Les obligations disjonctives sont des modalités de l’obligation comportant plusieurs prestations au sein d’une mêmeobligation. Méconnues par les praticiens et peu traitées en jurisprudence, les obligations alternatives et facultatives sont,néanmoins, un formidable outil juridique. Postérieurement à la formation de l’obligation, elles octroient un choix à l’une desparties dans le mode d’exécution de l’obligation du débiteur. Traditionnellement, l’obligation disjonctive était perçue comme un moyen de garantie. Or, la flexibilité contractuelle offerte par le choix amène à proposer d’autres utilisations à l’obligationdisjonctive, dans le dessein de satisfaire la volonté des parties. Le titulaire du choix bénéficie, sur le fondement de la libertécontractuelle, d’un droit potestatif qui lui octroie une option parmi plusieurs prestations. Ce choix confère à cette modalité del’obligation un caractère typique et constitue la particularité de l’obligation disjonctive. Il permet aux parties de disposer d’unrare mécanisme contractuel flexible et efficace. / Disjunctive obligations are modes of the obligation comprising several benefits within one and the same obligation.Disregarded by practitioners and rarely dealt with in jurisprudence, alternative and optional obligations are, nevertheless, aformidable legal tool. After the obligation has been formed, they grant a choice to one of the parties in the method of execution of the debtor's obligation. Traditionally, the disjunctive obligation was perceived as a means of guarantee. However, the contractual flexibility offered by the choice led us to propose other uses for the disjunctive obligation, for the purpose of satisfying the parties' wishes. The person entitled to make the choice benefits, on the basis of contractual freedom, from an autonomous right which grants him an option among several benefits. This choice confers a typical character on this mode of obligation and constitutes the special feature of the disjunctive obligation. It allows the parties to have a rare flexible and effective contractual mechanism.
