Montesquieu on the History and Geography of Political Liberty

Thesis advisor: Christopher Kelly / Montesquieu famously presents climate and terrain as enabling servitude in hot, fertile climes and on the exposed steppes of central Asia. He also traces England's exemplary constitution, with its balanced constitution, independent judiciary, and gentle criminal practices, to the unique conditions of early medieval northern Europe. The English "found" their government "in the forests" of Germany. There, the marginal, variegated terrain favored the dispersion of political power, and a pastoral way of life until well into the Middle Ages. In pursuing a primitive honor unrelated to political liberty as such, the barbaric Franks accidentally established the rudiments of the most "well-tempered" government. His turn to these causes accidental to human purposes in Parts 3-6 begins with his analysis of the problem of unintended consequences in the history of political reform in Parts 1-2. While the idea of balancing political powers in order to prevent any one individual or group from dominating the rest has ancient roots, he shows that it has taken many centuries to understand just what needs to be balanced, and to learn to balance against one threat without inviting another. Knowledge of the administration of criminal justice has proven the most important to liberty, as well as the most difficult to acquire and put into practice. Montesquieu's attention to accidental causes sheds light on the contradictions within human nature, and the complex relationship between humans and their physical and conventional environments. He shows how nature provides support for both political liberty and for despotism. The wisdom of organizing government with a view to political liberty, as well as the means for doing so, does not follow from human nature in the abstract, but has required reflection on experiences with the consequences of actual governments. By highlighting the dependence of free politics on conditions outside the legislator's immediate control, he encourages reformers to attend to the non-legal supports of political liberty, the limits of human ingenuity, and the risks of unintended consequences. O objetivo deste trabalho é identificar os modelos de realeza em Luís IX, rei da França entre 1226 e 1270, tendo como base principalmente a obra de Jean de Joinville intitulada Histoire de Saint Louis. No decorrer da análise, constata-se o caráter peculiar do documento como espelho de príncipe, gênero medieval que procura estabelecer um modelo ideal de realeza. Luís IX é nele retratado como um rei peregrino, cruzado que ampliou o reino de Deus na terra, buscando identificá-lo ao reino de Cristo, à Imitatio Christi. Joinville, senescal de Champagne, descreveu nessa obra grande parte da vida do rei, memórias resgatadas trinta anos depois de sua morte. Escrita de 1305 a 1309, a pedido de Joana de Navarra (1270-1305), esposa de Filipe o Belo (1268-1314), seu objetivo seria de enaltecer as palavras santas e as boas realizações do rei, que se tornaria São Luís. Escolheu-se este documento sobretudo por seu caráter de particular autoria, visto que Joinville, na condição de senescal laico, amigo e confidente do rei, narrou um longo período do governo do seu rei e senhor de um ponto de vista privilegiado. Uma característica muito marcante da monarquia capetíngia e do reinado de Luís IX especificamente foi a forte aliança com a Igreja. A Igreja era peça mestra do sistema feudal e sua justificadora ideológica, sendo a principal intermediária entre o rei e seu populus, dando-lhe a posse do reino, por meio da cerimônia de sagração e unção. Rei símbolo do período medieval francês, Luís IX aglutinou elementos das três funções sociais, propostas por Adalberon de Laon no século XI, a saber, a dos oratores, bellatores e laboratores. Tornou-se santo trinta e sete anos após sua morte, contribuindo para legitimar a dinastia capetíngia proposta e representada por Filipe o Belo. / The goal of this work is to identify the royalty models in Louis IX, king of France from 1226 to 1270. The basis of analysis is mostly Jean de Joinvilles work named Histoire de Saint Louis. During this analysis, we verify the peculiarity of the source, a mirror of prince, medieval gender whose goal is to establish an ideal of royalty. Louis IX is traced as a king-pilgrim, a crusade that enlarged the king of God on the hearth. He is identified with the kingdom of Christ and the Imitatio Christi. In that work, Joinville, seneschal of Champagne, described the main facts of the kings life, recovered memories thirty years after his death. Written from 1305 to 1309, by request of Joan of Navarra (1270-1305), Philip Le Beauxwife (1268-1314), his goal would be to value the holy words and good accomplishments of the king, Saint Louis. We chosen that source mostly for its trace of private authority, since Joinville, as laic seneschal, friend and confident of the king, described, from a privileged point of view, a long period of his king and lords government. The strong alliance with the Church would be one of the main traces of the Capetingean monarchy. The Church was the master piece of the feudalism, as well as its ideological support. It was the main mediator between the king and his populus, by giving him the power towards the kingdom through the ceremony of crownement. King-symbol of the French Medieval Ages, Louis IX grouped elements of the three social functions of the XIth century, according to Adalberon de Laon: the oratores, the bellatores, and the laboratores. He was canonized thirty seven years after his death, supporting the legacy of Philip Le Beauxs capetingean dynasty.

Robert de Sorbon et son oeuvre (1201-1274) / Robert Sorbon and his opus

Ce travail a pour objectif de faire le point sur les connaissances concernant Robert de Sorbon. Le cursus scolaire du personnage peut admettre de nouvelles filières par le constat d'une fréquente présence de l'ordre de Prémontré autour du village de Sorbon. La seule date qui soit vraiment assurée est l'année de sa mort en 1274, la tradition de fixer sa naissance en 1201 remontant au XVIIe siècle. La plus grande partie de sa vie reste dans l'ombre jusqu'en 1249. Robert de Sorbon n'est pas d'origine paysanne malgré la remarque de Joinville. L'étude des actes du cartulaire permet de comprendre les méthodes et les personnes soutenant la fondation de la Sorbonne. Celle-ci n'est pas, dans les premiers documents (actes et statuts), décrite comme une institution charitable, mais comme une maison de formation pour Séculiers, répondant aux attentes des chanoines des chapitres du nord du royaume, concurrencés alors par les succès des ordres mendiants au sortir de la polémique universitaire. Les écrits pénitentiels de Robert sont connus depuis plusieurs siècles et un regain d'intérêt récent a multiplié les éditions et surtout des sermons : un premier inventaire de ses écrits était donc nécessaire. On étudie ensuite quelques textes des manuscrits de la collection de l'auteur et une version inédite de son traité le plus connu, le De Conscientia pour repérer les techniques utilisées par Robert de Sorbon, sa langue, ses idées, les exempla utilisés et les liens entre les différentes œuvres. Ainsi, sont mises en évidence les différentes facettes d'une même personnalité qui accompagne la croissance de l'Université parisienne. / This work aims to gather knowledge concerning Robert de Sorbon. Thus the curriculum of character can admit new ways by finding frequent presence on the order of Premontre around the village of Sorbon. The only guaranteed date is the year of his death in 1274, while the habit of fixing his birth in 1201 did not appear until the seventeenth century. Much of his life is rather obscure until 1249. Robert de Sorbon is defenitly not of peasant origin whatever said Joinville. Studying acts of the cartulary helps to understand the methods used and also to know the people supporting the foundation of the Sorbonne. At the beginning, the domus is not described as a charitable institution but as a formation House for Secular and it links up the expectations of the canons of chapters from the northern kingdom of France, then competed for the success of the mendicant orders after the university polemic. The pentiential writings of Robert are knomn for centuries but a recent surge of interest has multiplied editions of texts and especially sermons : an initial inventory of his works was necessary. We study thereafter some texts of the personal collection of sermons and a manuscript known to contain a new version of its best-known treaty, De Conscientia to understand the techniques used by Robert de Sorbon, language, ideas, exempla used and the links between different works. So, are highlighted the different facets of the same personality during the growth of the parisian University.
