"Ei, polícia, maconha é uma delícia!" : o proibicionismo das drogas como uma política de criminalização social

Este artigo tem como objetivo analisar as políticas proibicionistas com relação às drogas, no Brasil, como políticas públicas voltadas à criminalização social. A partir de um histórico sobre o processo de proibição, define-se como tais políticas se deram por iniciativas de reprimir a população negra e pobre, ex-escrava, do início do século XX. Avançando no tempo, a segunda parte do trabalho analisa como a política criminal contemporânea no tratamento às drogas exemplifica uma vontade de Estado criminalizador, sendo fator fundamental na criminalização e no extermínio da juventude pobre, majoritariamente negra, brasileira. O trabalho se utiliza de uma abordagem, principalmente, qualitativa, a partir de uma ótica foucaultiana acerca das relações sociais e de poder, além das análises de criminólogos e sociólogos reconhecidos na temática de estudo no país. / This article objective is to analyze drug’s prohibition policies, in Brazil, as public policies aimed to social criminalization. From a historical view regarding the process of prohibition, it is defined that such policies were initiatives based on the repression of the black, poor and former slave population of the beginning of the 20th century. Advancing in History, the second part of the text brings the analysis of how the contemporary criminal policy concerning drug treatment exemplifies a desirability of a criminalizing State, becoming a fundamental factor in what we can define as the criminalization and the extermination of the poor, mostly black, Brazilian youth population. This work utilizes mainly qualitative approaches, based on Foucault studies on social relations and power. Besides, it brings out the studies of criminologists and social scientists, known for their views on these subjects in Brazil. / Este artículo tiene como objetivo analizar las políticas prohibicionistas con relación a las drogas, en Brasil, como políticas públicas dirigidas a la criminalización social. Desde un histórico acerca del proceso de prohibición, se define como estas políticas fueran iniciativas para la represión de la populación negra y pobre, ex esclava, del inicio del siglo XX. Avanzando en el tiempo, la segunda parte del texto analiza como la política criminal contemporánea en el que dice respecto al tratamiento a las drogas ejemplifica una voluntad del Estado criminalizante, siendo factor fundamental en la criminalización y en el exterminio de la juventud pobre, mayoritariamente negra, brasileña. The theoretical part of the thesis reveals the history of Cannabis, gives basic characteristics of Cannabis-based drugs and their sorts. Hereafter, the active substances of marihuana and manifestations of intoxication are quoted. The main emphasis is put on the description of risks related to the use of this soft drug. The medical, mental and social risks are commented. One chapter is dedicated to applicable legislation. Consecutively, various approaches of drug politics and its specifics are mentioned. The attention is also paid to the prevention and subsequently te the assistance to the drug users. The practical part of thesis is focused on the public and professional opinion referring to the possible risks of marihuana use. The attention is paid to the general attitude to this drug as well. Subsequently, the opinions of both contrary parties are compared.

Economical analysis of market with cannabis products is solved by the master thesis. Emphasis is placed on the situation and specifics of Czech Republic market with focus on price of cannabis drugs. It contains research questions which deal with role of price of drugs users -- if price factor is more significant than other socio-economical factors. The thesis describes development of legislation and anti-drug policy in the Czech Republic and its focus on cannabis products. In the theoretical part of the thesis there are presented economical and social aspects of anti-drug policy and its forms of applications in the Czech Republic. Analytical part of the thesis is focused on analysis of recent situation in the market with cannabis products. There is presented survey dedicated to consumption of cannabis drugs by students of high (secondary) schools. The survey also deals with attitudes of these students towards cannabis drugs. The survey is the source of data for regression analysis. Research has shown the most of users of marijuana do not pay for the drug. In case of act of buying there are frequent volume distcounts. Procurations of anti-drug policy which are trying to influence the price therefore may not have any impacts on buying behavior.

This diploma thesis focuses specifically on the phenomenon of self-medication with cannabis (Cannabis Sativa L.) in the Czech Republic exploring subjective perception of this treatment by ill persons and its sociocultural framework. It describes a situation when the state fails to effectively regulate medical cannabis and patients often seek practices of self-medication, which remains illegal. Theoretical part of this thesis aims to explain the self- medication and cannabis use in the sociocultural context. Practical part is based on an anthropological research, which was implemented in the Czech Republic from January 1, 2017 to May 1, 2017 in a form of the on-line qualitative questionnaire survey. The research sample consists of 107 subjects, who used cannabis and its derives for self-medication. The analysis was done by the Grounded theory method. The results demonstrate that people who seek cannabis self-medication in the Czech Republic consider current legal regulation of cannabis objectionable. Cannabis plants for self-medication are usually grown at home and people find information about specifics of the treatment on-line. Tomiczek, J. Proposal for Taxation of Legalized Trade of Marijuana in the Czech Republic. Thesis. Brno: Mendelu in Brno, 2019. The thesis deals with the legalization of marijuana trade and consumption in the Czech Republic. The aim of the thesis is to propose a method of taxation of marijuana trade in the Czech Republic. First, the situation of the states that allowed marijuana trade is described. Then international conventions on cannabis, models for marijuana trade, effective tax collection and tax evasion are presented. Thereafter, the costs associated with the legalization of marijuana are estimated and then the excise duty rate is proposed with an estimate of income. Part of the thesis is the rejection or non-rejection of the hypothesis that the legaliza-tion of the marijuana trade is advantageous from the tax point of view.
