1 Abstract This diploma thesis deals with the analysis of the issue of sanctioning of legal persons as well as with selected aspects of criminal liability of legal persons. The main reason why I chose this topic is my deep interest in analyzing the discussed issues together with the evaluation of the current state of the Act No. 418/2011 Coll., On Criminal Liability of Legal Persons and the Proceedings against them, and on the basis of this evaluation to submit proposals for improvement. At the beginning of this work, the reader will find a presentation of the basic structure, along with an outline of the main goals of the thesis, and then it will be divided into five basic chapters. The first chapter defines the basic concepts of criminal liability of legal persons related to their sanctioning. There is a theoretical definition of a legal person due to the absence of a definition of this term in czech criminal law. After defining the theoretical basis of criminal liability of legal persons, the development of this institute is outlined, together with the question of sanctioning the legal persons that are primarily involved in this work. La condition pénale de l'enfant avant sa naissance : de la non-reconnaissance à la protection / The criminal status of the child before being born : from the non recognition to the protection

Débat social et juridique, la condition pénale de l’enfant à naître s’est, dans un premier temps, cristallisée autour de la question de l’interruption volontaire de grossesse. Cette question a ensuite trouvé un prolongement dans la jurisprudence criminelle relative à l’atteinte involontaire à la vie d'un enfant à naître. La situation pénale de l’enfant avant sa naissance est caractérisée par une absence de reconnaissance de sa qualité de victime. Les interrogations relatives à la condition juridique de l’enfant conçu ont également été renouvelées par les différentes lois bioéthiques et le sort réservé aux embryons surnuméraires. L’indétermination du statut juridique de l’enfant avant sa naissance trouve des éléments de réponse dans la confusion notionnelle qui règne autour de la notion de personne. Parallèlement, une analyse erronée des législations qui autorisent les atteintes portées à la vie embryonnaire sclérose sa situation juridique. La condition pénale de l’enfant avant sa naissance doit évoluer vers une reconnaissance de sa personnalité humaine. Les notions consubstantielles de personne humaine et de dignité sont les outils notionnels au service de la reconnaissance pénale de l’être avant sa naissance. Cette protection pénale de la vie anténatale doit s’organiser parallèlement à la protection pénale de la liberté procréative de la femme. / Social and legal debate, the criminal condition of the unborn child has first centered around the issue of termination of pregnancy. This issue has then found an extension in criminal case-law concerning the involuntary infringement on the life of the unborn child. The criminal situation of the child before his/her birth is characterized by a lack of identification of its status as a victim. The questions about the legal status of the conceived child have also been renewed by the various laws on bioethics and the fate of surplus embryos. Some answers about the indeterminate character of the legal status of the child before his/her birth can be found in the notional confusion which surrounds the notion of person. At the same time, an erroneous analysis of the legislations which allow attempting to damage the embryo’s life block the evolution of its legal status. The criminal condition of the unborn child must tend towards a recognition of his/her human personality. The consubstantial notions of human being and dignity will be the notional tools helping to acknowledge the criminal status of the person before his/her birth. This criminal protection of the pre-birth life must be concomitantly organized with the criminal protection of the liberty of a woman to conceive a child.

Analytic Functionalism as a Foundation for the Contention that a Non-Biological Machine (Android) can be Viewed as Both a Legal and a Moral Person

abstract: This Thesis contends that if the designer of a non-biological machine (android) can establish that the machine exhibits certain specified behaviors or characteristics, then there is no principled reason to deny that the machine can be considered a legal person. The thesis also states that given a related but not necessarily identical set of characteristics, there is no principled reason to deny that the non-biological machine can make a claim to a level of moral personhood. It is the purpose of my analysis to delineate some of the specified behaviors required for each of these conditions so as to provide guidance and understanding to designers seeking to establish criteria for creation of such machines. Implicit in the stated thesis are assumptions concerning what is meant by a non-biological machine. I use analytic functionalism as a mechanism to establish a framework within which to operate. In order to develop this framework it is necessary to provide an analysis of what currently constitutes the attributes of a legal person, and to likewise examine what are the roots of the claim to moral personhood. This analysis consists of a treatment of the concept of legal personhood starting with the Greek and Roman views and tracing the line of development through the modern era. This examination then explores at a more abstract level what it means to be a person. Next, I examine law's role as a normative system, placing it within the context of the previous discussions. Then, criteria such as autonomy and intentionality are discussed in detail and are related to the over all analysis of the thesis. Following this, moral personhood is examined using the animal rights movement of the last thirty years as an argument by analogy to the question posed by the thesis. Finally, all of the above concepts are combined in a way that will provide a basis for analyzing and testing future assertions that a non-biological entity has a plausible claim for legal or moral personhood. If such an entity exhibits the type of intentionality and autonomy which humans view as the foundation of practical reason, in combination with other indicia of sentience described by "folk psychology", analytic functionalism suggests that there is no principled reason to deny the android's claim to rights. / Dissertation/Thesis / M.S. Nous sommes partis, dans notre recherche, d’une analyse étymologique du mot persona. Ainsi,nous avons commencé notre recherche avec la tentative d'en circonscrire l’objet entre les limitesd’une dynamique linguistique de la subjectivité juridique. Dans cette perspective, nous avonschoisi une définition fondamentalement normative de subjectivité juridique: dans un senspurement normatif, les personnes morales sont des entités capables d’agir et de produire desfaits juridiquement significatifs. Le droit pénal est un droit des “faits”2. Autrement dit, un droitqui prend pour objet de sa discipline les faits dérivants des actions ou des omissions matérielles.Ainsi, nous devrions en déduire que les personnes morales devraient être considérées commedes sujets provenant d’un phénomène autonome pré-juridique. Cette dérivation, en tant quephénomène pré-juridique, trouve son évidence dans la constatation historique de l’existence desentités collectives créées de fait et de la constatation que leur existence, ainsi déterminée, donnelieu à des faits sociaux objectivement constatables. Certes, dans l’histoire de la définitiondoctrinaire des personnes morales, l’observation selon laquelle ce sont les personnes physiquesqui agissent matériellement au sein des personnes morales a suscité nombreuses difficultés. Ils’agit ici de savoir si, lorsque l'on parle de la personne morale, nous entendons fictivement faireréférence à l’ensemble des individus qui la constitue par le biais d’un mécanisme pratique desimplification juridique ou, au contraire, si nous faisons référence plutôt à une unité collectivedotée d’une autonomie propre par rapport aux individualités humaines qui la composent. / This juridic inquiry aim at definition of model of penal responsibility (or para-penal) forcorporations, trough a theoretical analyse of corporation’s personality nature. It hasdeveloped a responsibility model, with the purpose of combining the theoretical coherencewith an adequate generalization degree, for launch of harmonized rules to this matter in theEU. This purpose has run into certains difficulties, in particular it needed to: 1) convergecriminologies reasons with contemporaries concepts concerning risk, precaution's andprevention's principles; 2) face the problem of State’s legal person and his membersresponsibility; 3) to exceed deeps differences among nationals pragmatic systems andnationals systems most keen to doctrinal elaborations. Thesis title: Curatorship The thesis deals with the legal institute of curatorship, as one of the forms of representation, which is intended to protect and fulfill the rights and interests of the person represented. The thesis is primarily focused on substantive legislation contained in an Act No. 89/2012 Coll., The Civil Code. Despite the fact that this thesis is focused on substantive legislation, it also discusses related procedural issues. This diploma thesis is divided into introduction, six chapters and a conclusion. The first chapter describes historical basis of curatorship and also a short glimpse to the previous legislation. The next chapter introduces fundamental terms and explains the systematic inclusion of legislation governing curatorship in an Act No. 89/2012 Coll. The core of this thesis is chapter three, which analyses the legislation of curatorship of an individual. This chapter also introduces related legal institutes such as limitation of legal capacity and declaration in anticipation of incapacity. Chapter three focuses on adult curatorship law as well as on curatorship law of minors. It deals with the arguments of supporters and opponents of implementation, as compared to criminal and administrative sanctions of legal persons. The author critically assesses the reasons which led to the adoption of the law on criminal liability of legal persons and proceedings against them. There is also a description of the problematic provisions of this Act. Sanctioning of legal persons Abstract This thesis focuses on criminal responsibility of legal persons, with an emphasis on sanctioning. The thesis examines the Act No. 418/2011 Coll., On Criminal Liability of Legal Persons and the Proceedings against them (hereinafter as "the Act"). 1 Criminal proceedings against legal persons Abstract On the first of January 2012, criminal liability of legal entities was finally established in the Czech Republic. This happened with effectiveness of the Act No. 418/2011 Coll., on the Criminal Liability of Legal Persons and Proceedings against them. This event significantly influenced Czech Criminal Law and caused a great stir. There has been both praise and criticism of the adoption of this law. Despite the fact that almost ten years have passed since that day and the Act itself has been amended by more than ten amendments, it has undergone extensive development, both in terms of interpretation and application.
