A investigação realizada se deu no contexto da diferenciação entre produção acadêmico-científica sobre o Direito, Teoria e Decisão Jurídica. A produção acadêmica pertence ao Sistema da Ciência, a decisão jurídica ao Sistema do Direito e a Teoria do Direito trata-se de acoplamento entre os dois Sistemas. A problemática investigativa partiu da indagação acerca da possibilidade da produção acadêmico-científica sobre o Direito comunicada pelos Programas de Pós-Graduação Stricto Sensu em Direito no Brasil produzir irritações na Dogmática. Considerando o aumento significativo da produção científico-jurídica nas últimas décadas e a constante complexificação das demandas sócio-jurídicas inerentes ao cenário policontextural, a tese apresenta o que o Sistema da Ciência observa (produção acadêmico-científica sobre o Direito) sobre o que o Sistema auto-observa (Dogmática). Elegeu-se a teoria dos sistemas de Niklas Luhmann e suas releituras contemporâneas como suporte teórico. A observação temática das teses dos Programas de Pós-Graduação em Direito avaliados com conceito 6 pela CAPES bem como dos recursos julgados pelo Tribunal de Justiça de Santa Catarina no período entre 2013 e 2015 foi realizada a partir da Análise Textual Discursiva estabelecendo-se assim, as possíveis relações entre produção acadêmico-científica e decisões. Tal observação considerou também os diversos acoplamentos entre as organizações do Sistema da Ciência com outros Sistemas e as diversas orientações legais e administrativas que interferem na produção científica. Concluiu-se que há baixa capacidade de assimilação da produção acadêmica pela Dogmática jurídica e parca capacidade de impacto da produção científica sobre o Direito. Isso ocorre por três motivos que se complementam: a autopoiese dos dois Sistemas observados como fator limitador da interferência intersistêmica; o papel das organizações que estão envolvidas na produção do conhecimento científico jurídico no Brasil bem como na organização da pesquisa e dos Programas de Pós-Graduação Stricto Sensu em Direito; a dissonância temática entre o que se observa cientificamente e o que o Direito auto-observa. / This thesis studies the Systems of Law and Science and observes their intersystemic relationships and the production of academic-scientific knowledge about the Law as a possibility of irritation in Juridical Dogmatics before the requirement of judicial decisions in the context of social complexity. The investigation was conducted in the context of differentiation between scientific-academic production about the Law, Theory and Juridical Decision. The academic production belong to the Science System, judicial decision belong to the Law System, and Theory of Law is the coupling of the two systems. Investigation problem was started from the inquiry about the possibility of academic-scientific production on Law communicated through Strictu-sensu Post-Graduate Law Programs in Brazil produce irritations in Dogmatics. Considering the significant increase in scientific-juridical production about the Law in recent decades and the continuous increase in complexity of social-juridical requirements inherent to the policontextual scenery, the thesis presents what the Science System observes (scientific-academic production on Law) regarding what the System observes (Dogmatics). Niklas Luhmann's Theory of Systems and contemporary re-lectures was elected as theoretic support. The thematic observation of Post-Graduate Law theses evaluated with grade 6 by CAPES, as well as the recourses judged by the Santa Catarina State Justice Court in the period of 2013 to 2015, was based on the Discursive Text Analysis, thus establishing the possible connection between academic-scientific production and the decisions. This analysis also considered the various couplings between the organizations of the Science System with other systems and the different legal and administrative orientations which interfere in the scientific production. The conclusion reached was that there is low capacity for the academic production to be assimilated by juridical Dogmatics, and an even lower capacity of impact of the scientific production on the Law. This happens due to three connected reasons: the autopoiesis of the two Systems observed as a limiting factor for intersystem interference; the role of organizations involved in the production of juridical-scientific knowledge in Brazil, as well in the organization of research and of Stricto Sensu Post-Graduate Law Programs; the thematic dissonance between what can be scientifically observed and what Law self-observes .

Rechtsökonomik als Rechtsanwendungsmethode

Die bisherigen Heranziehungsmodelle der Rechtsökonomik bei der Rechtsanwendung geht vor allem davon aus, dass die Effizienz als Rechtsprinzip in bestimmten Rechtsordnungen inbegriffen ist. Dies schränkt aber die Rolle der Rechtsökonomik für die Rechtsanwendung ein. Da der Rechtsanwender in Deutschland sowohl am geltenden Recht als auch an wissenschaftlichen Gesetzen binden soll, kann die Rechtsökonomik als die im Sinne vom kritischen Rationalismus genannte Wissenschaft zur Erklärung menschlichen Verhaltens unter Berücksichtigung der gegebenen Rechtszuordnungen bezeichnet werden. Daraus ergibt sich, dass die aus der wissenschaftlichen Rechtsökonomik abgeleitete Gesetzmäßigkeit dem Rechtsanwender nachkommen soll, sodass die Rechtsökonomik als Rechtsanwendungsmethode unbeschränkt bei der Rechtsanwendung verwertet werden kann. Bei der Auswahl rechtsdogmatischer Lehrsätze bei der Rechtsanwendung ist das Werturteil unvermeidlich, mithilfe des vom kritischen Rationalismus vertretenen Brückenprinzips und Komparativismus kann die Werturteilproblematik bei der Rechtsanwendung durch die positive Wissenschaft und Rechtsökonomik gelöst werden. Die konkrete Methode zur Auswahl rechtsdogmatischer Lehrsätze ist es, dass durch die positive Rechtsökonomik diese rechtsdogmatische Lehre auszuwählen ist, die im Vergleich mit anderen konkurrierenden Lehren das restriktive Minimum der Transaktionskosten darstellt und somit die faktische Geltung der entsprechenden rechtlichen Regelung unter dem gegebenen Umstand am höchsten verwirklicht. / The previous application models of economics of law in the judicial application assume that efficiency as a legal principle is included in the jurisdiction. However, this limits the role of economics of law in the judicial application. As the legal practitioner in Germany shall obey applicable laws and scientific laws, economics of law can be recognized as a real science in the sense of critical rationalism, explaining the human behavior under the condition of the given legal order. It follows that the regularity derived from the scientific economics of law shall be complied with by the legal practitioner, so that the economics of law can be indefinitely used in the judicial application. By selecting the concrete legal dogmatic doctrines in the judicial application, the value judgement is inevitable. With the help of bridge principle and comparativism of the critical rationalism, the value judgement problem can be resolved through the positive science and the positive economics of law. The concrete method of selecting legal dogmatic doctrines is that the legal dogmatic doctrine, which represents the restrictive minimum of the transaction costs and thus realizes the de facto validity of the relevant legal provisions under the given circumstance in highest grade, shall be selected through the positive economics of law.

'Le parfait Ambassadeur' : the theory and practice of diplomacy in the century following the Peace of Westphalia

This thesis examines the theory of diplomacy in the formative phase of the European states-system. From the viewpoint of the discourse on the 'ideal ambassador', it explores early modern diplomacy as cultural history encompassing ideas, discourses, perceptions and 'codes'. The scope of study is the century following the Peace of Westphalia (1648), and three states and regions (France, Britain, the Holy Roman Empire) serve as case studies for a comparative approach of diplomatic theory and practice. In five parts, the adaptation of the theory and practice of diplomacy to the new demands of international relations after 1648 are considered. The first section sets the stage by illustrating that the mid-seventeenth century was regarded as a turning point in the practice of diplomacy. Part II examines diplomatic theory as a particular 'language' in its intellectual and socio-professional contexts. While published treatises on the 'ideal ambassador' build the core of this study, related genres of international law theory, ceremonial theory and political and state science are also taken into account. From the viewpoint of this diplomatic theory, the following section examines the ways in which the instruments and practices of diplomacy were aligned to the new framework. These ranged from changes in the structural framework of diplomacy to the evolution of norms and procedures of negotiation, international law and ceremonial. Part IV reconsiders the issue of 'professionalism' in diplomatic theory with regard to the preparation and training of diplomats. Special attention is given to proposals for diplomatic 'academies', which are for the first time examined in comparison. Finally, section V recasts the findings of this thesis in a comparative perspective. It underlines that, with the emergence of a states-system, the techniques of diplomacy became formalised and uniform, constituting a common European diplomatic practice. Against the background of the different regional and structural conditions, the alleged model role of France in the evolution of diplomatic theory and practice is re-evaluated.

Rethinking money laundering offences : a global comparative analysis

Since the late 1980s, efforts made by the international community to deal with the complex and global problem of money laundering have stimulated the creation and definition of the so-called 'international crime of money laundering', which is included in various United Nations and Council of Europe international treaties, as well as European Union Directives. The Central purpose of this thesis is to investigate if the main goal of effectiveness in the adaptation of the international crime of money laundering at the domestic level, might undermine other values that international law is seeking to protect, namely the guarantee of due process and the adequate protection of human rights principles. Then, if the adoption of any element of the crime shows to be inconsistent with civil rights and guarantees, to propose how deficiencies could be remedied.
