agricultural activities in the area. Taking all these factors into account, a view is held that all developmental endeavours in the area must be informed by the collective participation of the affected local people, and their efforts must be united for the enhancement of their livelihood. / Development Studies / M.A. (Development Studies)

The impact of employment equity legislation on land reform delivery within the provincial land reform office of the department of rural development and land reform in the Western Cape

Thesis (MTech (Public Management))--Cape Peninsula University of Technology, 2011. / The main objective of this research was to evaluate the impact of Employment Equity Legislation on land reform delivery within the Provincial Land Reform Office of the Department of Rural Development and Land Reform in the Western Cape Province. In order to achieve this goal the researcher conducted a literature search of relevant books, journal articles, academic papers, news paper articles, legislation and subordinate legislation, policy documents, official reports, other applicable published and unpublished research materials. In conjunction with the literature search, the researcher developed a survey questionnaire to establish whether employment equity legislation does have a negative impact on land reform delivery within the provincial land reform office in the Western Cape. The survey was conducted arnonqst 60 employees within the Provincial Land Reform Office in Cape Town, including the District Offices of the Provincial Office. Fifty four (54) responses were used in the analysis, which represent a 90% rate of return. Based on the findings of the literature study and the empirical survey, 51.9% respondents' are of the opinion that the implementation of employment equity legislation does have a negative impact on land reform delivery within the provincial land reform office of the Western Cape. The researcher recommends that the department should consider using provincial demographics when employing staff within its provincial offices to ensure a more stable workforce. This is a true reflection of the responses as the majority of the respondents (81.5 %) agreed that Employment Equity (EE) targets should be based on provincial demographics rather than national demographics, whilst 13% of the respondents disagreed with this statement. Seventy seven comma eight percent (77.8 %) of the respondents also agreed that EE should reflect the target market being served. This will go a long way to foster good employer - employee relationships.

An evaluation of the effects of land tenure security in on-farm investment and on-farm productivity: a case of the smallholder farmers in the Amathole District of the Eastern Cape Province of South Africa

Smallholder agriculture contributes to poverty alleviation through food price reduction and employment creation. Smallholder farmers have the potential of creating employment because they are labour-intensive. Most small holder farmers in the Amathole District practices dual farming system i.e. crops and livestock production. However these farmers are faced by a number of constraints amongst these are land tenure security, lack of capital, drought, diseases, lack of access to markets and production inputs. The objectives of this study were: to investigate land tenure security impact on-farm investment and on-farm productivity by the smallholder farmers; to assess constraints encountered by the smallholder farmers, to identify factors influencing on-farm investment by the smallholder farmers and to identify factors influencing on-farm productivity by the smallholder farmers. Eighty smallholder farmers were interviewed using a structured questionnaire. The data was analyzed using descriptive statistics (frequency, percentages) and regression analyses. Data was for coded and processed for analysis using Statistical Package for Social Sciences (SPSS). The results revealed that generally, the household demographic characteristics have an influence on the decision to investment in the farm thus on farm productivity. These included age, gender, marital status, educational level and household size of the smallholder farmers. However the findings revealed that smallholder farmers were not much concerned with the land tenure security of the land as they see themselves as owners of these lands. The reason being that they always had access to their land and there were no perceived tenure insecurity threats. The majority of the smallholder farmers were not worried that they might lose their land in the future as they felt that their land tenure was secured. Although, the majority of farmers had some sense of security they still preferred a freehold tenure system as form of land tenure security. This suggests that there was a sense of insecurity among some of the smallholder farmers caused by their current tenure forms. Majority (66%) of the farmers held their land under freehold whilst leasehold and communal hold farmers constituted 5 % and 29 % respectively. Even though majority had freehold tenure system, they could not use their land as collateral when required for funding from the lending institutions because the title deeds were not registered in their names but those of deceased family members. As a result the majority was constrained by lack of credit and had low income. Lack of cash suggests that the farmers have difficulties in purchasing farm of the survey suggest that the household demographics and socio-economic variables may have an influence on the on-farm investment and on-farm productivity by the smallholder farmers. Furthermore, besides the challenges with land tenure, there are other factors that are likely to influence on-farm investment and on-farm productivity. The results of the survey revealed that smallholder farmers were faced with lot of challenges. These included lack of access to markets, grazing land, credit, farm implements, productions inputs and irrigation water. In addition to this the smallholder farmers were faced with both crops and livestock production constraints. Crop production constraints included lack of access to labour, transport, capital, storage facilities, pests, diseases, lack of management skills and severe drought. Livestock production was constrained by diseases, theft, attack by wild animals, lack of fence in the camps, labour, vaccines, dipping facilities too far and severe drought. For both crop and livestock production diseases and drought were major concerns for smallholder farmers since they were dependent on rainfall for their farming activities. With regards to improvements and investment there was little or not much investment that has been made by the smallholder farmers. One of the reasons mentioned by the farmers as the main cause for little or no investments is the lack of capital to make such improvements or investments. The study also employed empirical analysis through employing on-farm investment and on-farm productivity models of the study on the factors influencing the on-farm investment and on-farm productivity by the smallholder farmers in the study area. In both models, the independent variables were tested for their significance and it was found that some variables were significant whilst others were not. With regards to the dependent variable on-farm investment, household socio-economic factors such as household size, educational levels and farm size, had a positive influence in on-farm investment and were also statistically significant. On the other side, factors such as land tenure security, age, gender, household income and access to markets did not have any influence and were not statistically significant. From the perspective of on-farm productivity variables such as farm size, access to credit and access to extension services had a positive influence. However, variables such as land tenure security, age, household income, educational levels, access to implements, were negatively influencing onfarm productivity by the smallholder farmers. The governance and management of commonages in three small towns in the Eastern Cape, South Africa

Commonage is land that is usually found adjacent to a town, which is owned by the local municipality and acquired through state grants or, historically, through the church. Since the new government dispensation in 1994, poor and previously disadvantaged residents have acquired access rights to commonage for agricultural purposes. Through the Department of Land Affair’s Commonage Programme, local municipalities are acquiring more commonage land for purposes of agriculture and grazing livestock. Commonages are increasingly being recognised as an important livelihood asset for the poor and unemployed residents’ of towns and rapid urbanisation is contributing to the increasing use of commonage for livelihood provisioning. Some municipalities view commonage as a key asset to promote Local Economic Development, while others are finding it difficult to manage the land effectively, to the extent that some analysts see tragic ecological consequences occurring due to over-grazing. This has been likened to the “tragedy of the commons” as advocated by Hardin in 1968. Commonage and common property resource systems have many similarities and co-management has been advocated as a potential management regime for commonage. Researching the policy framework, institutional structures and management bodies involved in commonage, gave a better understanding of the governance and management of the commonages in Grahamstown, Fort Beaufort and Bathurst. Current management attempts are not ensuring the efficient, equitable and sustainable use of these commonages. The governance framework is not adequately supporting proper management. In an environment of resource-poor institutional bodies, adaptive co-management could prove to be the most effective system to ensure the sustainable use and development of this natural resource. Furthermore, commonage is no longer contributing to the Land Reform Programme. Commonage should be better integrated into agrarian reform through lease schemes and an efficient Emerging Farmer Programme.

A history of the Thembu and their relationship with the Cape, 1850-1900

Present day Thembuland is situated roughly between the Mthatha and Kei rivers. It lies within the south-western portion of the political unit which has been known since 1976 as the Republic of Transkei. It comprises the territories formerly known as Emigrant Thembuland (now the districts of Cala and Cofimvaba) and Thembuland Proper, i.e. the districts of Mqanduli, Umtata, Engcobo and Bomvanaland. We have evidence that Thembu people had already settled in Thembu land Proper, at the Mbashe river, by the beginning of the 17th century. Pioneering clans many have entered the territory at a much earlier date. In the 1830's some clans broke away from the Mbashe settlement, and moved to the region of present day Queenstown. In 1853 their lands were included in the so-called Tambookie Location, which in 1871 became the district of Glen Grey. Emigrant Thembuland came into existence in 1865 when four chiefs from Glen Grey accepted Sir Philip Wodehouse's offer to settle on the lands across the White Kei whence the Xhosa chief Sarhili had been expelled in 1857. This thesis deals with the history of the people who lived in these territories between 1850 and 1900.

Access to land as a human right the payment of just and equitable compensation for dispossessed land in South Africa

This thesis deals with the conceptualization of access to land by the dispossessed as a human right and commences with an account of the struggle for land between the peoples of African and European extractions in South Africa. It is observed that the latter assumed sovereignty over the ancestral lands of the former. The thesis discusses the theoretical foundation of the study and situates the topic within its conceptual parameters. The writer examines the notions of justice and equity in the context of the post apartheid constitutional mandate to redress the skewed policy of the past. It is argued that the dispossession of Africans from lands that they had possessed for thousands of years on the assumption that the land was terra nullius was profoundly iniquitous and unjust. Although the study is technically limited to dispossessions occurring on or after the 13th June 1913, it covers a fairly extensive account of dispossession predating this date. This historical analysis is imperative for two reasons. Besides supporting the writer’s contention that the limitation of restitution to land dispossessed on or after 1913 was arbitrary, it also highlights both the material and non-material cost of the devastating wars of dispossessions. The candidate comments extensively on the post apartheid constitutional property structure which was conceived as a redress to the imbalance created by dispossession. This underlying objective explains why the state’s present land policy is geared towards facilitating access to land for the landless. The thesis investigates the extent to which the present property structure which defines access to land as a human right has succeeded in achieving the stated objective. It reviews the strengths and weaknesses of the land restitution process as well as the question of the payment of just and equitable compensation for land expropriated for restitution. The latter was carefully examined because it plays a crucial role in the success or otherwise of the restitution scheme. The writer argues that the courts have, on occasions, construed just and equitable compensation generously. This approach has failed to reflect the moral component inherent in the Aristotelian corrective justice. This, in the context of South Africa, requires compensation to reflect the fact that what is being paid for is land dispossessed from the forebears of indigenous inhabitants. It seems obvious that the scales of justice are tilted heavily in favour of the propertied class whose ancestors were responsible for this dispossession. This has a ripple effect on the pace of the restitution process. It also seems to have the effect of favouring the property class at the expense of the entire restitution process. The candidate also comments on the court’s differing approaches to the interpretation of the constitutional property clause. The candidate contends that the construction of the property clause and related pieces of legislation in a manner that stresses the maintenance of a balance between private property interest and land reform is flawed. This contention is supported by the fact that these values do not have proportional worth in the present property context of South Africa. The narrow definition of “past racially discriminatory law and practices” and labour tenant as used in the relevant post apartheid land reform laws is criticized for the same reason of its uncontextual approach. A comparative appraisal of similar developments relating to property law in other societies like India and Zimbabwe has been done. The writer has treated the post reform land evictions as a form of dispossession. The candidate notes that the country should guard against allowing the disastrous developments in Zimbabwe to influence events in the country and calls for an amendment of the property clause of the constitution in response to the practical difficulties which a decade of the operation of the current constitution has revealed.

A critical analysis of land redistribution and economic development of farm workers in the Stellenbosch Agricultural Area : a research treatise

This study critically analyzed land redistribution and economic empowerment of farm workers in the Stellenbosch agricultural area. Past socio-economic and political policies have resulted in a racially skewed and inequitable distribution of land as well as overcrowding, overstocking and poverty in the countryside. It has become imperative that fundamental change is brought about in order to improve economical opportunities of all South Africans to access land for beneficial and productive use. Land reform, as the central thrust of land policy, is not only part of the effort towards the creation of equitable land distribution, but also of national reconciliation and stability. This study analyzed the notion of economic empowerment of farm workers. It looked at historical overview of the evolution of politics in South Africa and contemporary legislative framework pertaining to land redistribution and farm workers in the Western Cape. A case study of Bouwland farm in the Stellenbosch agricultural area was used as an example of how land redistribution can contribute to economically empower farm workers.

Traditional leadership and the use of cultural laws in land administration: implications for rural women's land rights in a transforming South Africa

This dissertation critically examines how traditional leaders use cultural laws to allocate land to women and to allow women to participate in land administration in communal areas. Given the government's commitment to gender equity in all spheres of life as stipulated in Section 9 (3) of the South African Constitution (Act 108 of 1996), the dissertation examines whether related legislation and policy (such as CLARA and TLGFA) alone can guarantee equitable access to land for women and their participation in land administration structures in communal areas where patriarchy dominates. In essence, the study interrogates whether state intervention through formalizing laws that govern land matters do achieve gender equity while cultural laws still exist in communal areas. Based on the view that land in communal areas is held by the state and administered by traditional leaders who have historically discriminated against women, the dissertation employs a case study method to examine whether cultural laws are exercised when women apply for a piece of land at the three levels of traditional authority viz: village, sub-village and traditional council levels in the Matolweni village of the Nqadu Tribal Authority. Although women are often the de facto rights holders in rural areas as a result of male migration to urban areas, findings seem to indicate that it is difficult and/or sometimes impossible to translate paper laws into practice while cultural laws are still operating. For effective transformation to occur, the study recommends that unless a strong women's rural movement emerges, coupled with a socialist feminist position that advocates for a radical transformation of rural society to defeat the patriarchal norms and standards, traditional leaders will continue to discriminate against women in land issues.

Assessment of the determinants of access to land for development in Mutale Local Municipality of Limpopo Province

MRDV / Institute for Rural Development / The study was carried out to assess the community-perceived determinants of access to land for development in Mutale Local Municipality. It was conducted in the Makuya and Mutele Traditional Authority areas of the former Mutale Local Municipality. All the views relating to access to land for housing, agriculture and business development expressed during the Vhembe District Land Development Summits and Forum meetings held in 2008, 2010 and 2014 were consolidated. Using this information, a questionnaire comprising entirely closed-ended answers requiring responses on a Likert-type scale of 1 (strongly agree) to 5 (strongly disagree) was prepared. The questionnaire was administered through focus group discussions in community workshops during which youth (male and female), women, men and community leaders were the respondents. Open-ended questions were also administered focusing on the factors hindering or enabling access to land, and solutions that the community perceived needed to be taken. Mean and mode for each response were calculated. Chi-Square tests for association were conducted to determine whether there was any association in the responses obtained from the traditional authority areas. Kruskal Wallis and Mann-Whitney tests were conducted to determine the level of agreement of perceptions respondents with Vhembe district land development summits resolutions among youth, adults and community leaders. There were no statistically significant differences (P > 0.05) in perception of issues relating to access to land for housing, agriculture and business development of land development. Thus, the issues are real and should form a solid basis for planning interventions that might unlock access to land for different types of uses. Moreover, improving transparency and deepening community participation and consultation over classification and sale of unoccupied land could minimise the likelihood of potential land conflict.
