Statutory licenses with reference to the broadcasting of sports events This thesis is focused on the topic of statutory licenses with reference to the broadcasting of sports events. As mentioned right at the beginning of the thesis, the statutory licenses belong together with the free use and compulsory licenses to the extra-contractual institutes. They enable any third person, while meeting statutory requirements, the use of a copyright work or a subject-matter of related rights without a consent of the rightholder. The main reason why they were introduced into the international, European and national legal systems, was especially the endeavour to achieve a fair balance of rights and interests between different categories of rightholders and users of protected subject-matters. The crucial document on the European level in the field of treatment of exceptions and limitations to the rights is the Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society which provides a comprehensive list of one mandatory and twenty facultative exceptions and limitations, as well as the so-called three-step test. Resumé - AJ This thesis concerns to the topic Trade license and the requirements for undertaking business as sole trader. I have chosen the trade law topic because it represents an essential part of private business. The purpose of my thesis is to analyze current legal regulations, describe and clarify main juridical institute with regard to the historical development and judgments. The thesis is composed of five chapters, each of them dealing with different aspect of the trade law. It also contains an introduction, which explains the reasons for importance of the trade law and specifies the main thesis's tasks and structure. Chapter One, subdivided into four parts, summarizes the historical development of the trade law from the second half of the nineteenth century to present day. It examines relevant Czech legislation and the essential amendment of the law. Chapter Two, Part One, defines the term of trade license. Part Two investigates the subject of trade license, part Three describes the requirements for undertaking business as sole trader. CONTRACTUAL COPYRIGHT LAW This thesis is dedicated to the Czech Copyright Law, which is part of Intellectual Property Law. The core of this work is lying on description and recognition of contractual concepts of Copyright Law in Czech Republic, namely the last two Copyright Acts. The first Copyright Act was valid from 1965 till 2000. The second Copyright Act is effective since 2000. Chapter 1 covers the sources of Czech Contractual Copyright Law on different levels, from the constitutional grounds to the regulations. Chapters 2 and 3 are initial introduction to the Intellectual Property Law. It provides basic explanation of intangible property terms. Chapter 4 tries to briefly show the history and the development of the Copyright Law on the Czech territory, particularly Czech Contractual Copyright Law. Chapter 5 deals with provisions of Copyright Act 35/1965. It concentrates on contracts for the distribution of a work and contracts to produce a work. Chapter 6 is devoted to the effective czech Copyright Act 121/2000 and its provisions related to contractual law. With short notice about contract for a work done. Property rights of copyright (economic copyright) Abstract Intellectual Property Law as a branch of Private Law comprises two categories of rights - industrial property and copyright in a broader sense. In my thesis I focus on that part of Copyright Law which deals with rights to the author's work (i. e. copyright in the strict sense), specifically property rights of copyright (economic copyright). This thesis therefore provides a comprehensive explanation of property rights, which would not be possible without a brief explanation of the subject, development, concept and content of copyright. I also pay attention to legal regulation of the license agreement, which is a separate type of contract under the Copyright Act. Finally there is the collective management of copyright explained in my thesis. With respect to the importance of copyright which increases over time in response to the rapid development of information technologies, there is a need of its consistent protection and acceptance of more detailed and rigorous legislation. A numerous instruments of International Law and EU Law (whose main purpose is to harmonize national provisions of the Member States; the Czech Republic is a member of the European Union since 2004) therefore plays an important role in the harmonization of the national provisions...

Name of the thesis: An audiovisual works In my final thesis, I tried to summarize the current legal regulation of an audiovisual works and the rights and obligation relating thereto. In the thesis, I mainly deal with Czech private law legislation, as regulated particularly in Act No. 121/2000 Coll., Copyright Act, as amended, and with regards to License Agreement in Act No. 89/2012 Coll., Civil Code, as amended, or other legal acts. In the first chapter, I focus on different sources of legal regulation of an audiovisual works and its historical development in public international law, secondary law of the EU and also in national legislation. In the second, third and fourth chapter, I elaborate on the defintion of the term "audiovisual work" and its author, as well as the term and author of a "work audiovisually used" and "performances audiovisually used." These works and performances, together with audio records, constitute basic elements which audiovisual works might be composed of. In chapter five and six, I highlight the specific position of audio and audiovisual records producers and define the term of a "producer of audio record" and "producer of audiovisual record". The aim of my work is the analysis of the company Škoda Auto in the market of China. This market is one of the key market for sales nowadays. Another aim is the analysis of potential countries for expanding of the company and trying to find a suitable strategy for enter. The first part deals with the automotive industry mainly in the domestic market including influence of world crisis. The presentation of the company, the position in the market and operations abroad are described in the second and the third part. The goal of the fourth part is the market of China, where Škoda Auto produces on basis of license. The tools of marketing mix with emphasis on China are included in the fifth part. China disposes of great potential and increasing sales, but there are another possibilities to expand its activities. The company doesn't operate in the markets of Southeast of Asia yet. I tried to find suitable strategies how to enter there.

This diploma thesis is focused on a franchising business establishment, particularly on the business establishment of a fictive coffe house which could become a well known franchising concept on the Czech market. Primary advantage of franchise compared to the other types of business cooperation is mainly risk reduction for the investor (franchisee) who obtains proven model of the business. For the franchisor the franchise means an easier way how to widen his business without taking higher lability. The main reason for choosing this topic is an attractivity of this field. Correct preparation and serving of a cup of coffee is not an easy process and there is not a big number of coffee houses and restaurants which can offer such a coffee. By offering high-quality and delicious coffee at user acceptable price our company would like to achieve its objectives and be a successful. The primary objective of this diploma thesis is to analyse and define strategy, mission, vision, marketing activities, product strategy and price policy of a new coffee house. These factors should be used for successful enter to the market. Secondary objective is to determine necessary initial capital, planned costs analysis and investment rate of return.

Multinational mining corporations and corporate social responsibility: The case of Anglogold Ashanti in Ghana and South Africa

“Corporate social responsibility”, an unremittingly contested concept since its inception, has attracted global interest in a progressively integrated world economy. The aim of this study is to explore and critique recent claims of a move towards corporate social responsibility (CSR) initiatives by multinational mining corporations (MNMCs). Today, MNMCs are expected to promote and practice CSR for the socio-economic consequences of their activities in host countries. The study will also investigate how (if at all) host-country political and regulatory environments affect CSR initiatives undertaken by MNMCs. Previously, mineral developers merely insured full compliance with host-country environmental regulations. However, there is a growing recognition that full legal compliance is insufficient in meeting society’s demands with regards to mining issues. Thus, mineral developers are increasingly expected to gain a ‘social license to operate’ (SLO) from local communities in order to avoid potentially costly conflict and exposure to social risks. In order to achieve the aim of the study, a comparative-case analysis of the activities of the Anglo-American giant, AngloGold Ashanti in South Africa and Ghana will be employed. Furthermore, by drawing particular attention to CSR and SLO, the study will explore how international norms such as CSR evolve, are appropriated and sometimes operationalized by powerful actors and agents within the international system.

Making Copies: The Impact of Photocopying on Copyright Law in Australia In recent years, there has been a growing interest in looking at the history of copyright law through the lens of different technologies. Rather than looking at the historical development of, for example, copyright defences, the development of a specific piece of legislation or the way in which copyright law as distinct body of law took shape, there is a growing interest in looking at the way in which copyright law was shaped and influenced by specific types of technology. This literature is based on the idea that by focusing on the way that the law responded to a particular technology, that this enables us to get a better sense of the way in which the different legal rules and procedures operate and intersect: something that tends to be lost in more focused doctrinal or policy accounts. While there have been a number of important studies that focus on the impact of specific technologies, notably the printing press, on the development of copyright law, there are many other technologies that have not been given the attention they deserve. The thesis aims to contribute to the growing body of copyright scholarship that looks at the impact that specific technologies have had on copyright law. More specifically, it aims to look at the impact that the photocopier had on the development of copyright law across the second half of twentieth century. In effect, the question that the thesis asks is: what impact did photocopying have on the development of copyright law in Australia? The thesis shows that in responding to the problems created photocopier, a number of important changes were made to copyright law. In addition to contributing to the introduction of published edition copyright, it will be argued that the photocopier not only led to the introduction of library copying provisions which have played and continue to play an important role in ensuring access to information, but also helped to clarify that the fair dealing defence extended beyond hand copying to include machine copies. As well as highlighting the impact that the photocopying licences, which were introduced to deal with multiple copies, had on copyright law, it will be also be argued that the photocopier led to other changes, such as the politicisation of literary copyright. In highlighting the various changes brought about as a result of the attempt to respond to the problems created by the photocopier, the thesis will highlight the important role that technological change has had on the development of copyright law.
