To do so, it was realized a quantitative and qualitative research, whereas it was applied an online survey, organized in ten questions, both objectives and subjectives, designed to 46 judicial mediation instructors that act in TJ/RS, being that 31 of the 46 instructors answered it. As a result, it was identified that the formation and capacity of the judicial mediation is based on Harvard School, which implies being a model reasoned on the construction of an agreement built by the related parties in a mediation proceeding. Nevertheless, such model apply itself to various types of conflicts that reach the judiciary, presenting some limitations in relation to the construction of the understanding in the resolution of these conflicts. Therefore, it concludes that the formation and capacity of the judicial mediation, even restricted by one School, have an objective approach in the acting and resolution of conflicts, being that the formation of this mediation demands the use of diverse knowledge so the judicial mediation would produce real effects. Capacity. / A presente pesquisa tem por objetivo identificar qual a formação e capacitação dos mediadores judiciais do Tribunal de Justiça do Rio Grande do Sul (TJ/RS), conforme a Resolução 125/2010 do Conselho Nacional de Justiça (CNJ). Para tanto, realizouse uma pesquisa com abordagem quantitativa e qualitativa, porquanto, aplicou-se um questionário online, composto por dez perguntas, abertas e fechadas, encaminhadas para 46 instrutores de mediação judicial que atuam no TJ/RS, sendo que destes, apenas 31 responderam. Como resultado, identificou-se que a formação e capacitação do mediador judicial é baseada na Escola de Harvard, o que implica em ser um modelo fundamentado na construção de um acordo construído pelas partes envolvidas em um procedimento de mediação. Contudo, tal modelo aplica-se aos mais diversos tipos de conflitos que chegam ao poder judiciário, apresentando assim, limitações relacionadas a construção do entendimento na resolução destes conflitos. Portanto, conclui-se que a formação e capacitação do mediador judicial, mesmo que restrita a uma Escola, tem enfoque objetivo na atuação da resolução de conflitos, sendo que a formação desse mediador demanda a utilização de conhecimentos diversos a fim de que a mediação judicial produza efeitos reais. Just as lawyers, mediators develop different strategies to achieve better positions and distinctions within this field. Our goal was to understand the meanings of these local around the mediation field marked by the pursuit of ownership of the practice of this activity and the authority to speak and act with legitimacy. The methodology used was based on a qualitative approach with interviews, participant observation and document analysis, aiming to realize negotiations and dispute within the group of professionals in the legal world. / Com a presente pesquisa busca-se analisar as relações existentes entre os mediadores judiciais no âmbito do setor de Mediação Judicial na cidade do interior paulista denominada Comarca Azul e os agentes do mundo do direito: advogados e juízes. Da mesma forma que os advogados, os mediadores desenvolvem diversas estratégias para alcançar as melhores posições e distinções dentro deste campo. Nosso objetivo foi compreender os sentidos destas disputas locais em torno da mediação, campo marcado pela busca da apropriação da prática desta atividade e pela autoridade de falar e agir com legitimidade. A metodologia empregada foi baseada numa abordagem qualitativa com a realização de entrevistas, observação participante e análise documental, com intuito de perceber as negociações e a disputa dentro do grupo dos profissionais do mundo jurídico.
