The Effects of Content and Layout Variation in Newspaper Advertising for Legal Services

The focus of this investigation is on the effects that content and layout forms of newspaper advertising have on consumer attitudes toward the legal profession. A second major purpose of the study was to determine the differences which exist between certain socio-demographic categories with respect to attitude towards the advertised lawyer and the legal advertisements. Thirteen variations of a legal advertisement for the newspaper medium were developed and shown to consumers and then tested by measuring consumers' attitudes toward twelve lawyer-related attributes and ten advertisement-related attributes.

The sale of law : ethical advising and advocacy in light of billing for civil litigation services

This thesis identifies the financial incentives of litigants and lawyers to behave in certain ways in relation to civil litigation files. By identifying such incentives, this thesis raises questions about the extent to which substantive and procedural private law is capable of being influenced by them. Specifically, this thesis argues that: lawyers have a lawmaking function within the private law system; lawyers have financial incentives distinct from those of their clients; and the costs of retaining lawyers produce observable incentives and effects on the outcomes of civil litigation matters. In addition to the many theoretical materials cited, empirical data have been cited from research observing the legal profession in North America and elsewhere. This thesis argues that external influences--such as financial incentives for non-parties--can affect the way private law applies and develops. This thesis also identifies general regulatory strategies that might limit the influence of external factors on private law.

The political significance of popular illegalities in post-apartheid South Africa

This thesis discusses the significance of popular illegalities in contemporary South African service delivery. Illegal access to and non-payment of services have been indentified by the government as a major criminal problem which undermines effective service delivery. By contrast, this thesis argues that popular illegalities are positive phenomenon which provides otherwise unobtainable benefits for the poor and also exposes the ability of communities to self-manage their own service provision. The thesis begins by surveying a variety of literature on this issue using both contemporary and historical literature. I then discuss the scope of popular illegalities in South Africa and the methods government has used to curtail them, with a particular emphasis on how this has been influenced by the adoption of neo-liberal cost recovery initiatives. Using case studies of three communities where illegal access is prevalent, I discuss both the motivations behind and significance of illegal water and electricity connections. In conclusion, I argue that popular illegalities are a significant phenomenon in so far as they suggest new methods of delivering services. The prevalence of these illegalities is also important as it highlights many of the failings of official delivery. The thesis concludes on a hopeful note in arguing that illegalities may be inherently progressive in both benefiting the marginal and leading to the creation of radically autonomous spaces which can be viewed as laboratories of radical social change.

Effective change leadership is important to any organisation undergoing fundamental transformation. In particular, the ability of senior public sector leaders to successfully drive strategic change is crucial to meeting the developmental and service delivery challenges faced by the Province of the Eastern Cape in ensuring the effective, efficient and innovative government demanded by all its various stakeholders. The creation on 3 October of a Shared Legal Service situated in the Office of the Premier provided a unique opportunity to examine the leadership of this change initiative in the context of the organisational culture that existed in the provincial public service. This thesis consequently probes the phenomenon of effective change leadership by means of an examination of the understandings of the three change agents involved in driving the transformation of the provision of legal advisory services to the provincial administration and its constituent departments. The picture which emerges from the insights of the participants is one that casts a shadow over the validity of the contemporary theory of transformational leadership. Furthermore, the research conducted has identified the need to view the nature of effective change leadership through a more nuanced, situation-specific lens: one that appreciates the role of relationships and emotions, and that recognises the importance of culture and its impact on the success of organisational transformation. The case study of the Shared Legal Service change initiative provides useful insights into the many and varied challenges faced by public sector leaders in driving strategic transformation in the provincial administration. It offers an example of successful change leadership and demonstrates the need for change agents within the public service to harness more emotionally resonant and relational forms of leadership if they are to soar to new heights in meeting the service delivery expectations of all who look to provincial government to deliver the fruits of democracy.

Challenging Nonprofit Legal Services: Four Cases from New Orleans, 1970 - 2004

During the past century, lawyers in New Orleans created a number of organizations to provide legal services for the poor, as lawyers did throughout the country. Most of those organizations provided routine service directly to individual clients and received quiet acceptance within the city and the state. However, more aggressive lawyers in other legal services offices engaged in law reform or challenged politically powerful interests. These offices found themselves embroiled in controversy and facing impediments that were placed in the way of their work. This dissertation introduces nonprofit legal services in New Orleans, but focuses on and investigates the experiences of four organizations – the New Orleans Legal Assistance Corporation, the Tulane Environmental Law Clinic, the Louisiana Capital Assistance Center, and the Advocacy Center – that were involved in controversies. This investigation differs from most prior studies of legal assistance in several ways. First, it discusses a variety of local legal service organizations rather than concentrating on the legal aid movement of the first half of the twentieth century, or the later Legal Services Program and its successor Legal Services Corporation. Secondly, it provides detailed discussion of several New Orleans legal services, which had previously been limited to scrutiny of the Tulane Environmental Law Clinic. Most importantly, it goes beyond description to provide causal explanation for the controversies by reference to social structure, and the social mechanisms and social processes at work. The dissertation presents access to law by the poor as being a form of "largesse" or charity or gift, which is granted when it is convenient for the powerful, but withheld when it is inconvenient for the powerful. From this perspective, the controversies resulted from the opposing interests of the two major social classes in modern capitalist society, with the politically powerful objecting to certain legal victories or gains achieved by the poor. In addition to the New Orleans cases, the dissertation refers to other legal services offices throughout the country that experienced similar problems. This demonstrates that the underlying issues are not limited to the city of New Orleans or the state of Louisiana, but are national in scope.

The aim of this thesis is to analyse legal regulations of marketing and advertising in the Czech Republic as well as in the European context and define possibilities of applications of marketing methods and tools in the field of legal services. This is followed by a detailed elaboration for advocacy being the most marketable branch within this field. Based on the analysis of classic marketing mix tools, the aim is to create a set of marketing instruments suitable for the selected field of advocacy services. The thesis takes into consideration particularly strong characteristics of legal services as such. The theoretical part of the thesis is opened by a chapter dealing with the issue of marketing in general. Defining the respective branch and identifying its basic descriptive signs creates a terminology basis for further development of the subject. Special attention is paid to individual key marketing components, the main one being the strategic marketing management and its main variables composed of the following: company mission, company objectives, company strategies and company opportunities. This analysis is justified by the currency and importance of the subject in both national and international settings, and its relationship with constitutional principles and objectives. The hypothesis is that human rights education can contribute significantly to the realization of democracy and human rights, including in cases involving discrimination and exclusion, and that Legal Services have an important role therein. First, the meanings and main issues pertaining to education, human rights and democracy are analyzed in association with the subject are analyzed in a historical-critical study. Then, the several aspects of human rights education and applicable national and international regulations are examined.
