Autorskoprávní ochrana počítačových programů / Copyright protection of software

Diploma thesis summary The topic of my diploma thesis is Copyright legal protection of computer programs. The purpose of my thesis is to describe in basic features the current regulation of this item in Czech republic. This thesis is composed of twelve chapters, where the crucial part can be found in chapter ten and eleven. Introductory Chapter emphasizes necessity of copyright legal protection of computer programs. Next chapter summarizes efforts for definition of computer program and also includes reasons, why the exact literal definition is not very convenient. Third chapter defines basic terminology, that we can find crosswise copyright; it also enumerates requirements for the authors work to be under copyright legal protection. Following chapter contains an outline of international treaties and history of computer programs. Sixth chapter concentrates on the role of computer program in the area of copyright and helps to distinguish the difference between computer program and any other author's craft. Seventh and eight chapter provides information about creation and content of the copyright, which is followed by the list of exceptions of exclusive copyright law. Implied licences in copyright law

Copyright licences can be implied when the doing of a restricted act is covered neither by the express licence of the copyright owner, nor by one of the statutory limitations and exceptions. The manner in which copyright licences are implied, therefore, holds the key to broadening the scope of permissible acts. In contrast to the rigidity of statutory limitations and exceptions, implied licences are more malleable in being able to respond to a diverse set of circumstances, as the need arises. Thus, implied licences can serve as a flexible and targeted mechanism to balance competing interests, including those of copyright owners and content users, especially in today’s dynamic technological environment. However, implication as a process is contentious, and there are no established rules for implying a licence. Implication of a copyright licence is even more complicated because the conceptualisation of a copyright licence is unsatisfactory. The resulting uncertainty has prevented implied licences from being embraced more readily by the courts. The objective of this thesis is, therefore, firstly, to reconceptualise a copyright licence that is broad enough to accommodate the diverse circumstances in which copyright licences arise, and certain enough to assist in finding their constituents; secondly, to propose frameworks for implying copyright licences in a methodical and transparent manner, based on three sources: the consent of the copyright owner; an established custom; and state intervention to achieve public policy goals. The frameworks are also customised differently for implied bare and implied contractual licences. The thesis demonstrates the robustness of these frameworks by rationalising them with the existing case law. Underscoring the contemporary relevance of implied licences, in conclusion, the thesis tests and validates the frameworks in relation to three essential and ubiquitous functions on the internet – browsing, hyperlinking and indexing.

Cette étude développe les aspects juridiques et de marché concernant l'utilisation du nom et de l'image appartenant à la personne humaine comme marque de produits et services.Dans le monde du droit, on sait que la marque est un bien de propriété industrielle et que lorsqu'elle est formée par un nom de personne, ou par une image du titulaire lui-même, ce droit touche à une autre gamme de droits : les droits personnels d'identification de la personne. C'est un droit individuel, qui ne peut pas être traité, purement et simplement, comme un bien commercial et réel. Toutefois, le nom et l'image de certaines personnes dans le monde des affaires sont dotés d'une importance économique si valorisée que leur exploitation devient l'un des patrimoines les plus considérables pour leur titulaire.La marque sera observée du point de vue du marketing et de sa manière d'attirer la clientèle, pour ensuite être développée juridiquement en tant que droit personnel et en tant que droit réel et ses prérogatives.Un approfondissement sur le droit de la personnalité et sur le droit de marques est essentiel pour comprendre cette intersection de protection et limites d'exploitation.La France et le Brésil traitent le sujet de manière similaire et, surtout, dans le droit brésilien on note une grande influence du droit français sur le rapprochement de la matière. Les aspects judiciaires et de contrefaçon sont également développés, ainsi que la concurrence déloyale, usages abusifs du droit de la personnalité de tiers, ainsi que les modalités de protection et d'exploitation / This study develops marketing aspects, as well as law issues connected with the use of the name of a person as well and/or its image, as a trademark of products or services.In law, we know that the trademark is an industrial property right and when it is composed by the name of a person or by it's image, these rights touch another area of the law: personal rights connected with the identification of the person. It is an individual right which shall not purely and simply be treated like a commercial good like any other. However the name and the image of certain people have such an economic importance, and a special value, that their exploitation becomes one of the most considerable assets of its owner.The trademark will be observed on the marketing side in a manner to attract the clients, and then be developed according to the law aspects and to the personal civil rights, real rights and its forms of exercise.A deeper study of the personality rights and the trademark law is essential to understand this intersection of protection as well as the limits of exploitation.France and Brazil develop this issue in a very similar way and, mainly in Brazilian law, we notice a very important influence of French law in the subject matter. The procedure, prosecution and litigation aspects as well as the counterfeiting are also being developed, as well as the unfair competition, abusive use of third parties' personal rights, protection and exploitation

A theme of my thesis has been reconstruction project of a rural road network in two alternates. The project must respect valid norms and legal regulations. A lokality is found between two villages in Southern Bohemia, Olešník and Nová Ves. I have worked out the preferable alternate into the stadium of documentation for building licence. Rural road line has projected that way that the trafic situation will be better. Output of my theme is documentation for building licence.

This diploma thesis is focused on the financial market supervision, especially on terms and conditions of entry into the financial market and the role of the Czech National Bank in this area. The thesis mentions some arguments for the need of financial market regulation and supervision and explains the importance of the quality licence system. There is also an analysis on institutional organization of financial market regulation and supervision and contemporary trends. The thesis compares and contrasts legislation on licences for different types of the financial institutions. Together with development of the financial market and the economic situation in the Czech Republic during the past 20 years (1989 -- 2009) the thesis also points out substantial changes and improvements in primary and secondary legislation in the area of licensing.

Diploma thesis deals with trademarks and licensing agreements for trademarks. The work evaluates and assesses the effectiveness of the legislation in connection with its application by the conclusion of license agreements in practice. The first chapter of the work focuses on the international and the community sources of legislation which are the basis for national adaptation. Another part is devoted to analysis of the constitution of the trade marks legislation significant for the conclusion of license agreements and to the assessment of their effectiveness, clarity and understandability in relation to practice. The third chapter assesses the constitution of the Commercial Code governing the licence agreemants and points to the frequent types of violations of licensing. It is a recommendation for the consclusion of licensing agreements for the mark without any problems.

Currently, operation of companies is entirely dependent on information and communication technologies (ICT) which are used across all indfustries. There are bigger demands that are placed on the management of individual assets, while software is the most problematic from this perspective. It is necessary for companies to pay sufficient attention to this issue, because there is a high risk of financial penalties in case of its failure. The first objective of this thesis is to provide basic characteristics of Software Asset Management (SAM) belonging to Information Technology Infrastructure Library (ITIL), which is one of the few adressing this area in an entirely way. This objective is default condition for achieving the second objective, where will be analyzed specific case of software asset management in the banking sector. On the basis of the analysis will be accepted proposals for implemention of best practises of SAM. The third objective is enrichment of previous proposals by parts of request for proposal, which are focused on detailed specification of the required functionality of software tools according to SAM. The all tasks will be achieved through the study of relevant sources and through techniques that help with analysis and definition of the future state. The benefits of thesis are in to identification of gaps within software asset management, which obtained through employee survey. The second contribution is to propose changes in the form of specific steps that should help to bring more efficiency to the current state. The last contribution is to summarise new pieces of knowledge, which are extending this issue by information focused on large organisations.

Concurrence, Innovation et Choix Optimal de Licence de Brevet / Competition, Innovation and Optimal Licensing Regime

On étudie dans cette thèse le transfert de technologie à travers la licence de brevet dans des modèles à la Hotelling, à la Salop puis à deux dimensions. On trouve que le régime optimal dépend des coûts de production , de la taille de l'innovation et du modèle géographique de la localisation des consommateurs. On montre qu'un prix fixe peut être optimal dans un modèle à deux dimensions et qu'une royaltie peut être optimale même pour une innovation intense dans un modèle à la Hotelling quand les coûts sont asymétriques et que la firme innovatrice est inefficiente en terme de coûts. / We study in this thesis technology transfer through patent licensing in a Hotelling mdel, a Salop model and a two dimensionnal model. We find that the optimal licensing regime depends on the costs, on the size of the innovation and the geographic model of consumers locations. We show that a fixed fee can be optimal in a two dimensionnal model and that royalty licensing can be optimal even for a drastic ennovation in a Hotelling model with asymmetric costs and ineficient patent holder.
