It aims to recognize their decisive role as peacemakers, avoiding identifying women¿s role as victms only, in the conflict solving áreas marked by complexity and boundary breaking, which demands new, different and creative ways for resolutions. The international mediation strategies which include women and civil society in a wider way are more likely to achieve more sustainable peace and generate international support, the strengthening of its legitimacy and credibility. Women¿s perspectives bring perception and understanding which are different from the causes and consequences of conflicts, and make way for the building of more comprehensive and objective proposals for their respective resolutions. The preservation of future generations islikely to be assured with the participation of all actors involved, and it not longer allows gender exclusion. This way, sustainable development won¿t be achieved if half of mankind gets its human rights denied. And the development that is studied in this paper is the concept that expands so as to include social dimensions, human rights, good governance and democracy . For these dynamics, peace, the environment and development make a unique harmonious arrangement in which music that is written on music sheets of the environment conflicts is conducted by women. The notes in this arrangement, interpreted this way, translate into environmental cooperation and are able to play an important role in mankind¿s hearts concerning the importance of building a better world. / A presente tese trata da inclusão das mulheres nos processos de paz conduzidos pela mediação ambiental internacional, em uma abordagem que pretende promover a sua participação efetiva no processo de tomada de decisões políticas, visando à paz duradoura e o alcance do desenvolvimento sustentável. Busca-se reconhecer o papel decisivo que desempenham como pacificadoras, dissociando-as da identificação de vítimas, apenas, na seara da resolução de conflitos marcados pela complexidade e pelo rompimento de fronteiras, o que exige formas novas, criativas e diferentes para sua resolução. As estratégias de mediação internacional que incluem mulheres e a sociedade civil de forma mais ampla têm maior probabilidade de alcançar uma paz mais sustentável e gerar maior apoio internacional, conseguindo o fortalecimento de sua legitimidade e credibilidade. As perspectivas das mulheres trazem uma percepção e entendimento diferentes das causas e consequências do conflito, o que possibilita a construção de propostas mais abrangentes e objetivas para a resolução correspondente. A preservação das gerações futuras é capaz de ser assegurada com a participação de todos os atores envolvidos, e não mais admite exclusão de gênero. Nessa linha, o desenvolvimento sustentável também não será alcançado se à metade humana forem negados seus direitos humanos plenos. E o desenvolvimento de que tratamos é conceito que se expande para incluir dimensões sociais, direitos humanos, boa governança e democracia. Nessa dinâmica, a paz, o meio ambiente e o desenvolvimento compõem um arranjo harmônico único quando a música que então se desenha na partitura dos conflitos ambientais é regida pelas mulheres. As notas desse arranjo, assim interpretadas, traduzem cooperação ambiental e são capazes de ¿tocar¿ a humanidade para a importância da construção de um mundo melhor.

1 ABSTRACT MEDIATION AS A MEAN OF INTERNATIONAL COMMERCIAL DISPUTE RESOLUTION This dissertation deals with the phenomenon of discrepancies between commonly shared perceptions about international mediation and its real and practical situation. The aim of this disertation is not to analyze the legal provisions on mediation in individual national jurisdictions or to analyze individual provisions of the private international law, which potentially apply to issues of cross-border mediation. The intention is to point to current trends and current issues in the field of international mediation. We especially want to conduct generally accepted theoretical concepts of mediation in an international context critical view by comparing it to empirical dates proving the actual state of mediation as a method of resolving international business disputes. The first part of this disertation summarizes the basic theoretical background related to mediation, which serves as a basis for the construction of generally recognized premises in this field. These premises relate to the context of international commerce. Therefore, it deals with the mediation principles, models and important aspects that are relevant to international commercial disputes with an international element. Regionalism and conflict resolution in the Horn of Africa : the role of inter-governmental authority on development in the Sudanese civil war

This thesis expounds the theoretical underpinnings of problem-solving approach to conflict resolution. It also criticizes the traditional state-centric approach to conflict resolution being followed by the Inter Governmental Authority on Development (IGAD) in the Sudanese civil war. IGAD was initially known as Inter Governmental Authority on Drought and Desertification (IGADD), but was renamed IGAD in 1996. Its objectives were reformulated to give priority to conflict prevention, resolution, and management, and humanitarian affairs. It is stipulated in the thesis that IGAD faces problems that need attention if the Sudanese civil war is to be resolved. A key problem is that while IGAD's objectives were reformulated to give priority to conflict resolution, IGAD's management structure has remained the same. The management structure is state-centric and lacks neutrality, which is a very important ingredient in deep-rooted social conflict resolution. The management structure, which was initially based on combating drought and desertification, was not restructured to conform to the realities of a problem solving approach to conflict resolution. The committee that was formed to look into the Sudanese conflict is composed of states in dispute with Sudan. The other structural problem cited in the thesis is that the IGAD peace process is cumbersome and does not include all aggrieved parties. The meetings involve heads of state, ministers, ambassadors and other government representatives. The peace process is not inclusive of other important players such as other rebel movements. This thesis concludes that: 1. there is a need for peace keeping forces from neutral African Union (AU) member states; 2. conflict resolution specialists are deployed in the region whose main task would be to assist the belligerent groups to reach a common understanding of their problems; 3. the United Nations (UN) acts proactively to create international awareness to the Sudanese problem.

1 Mediation as a Mean of International Commercial Dispute Resolution Abstract The subject of this dissertation is the topic of mediation in solving international commercial disputes. At the outset, the author focuses on the general theory of dispute and argues that the main psychological features of thinking about conflicts are inherent in virtually all types of social relations, regardless of their specific nature. It is therefore useful to recall the knowledge about the psychology of conflict in the context of research on the resolution of international commercial disputes, as this initial line of reasoning is also present. In the first part of the dissertation, the author defines the position of mediation within the spectrum of the dispute resolution and identifies its relationship with other ADR methods. She is particularly concerned with the recent change in the ADR area, particularly as regards the shift of arbitration towards judicial proceedings and convergence of mediation with arbitration in certain respects. Furthermore, the author considers the importance of mediation for international commerce, noting in particular the aspect of the institutionalisation of mediation and touches on the phenomenon of regional change in international trade. MA (Political Science) / Department of Development Studies / This study focuses on the politics of conflict resolution, paying special attention to the role of the international community in resolving the political crisis in South Sudan. The current political crisis in South Sudan has historical connections that date back to the time when Sudan was granted independence by the British government in 1956.These historical antecedents paved the way for the current political crisis which started on December 2013. The study is guided by the International Society Theory or the English School of Thought. The wisdom of the International Society Theory affirms international obligations bestowed on the members of the international community. According to this theory response to crisis of humanitarian nature such as the South Sudanese political crisis is part of the broader debate. Qualitative methods were used in this study because the researcher because they enabled the researcher to gain deeper insights on the research problem. All guidelines regarding ethical considerations were followed in order to avoid being biased and misinterpretation of information. Data were obtained from primary and secondary sources what sources. The study concludes that despite the involvement of many external actors, the conflict is still raging on due to a numbers of reasons such as, mistrust between the conflicting parties and lack of political will to resolve the conflict.
