Abstract
The global trade's commodity has 80% is by the marine transportation way loading, is responsible for the transportation industry the ships to maintain the navigation the security is stable; the ballast water tank will be pumping into the massive ballast water to maintain balanced. Had the research discovery, the loading ballast, if after has not processed properly on the emissions inflow harbor, has in the ballast the pathogen or the micro biology, will destroy the local port territory the biodiversity even to initiate threatens the human health disease, will create the serious economic loss. In order to reduce the ballast the emissions initiation pathogen destruction sea ecology, the International Maritime Organization to draw up the International Convention for the Control and Management of Ships Ballast Water and Sediments (BWM Convention) by the public law binding force, so as to protection marine environment.
In this studying, the questionnaire is in view of the shipping company, the shipyard, the ships equipment supplier and the maritime affair related organization and so on four communities. According to the investgating result, finds Taiwan shipping interest cognition ratio less than 50% regarding the new international convention, are worth the anxiety. Expected that produces the marine industrial, gonverment and marine educational intrest in Taiwan shipping facing the international ballast control and management tendency by this studying, and provides one to draw up effectively of reference in accordance to the strategy.

The oil spill marine pollution resulting from the shipping has been the major concern of Taiwan coastal environment that embraces abundant and enriched marine resources, because it often has caused serious destruction to the marine ecological habitat. The integrated policy on marine pollution control and protection is urgently needed to augment the efficiency of administration for the adaptions of many acts that exist in vary governmental departments. The present study was initiated to survey the current international law related to the marine pollution control and protection. The strategic management and organization of marine protection employed by United State, Canada, Japan, Singapore and Korea were evaluated and assessed to the idea of consideration of the existing environmental law and acts at the governmental department. These are to be made for better structure and organization for the improvement of integrated marine pollution control and protection.
The study illustrated both Tzini and Natuna oil spill cases for comparative analysis on handling the marine pollution control. The analysis showed that, the ocean environmental protection in Taiwan only focus on ¡§marine pollution¡¨, but lack of consideration on ¡¨marine ecological conservation¡¨. Besides, the task due among ministries is less of unified and good coordination. In addition, Taiwan is restricted to the situation of non-diplomatic relation to the world, it is very difficult to participate in international program or organization related to marine environment and pollution prevention. Taiwan should monitor and collect ecological resource data at the sensitive areas associated with the possible problems from the loss of coral reef recovery, fishery and local economy. This thesis attempts to suggest the need for the improvement mechanism and institution on legislation, organization, enforcement, ecosystem and compensation. Desiring future legislation should be able to integrate the marine environment protection by proposing a comprehensive integrated legislation, management, organization and to strongly urge energy enforcement.

Transport of oil or other hazardous substances by sea constitutes the backbone of the world economy. The fiscal benefits and dependence on the transport of oil and other substances by sea outweigh the dangers associated with the carriage of such substances by sea, especially the pollution of the marine environment. Although the absolute answer for the protection of the marine environment may be to prohibit the harm-producing activities altogether, and to turn to alternative energy-resources, it seems very unlikely that this will be the case in the near future. / The feasible solution for the protection and preservation of the marine environment and safe marine transport calls for a liberal approach that redistributes these responsibilities amongst all the related interests. In this respect, this thesis examines the issue of places of refuge, as a measure to protect and preserve the marine environment, and the position in international law on the obligation to grant refuge to ships in distress. It is argued that the obligation to grant refuge, founded in early customary international law and denounced in current international documents, can be reformulated in an environmental context.
