CREATION AND TERMINATION OF MEMBERSHIP IN COOPERATIVE Summary The theme of the thesis is Creation and termination of membership in cooperative. Cooperative as a legal entity is one type of an association of people for some specific purpose which is characterized by them. Any cooperative cannot be without its members. Therefore the legal amendment of membership's creation and termination in cooperative creates very important legal amendment part in cooperatives. The thesis, which has introductory and closing chapter too, is divided into five chapters which are arranged by way, whose goal is to give a systematic explanation of creation and termination of membership in cooperative in the Czech Republic. The thesis includes relevant decisions of the Czech courts and opinions from books and articles. The introductory chapter contains the main purposes of the thesis. The first and second chapters are a common introduction to the law of cooperatives. The first chapter provides a brief historical law sources explanation of cooperatives and valid legal amendment of cooperatives. A vacant membership interest is not an emerging concept in Czech law; disposition of vacant membership interest was regulated already by Section 113(5) and 113(6) of the then applicable Commercial Code. The legislative rules, however, were criticised for being incomplete and hence difficult to be applied: regulated as transferable to the company, the vacant membership interest could be transferred by the company to another company member or third party; if the membership interest was not transferred, the company was required to reduce its registered capital or distribute the vacant membership interest among the remaining company members. The newly enacted amendments have impacted a number of related concepts, introduced a liberalised company law regime and weakened the relationship between company members and companies. The calls on the government from the professional public to introduce a more flexible company law regime, give way to contractual freedom and expand the circumstances in which the company members have a right to withdraw from the company have been heard. Thesis (DTh)-- Stellenbosch University, 1996. / ENGLISH ABSTRACT: Questions and problems concerning church membership are plenty and surface regularly in church . meetings. The way in which the church operates reflects a particular concept of the church. The· ideal is that way the church functi~ns according to the church law must express the essence of the church. Therefore it is important to ask questions on church membership in the light of the scriptures and the confession. This study shows that there is tension between the concept of the church which comes forwardin the Scriptures and the confession on the one hand and that which is reflected in the practical handling of membership issues on the other hand. An investigation into certain historic backgrounds, the conventions of a variety of churches on the issue of membership as well as the views of church members from· the Presbytery of the Dutch Reformed Church in Pietermaritzburg was necessary to acquire insight into the present situation. These investigations have shown that there are several customs and views on membership issues that do not have a sound theological basis. On what membership means and how it must be handled in practice there is also a wide variety of opinions. From the Old and New Testaments it becomes evident that a complete definition of the church is not possible. The Bible speaks in different ways about thechurch. God's presence and initiative in the church as his people of the covenant is that which makes the faith community the church. Faith, the relation with Jahwe in the Old Testament and with Jesus Christ iri the New Testament, is that which distinguishes the members of the faith community from those who do not belong to it. The handling of membership developed in such a way that membership issues constitutes the delimitation of churches amongst each other. That hampers the visible unity of the church. In the last chapter an attempt was made to formulate guidelines for the handling of membership in such a way that the unity of the church is emphasized while the confessional base of the church is protected at the same time. In this process a distinction is made between the delimitation of the church against the world on the one hand and the delimitation of churches amongst each other on the other hand. An attempt is made to unite the soteriological and the canonical meaning of the baptism in the membership practice. Baptism, as the sacrament of incorporation .into the church of Jesus Christ is fundamental in the acknowledgment of membership and membership privileges in the congregation. / AFRIKAANSE OPSOMMING: Vrae oor lidmaatskap en die probleme wat daarmee verband hou, is volop en korn dikwels na vore • tydens kerkvergaderings. The goal of this thesis is to describe the effective legislation of the cooperatives. Where appropriate this thesis compares the effective legislation to the previous legislation. The thesis tries to locate the problematic areas and to find solution to the given problems. This thesis is divided into 5 main chapters. The first chapter describes the history of cooperatives, because I think that without understanding the historic development no topic can be properly understood. Also this chapter describes the cooperative at a general level. The second chapter is formed of a general description of the membership in a cooperative with comparison to the previous legislation. This chapter covers also the basic principles of the membership in cooperative, as well as the content of the membership in cooperative. The third chapter describes the individual methods of the formation of the membership in cooperative pursuant to the effective legislation and where appropriate compares it to the previous legislation. It describes formation of the membership in the moment of formation of the cooperative and the procedure that needs to be followed. Verification of FlexRay membership protocol using UPPAAL

Components with different requirements typically share a common distributed platform for communication. To accommodate varied requirements, many of these distributed real-time systems use FlexRay communication network. FlexRay supports both time triggered and event-triggered communications. In such systems, it is vital to establish a consistent view of all the associated processes to handle fault-tolerance. This task can be accomplished through the use of a Process Group Membership Protocol. This protocol must provide a high level of assurance that it operates correctly. In this thesis, we provide for the verification of one such protocol using Model Checking. Through this verification, we found that the protocol may remove nodes from the group of operational nodes in the communicating network at a fast rate. This may lead to exhaustion of the system resources by the protocol, hampering system performance. We determine allowable rates of failure that do not hamper system performance.

Membership of the Library and Information Association of South Africa (LIASA) among library and information service workers in KwaZulu-Natal

Thesis (M.Tech.: Library & Information Studies)- Dept. of Information and Corporate Management, Durban University of Technology, 2007. x, 109 leaves. / The objectives of the study were: 1) to investigate the extent to which workers in library and information services in KwaZulu-Natal are members of LIASA; and 2) if there are substantial numbers of LIS workers who are not currently members, then what are the possible reasons for this? The study surveyed three types of library services in KwaZulu-Natal, namely, academic, public and special libraries with 330 LIS workers participating in the study. A census was done of LIS workers in special libraries and in academic libraries of public higher education institutions in KZN. Simple random sampling was used in selecting public libraries in KZN for participation in the study. All staff in the selected sample of public libraries were surveyed. The research instrument used was a self-administered questionnaire. It was established that a significant number of LIS workers in all three types of libraries surveyed in KZN are currently not members of LIASA for various reasons. LIASA has been unable to draw significant membership from the support staff category in LIS services despite its constitution claiming to embrace all LIS workers. The study recommends that LIASA market itself more aggressively to increase membership levels particularly in the public library sector and among support staff in all LIS services. It also recommends that LIASA should consider involving itself in the industrial concerns of the LIS sector.

Economics, political values and historic legacy : Determinants of public support for EU membership and European integration in post-communist Europe

This study examines the explanatory power of the traditional explanations as to what determines public support for EU membership and European integration – the economic explanation and the political values‐based explanation – in the context of the post-communist member states of the EU. Further, an alternative explanation – the communist legacy explanation – is presented and tested. It is hypothesized that a high degree of Soviet influence and suppression during the communist period leads to a low degree of support for EU membership and European integration, because of a willingness to protect oneself from violation of national sovereignty once again. The explanatory power of the traditional explanations does not obtain convincing empirical support, even if many individual predictors are statistically significant as determinants. Communist legacy seems to be important as a determinant of public support for EU membership and European integration. However, the hypothesis can neither be accepted nor rejected, because of the methodological problems associated with the dummy variable approach used in order to test it. Further, the direction of the relationship between communist legacy and public support for EU membership and European integration seems to be two‐fold, rather than one-sided as hypothesized.

Everyday Construction of Gender Identity in a Sex-reassigned Child Negotiating Membership Categorization : A case study of an Iranian family in Sweden

Conversation analytic (CA) and ethnomethodological (EM) techniques are employed in this study to explore the ways speakers within and between interactional turns build and resist gender category by resisting its activities/predicates. It aims to reveal how a sex-reassigned child’s identity is pertinent to the construction of membership categorization and the doing of resistance towards category-bound activities/predicates.  The study attempts to explain how the child tries to design her answers in a way that - both explicitly and implicitly - resist both the gender membership categorization she is being assigned to be and its ties (predicates/activities) she is being asked to accomplish. Membership categorization analysis (MCA), formulated by Sacks (1979), is employed here to show that the identity categories used in talk are tools by which participants organize and perform activities/predicates to establish their categories. The human subject that this project concentrates on is an immigrant family having a sex-reassigned child called Aidan. The data, which is analyzed, was collected during a dispute around the haircut and clothing style for the sex-reassigned child between the child and the parents. During the interaction the parents try to generate the category predicates for building up a set of activities around what might be considered ‘normal’ within a community that enables them to define and validate the child particular membership category. The main resistance strategies adopted by the child are dispreferred actions such as refusals mainly through accounting (e.g., justification and explanation) and disagreement.

Scholars in the field are of the opinion that the early simultaneous bilingual and bicultural exposure not only does not harm the bilinguals, but also strengthens their social and cultural foundations and keeps them from getting vulnerable to external environment (Deuchar and Quay 1999, 2000; Genesee 1989; Genesee, Nicoladis, and Paradis 1995; Holowka, Brosseau-Lapre ́, and Petitto 2002; Lanza 1992; Meisel 1989; Petitto et al. 2001). Also it has been demonstrated that bilingual children have differentiated systems to provide them with the ability to distinguish between their two input languages from the beginning of language acquisition (Petitto & Holowka, 2002). However, the driver of the children’s language preference patterns at home needs to be further explored. The present study is indeed an attempt to answer the question of why it is that some children regularly exposed to their heritage language from a very young age actually continue to actively use it, and other children involving in similar parental policy about bilingualism do not? It aims to examine the impacts of parental language strategies during the childhood on children language preference at home after they achieve the key competences in each of the two languages. The foci are parental attitudes towards the patterns of language choice and their influence on child language preference. Data are collected from two Iranian immigrant families; one has been experiencing additive bilingualism, while the other has been involved in the process of subtractive phenomenon. Some implications for parent-child closeness, heritage language and the risk of language contamination are touched on briefly.
