Limites constitucionais à autonomia dos entes federados em matéria de contratos administrativos / Constitutional limits to the autonomy of federated entities in matter of government contracts.

O trabalho explora os limites impostos pelo texto constitucional de 1988 à autonomia dos entes federados quanto à distribuição da competência legislativa em matéria de contratos administrativos. Para tanto, dividiu-se a pesquisa em seis partes. Destas, as duas primeiras servem para, em linhas gerais, assentar os aspectos introdutórios da pesquisa e delimitar as noções conceituais adotadas. Segue-se para o enfrentamento das três hipóteses de pesquisa, cada uma em capítulo próprio, vislumbradas a partir do texto constitucional como inicialmente aptas a ordenar a distribuição da competência legislativa entre os entes federados para a edição das normas de contratos administrativos. Na primeira, discute-se, com base no artigo 22, XXVII, da Constituição de 1988, se caberia à União Federal, autorizada pelo termo contratação, estabelecer normas gerais sobre contratos administrativos, competindo aos Estados-membros, Distrito Federal e Municípios, suplementarem aquelas, para atenderem às suas peculiaridades. Outra, constante do artigo 22, I, da Constituição de 1988, admitiria à União Federal legislar integralmente sobre a matéria, com fundamento na sua competência para estabelecer normas em matéria de Direito civil, ramo no qual a categoria jurídica dos contratos tem assento tradicional. A última hipótese, por sua vez, decorrente do artigo 18, caput, da Constituição de 1988, não atribuiria a nenhum ente federado a competência específica para legislar sobre o tema dos contratos administrativos, relacionando esta matéria ao campo próprio da autonomia dos entes federados. A despeito dessa liberdade para legislar, pondera-se, no exame desta hipótese e pela perspectiva da distribuição de competências entre os entes federados, quanto à existência de outros limites constitucionais, aptos a restringir a autonomia dos entes federados no uso dos contratos administrativos. Ao final, retomam-se, em sede de conclusão, as hipóteses formuladas e as considerações apontadas sobre cada uma delas ao longo do trabalho, apontando-se aquela que se entende mais adequada à estrutura federativa do Estado brasileiro. / This thesis probes on the limits that the Brazilian Constitution of 1988 sets to the autonomy of federated entities in regards to the distribution of the legislative competence in matter of government contracts. The research was divided in six parts. The first two have the purpose of laying out an introduction of the study as well as the concepts employed. Afterwards, the three hypotheses are confronted, each in a paragraph of their own, perceived as from the constitutional text as initially able to ordain the distribution of legislative competence between the federated entities to regulate government contracts. On the first, it is argued, based on the article 22, XXVII, of the Federal Constitution of 1988, if it would behoove the Federal Union, authorized by the term contracting, to establish general rules on government contracts, competing to the Member-States, Federal District and Municipalities to supplement those, in order to attend their peculiarities. Another understanding, found in the article 22, I, of the Federal Constitution of 1988, would allow the Federal Union to fully legislate on the matter, grounded on its competence to establish rules in Civil Law, branch in which the legal category of contracts have a traditional place. The last theory, on its turn, consequent to the article 18, caput, of the Federal Constitution of 1988, would not assign to any federated entity the specific competence to legislate on government contracts, relating this theme to the proper field of autonomy of federated entities. In spite of this freedom to legislate, it is considered, in the exam of this hypothesis and from the perspective of distribution of competence between federated entities, in regards of the existence of other constitutional limits, able to restrain the autonomy of federated entities in the use of government contracts. Finally, it is resumed, in terms of conclusion, the hypotheses formulated and the considerations that were put forth in each of them through the project, pointing out the one understood as the most adequate to the federative structure of the Brazilian State.

Therefore, the approach examines the ramifications of Complementary Law No. 5.200/2006 with the declaration of unconstitutionality of Article 1 thereof , as well as the municipal competence, in order to understand the reason of legislative and legal disputes involving Federal, State and Municipalities in the context of agrarian and environmental issue . Thus , the aim is to raise the debate about the social function of property , federalism , municipal autonomy , and the blurring of boundaries of competence in editing standards by federal entities . From there , the research will conclude by the need to understand local interest , according to the environment protection and preservation of the economic development of the municipality of Rio Verde style. Finally , it will be evident that there is no invasion of legislative powers when the municipality acts in obedience to local interest and it will prevail in society. / A presente pesquisa tem por objetivo analisar a limitação do plantio de cana-de-açúcar no município de Rio Verde sob a ótica do interesse local e o avanço do setor sucroalcooleiro impulsionado pelo processo de expansão da fronteira agrícola. Para tanto, a abordagem analisa os desdobramentos da Lei Complementar nº 5.200/2006, alterada pela Lei Complementar nº 5.206/2006, com a declaração de inconstitucionalidade de seu artigo 1º, bem como a competência municipal, com vistas a compreender a razão dos conflitos legislativos e judiciais que envolvem a União, os Estados e os Municípios no contexto da questão agrária e ambiental. Assim, o que se pretende é levantar o debate acerca da função social da propriedade, do federalismo, da autonomia municipal, e da indefinição dos limites da competência na edição de normas pelos entes federativos. A partir daí, a pesquisa concluirá pela necessidade de se entender o interesse local, de acordo com a proteção do meio ambiente e preservação do modelo de desenvolvimento econômico do Município de Rio Verde. Por fim, será evidenciada a inexistência de invasão de competência legislativa quando o Município age em obediência ao interesse local e faz preponderar a vontade da sociedade.

With the advent of Federal Constitution in 1988, that granted legislative competence on process and procedure for the Union, to the States and to the Federal District (privatively and concurrently), came the necessity of the formulation of objective and specific criterion that allows the empiric separation of different kinds of normative acts, delimitating, therefore, the field of political entities. This study, that examines the evolution of the Federation in Brazil, issue imbricated to the division of power subject, has as a scope to formulate a proposal that helps the interpreter in the solution of conflicts on process and procedure, where vague, fluid and inaccurate concepts are multiplied (general and special rules) / A evolução científica do Direito Processual teve impulso a partir da distinção conceitual dos fenômenos processo e procedimento. Com o advento da Constituição Federal de 1988, que outorgou competência legislativa em matéria de processo e procedimento à União, aos Estados e ao Distrito Federal (privativa e concorrentemente), surgiu a necessidade da formulação de critério objetivo e específico que permita a separação empírica das diferentes espécies de atos normativos, delimitando, conseguintemente, o campo de atuação dos entes políticos. C obzipom na njixov značaj, one cy<br />y ovom pady analizipane kao nepocpedni aktep, ali i indipektno, kao činilac koji<br />kontpoliše odpeđene inctitycije koje ygpožavajy zakonodavny nadležnost<br />parlamenta.<br />Značaj diceptacije ogleda ce y tome što ovoj ppoblematici do cada nije<br />pocvećena pyna pažnja, koja ykljyčyje ppocec evpopckix integpacija i nezavicnix<br />pegylatopnix tijela. Zakljyčak koji cmo donijeli nakon ictpaživanja je da<br />očigledno poctoji potpeba za parlamentarnom pefopmom koja će yčiniti<br />zakonodavni poctypak efikacnijim, a zakonodavno tijelo cnažnijim. Genepalno,<br />cmatpamo da je neopxodno cnaženje tpadicionalne podjele vlacti. Diceptacija<br />takođe ppedlaže cpecifična konkpetna pješenja y kontekcty pefopme<br />zakonodavnog poctypka.</p> / <p>This dissertation is dealing with legislative parliament function and its relation<br />with other particular institutions that take away stipulated powers from parliament<br />causing his marginalization. This process is not new but it‟s become more complex to<br />deal with. In the beginning there was government and political parties, but during the<br />time, number of actors that threaten the legislative competence of parliament increased.<br />On this particular issue, modern parliament facing difficult challenges, sharing his<br />competence with head of the state, constitutional court, independent regulatory agencies.<br />Unfortunatelly, that is not the end. EU integration process, through the European<br />legislation, creates new area of legislative activity excluded from the national<br />parliaments.<br />Strong and highly disciplined political parties are dominating not only political<br />process but whole parliamentary procedures, and its increasing influence causes further<br />damage to separation of powers that constitution establishes and harms parliament<br />particulary. Considering their impact in this process, they are studied in this work<br />directly, and indirectly &ndash; as an acter that control other particular institutions which<br />threaten legislative competence of parliament.<br />The importance of the dissertation is reflected in the fact that this issue does not<br />have full attention including EU integration process, indepedent regulatory bodies. The<br />conslusion that we made after the research is that obviously there is a need for<br />parliamentary reform which will make law-making process more efficient, and legislative<br />body stronger. Basically, we find it necessary strengthening of the traditional separation<br />of powers. Dissertation also proposes specific solutions in the context of the law-making<br />process reform.</p>
