The Employment of the Czech citizens in other member states of the European Union The basic aim of my thesis is to analyze possibilities of Czech citizens seeking job in other member states of European Union. The enlargement of EU in 2004 and 2007 opened borders to labour markets of the old EU countries for citizens of new member states. Czech citizens are able to search for a job in most of the states of EU except of Germany and Austria. In my work I concentrate especially on research of United Kingdom. It is a country that opened the labour market for Czech citizens the day our accession to European Union. My thesis is divided into seven chapters. In the first three chapters I analyze the right of free movement of persons, workers and right of settlement. I concentrate on the development from the historical point of view. I also mention the European legislation related to the free movement right. The fourth chapter explains the migration, and the potential of Czech migrant workers. I also describe the reasons for Czech foreign migration. In the fifth chapter I focus on the employment of Czech citizens in other member states in general. Its goal was to know and understand how mobilization and organization of amazon workers, protagonists of the most important strike registered in the city. We use a oral history methodology, which enabled us to understand the process of formation of Oposição Sindical Metalúrgica, the conquest of the Union and the organization of workers inside and outside of the factories, which ensured the large membership of workers to the outage. From the registry in memory of some of the leaders of the outage, coverage by the local press, through the materials disseminated by newspapers A Crítica, Jornal do Commércio and A Notícia and other documents found in personal holdings of Union of Metallurgical and other public institutions, could also understand the central role played by the Catholic Church through Comunidades Eclesiais de Base (CEBs) and Pastoral Operária, training policy of the leaders of the movement, in addition to the significant contribution of the Federação de Órgãos para Assistência Social e Educacional (FASE) during the organization of the strike. / Este trabalho analisa a greve dos metalúrgicos ocorrida em agosto de 1985, em Manaus, Amazonas. Seu objetivo foi conhecer e compreender a forma de mobilização e organização dos operários amazonenses, protagonistas da mais importante greve registrada na cidade. Utilizamos como metodologia a história oral, que nos permitiu compreender o processo da formação da Oposição Sindical Metalúrgica, a conquista do sindicato e a organização dos trabalhadores dentro e fora das fábricas, que garantiu a grande adesão dos trabalhadores à paralisação. A partir do registro da memória de algumas das lideranças da paralisação, da cobertura dada pela imprensa local, através das matérias divulgadas pelos jornais A Crítica, Jornal do Commércio e A Notícia e outros documentos encontrados em acervos pessoais, do Sindicato dos Metalúrgicos e de outras instituições públicas, também foi possível perceber o papel central exercido pela Igreja Católica, através das Comunidades Eclesiais de Base (CEBs) e Pastoral Operária, na formação política das lideranças do movimento, além da contribuição significativa da Federação de Órgãos para Assistência Social e Educacional (FASE) durante a organização da greve.

Within the broader scope of free movement of persons, free movement of workers is one of the fundamental freedoms guaranteed by the European Union (EU) law. It is one of most significant rights that are granted to the Union citizens and will be enjoyed by Turkish nationals after Turkey&rsquo / s accession the Union. In this regard, this study examines the free movement of Turkish workers in the EU within the framework of Turkey&rsquo / s EU accession process and two recent EU enlargements since 2004. Along with the legal scope of free movement of workers, transitional arrangements applied in two recent enlargements are analyzed as it could provide some foresights about such freedom with respect to Turkey&rsquo / s EU membership.

A l'approche de l'élargissement de l'UE de 2004, les Etats membres de l'Union européenne ont adopté des dispositions transitoires à la libre circulation des travailleurs, à savoir une période dérogatoire de sept ans durant laquelle ils pouvaient continuer à appliquer leur législation relative aux permis de travail. Initialement isolée, l'Allemagne est parvenue en quelques années à imposer sa préférence à ce sujet à l'ensemble de l'Union européenne. Cette thèse fait trois constats. Le premier est que si la libre circulation des travailleurs se situe à l'intersection des politiques d'élargissement, de marché du travail et de politique migratoire, c'est la composante migratoire qui a dominé la prise de décision. Plus précisément, les dispositions transitoires étaient perçues comme un outil de migration sélective afin de choisir les profils jugés comme étant les plus désirables - et ce même si les désirs politiques ne correspondaient pas à la réalité du marché. La seconde est qu'il n'y a eu que très peu d'Européanisation et d'harmonisation dans ce processus de décision, les Etats membres dominant les négociations. Movement of workers in the EU - social and legal aspects

The aim of my thesis is to acquaint the reader with the problematic of free movement of workers, both from the theoretical point of view and from practical point of view based on the European Court of Justice cases. In the theoretical part of the thesis, I focus on the characteristics of internal market and definition of free movement of persons and workers. I mention individual law regulations that significantly influence the problematic of free movement of persons. Further, I describe different exceptions from free movement of workers, mutual recognition of academic qualifications and social security regarding the movement of workers. And at last in my practical part, I analyze individual cases of ECJ which have had the most significant impact on the development of free movement of workers.

My thesis deals with intra-EU migration, its motivation factors and then compares the advantages and disadvantages of migration. Free movement of workers is discussed in the next chapter as well as the key mobility drivers and its barriers. The thesis further deals with division of EU member states into receiving and sending countries. Future mobility intentions are analyzed in order to forecast the most probable moves in the future. In its last chapter it mentions labour mobility and ways how to measure it and then it analyses voluntary and forced mobility. In the following part labour mobility is compared to geographical mobility to see their practical implications. The eastern enlargement of the EU has brought some doubts about a massive inflow of labour migrants from the CEE countries to the old member states which has led to the introduction of transitional measures limiting free access to their labour markets. Therefore the main purpose of the thesis is to confirm or refuse the old member states' arguments that a potential migration from the new member states would threaten their labour markets.

Magistriniame darbe, naudojant mokslinės literatūros, aprašomąjį analitinį, teisės aktų ir dokumentų analizės metodus, analizuojamas ES Laisvo darbo jėgos judėjimo principo įgyvendinimas, apibrėžiama laisvo darbo jėgos judėjimo sąvoka, jos taikymo sritis, išskiriami pagrindiniai trukdžiai laisvam asmenų judėjimui ir įsteigimo laisvės įgyvendinimui. Siekiant atsakyti į iškeltus uždavinius pirmoje darbo dalyje pristatomos Europos integracijos teorijos: neofunkcionalizmas, liberalusis ir realistinis tarpvyriausybiškumas, taip pat paaiškinamos viršvalstybiškumo ir tarpvyriausybiškumo sąvokos. Antroje darbo dalyje supažindinama su sąvokos “darbuotojas” taikymo sritimi, jos apibrėžimu ir apžvelgiama kaip laisvas darbo jėgos principas apibrėžtas Europos Sąjungos teisės aktuose. Šioje darbo dalyje taip pat plačiau pristatoma Bosmano byla, kuri panaikino visas kliūtis profesionalių sportininkų iš Europos Sąjungos narių valstybių judėjimui bei taip pakeitė profesionalų sportą. Trečioje darbo dalyje apžvelgiami Europos Teisingumo Teismo sprendimai bylose, kuriose buvo įvardinamos pagrindines laisvės veikimo sritį pažeidžiančios, diskriminuojamosios priemonės, neutralios priemonės, apskritai trukdančios patekti į rinką, pristatomos problemos, kylančios iš valstybių teisės skirtybių. [toliau žr. visą tekstą] / The master thesis, using the scientific literature, descriptive analytical and document analysis methods analyses the implementation of the principle of free movement of workers in the EU, describes „free movement“ notion, its fields of action, excepts the most important disturbances for its implementation. Seeking to fulfill the set tasks, in the first part of the theoretical part are presented theories of European integration: neofunctionalism, liberal and realistic intergovernmental theories. In the second part is discribed „employee“ notion and its use, also is presented legislation of the EU, which controls the implementation of the principle of free movement of workers. In this part also is presented Bosman case. This case changed football transfer markets, because football players from the EU members are allowed play where they want without any limitation. In the third part are presented verdicts of the European Court of Justice which related with discrimination of workers from others members of the EU. In the fourth part are discribed social policy of the EU, its use and fields of action. In this part also are presented the National measures to new members of the EU, its fields of action and mechanism how contries can instal the National measures, its terms. Regulation of free movement of workers in the EU is very specific, because are important verdicts of the European Court of Justice, Treaty of Rome and other legislation of the EU.

The aim of my master thesis is to analyze hindrances to free movement of workers both from the theoretical point of view and in relation to the European Court of Justice cases. In the first part of the thesis I summarize the development of European integration and general principles of free movement of persons. Then the attention is paid to free movement of workers itself. The definition of a worker, primary and secondary legislation governing free movement of workers and the scope of free movement of workers are presented as well. Moreover, derogations from the principle of free movement of workers are discussed. The next part of the thesis is dedicated to the description of the European Court of Justice, its composition and various types of proceedings. In the last part of the thesis the most significant ECJ cases concerning hindrances to free movement of workers are selected and analyzed.

It is bibliographical and documentary research and also interviews is contempled with educators of the public basic network of Goiás State that participated in the organizations (Syndicate) in defense of the category combine to promote common interests: The Sintego (Union of the Workers in Education of Goiás State) and the MPG (Movimento de Mobilização dos Professores do Estado de Goiás). With regard to Sintego, the context of its genesis, development and crisis was observed, which intensify in the 90s as well as the following decades in a world context of productive restructuring of the monopolist capitalism and a deepening/wider/increase of the opening of the periphery societies to the neoliberalism capitalism. With regard to the MPG, its origin is approached within the neoliberal context, as a movement of opposition to the political direction given by the union (Sintego) to the movement of workers in education. / Este estudo insere-se na linha de pesquisa “Política Social – Movimentos Sociais e Cidadania”, do Programa de Mestrado em Serviço Social, e tem por objetivo compreender e analisar como vem acontecendo a organização dos trabalhadores em educação da rede básica pública em Goiás, desde o período pós reabertura política, no Brasil. Foram realizadas pesquisas bibliográficas, documentais e também entrevistas com trabalhadores em educação da rede básica pública de Goiás que participam das organizações classistas em defesa da categoria: o Sindicato dos Trabalhadores em Educação de Goiás (Sintego) e o Movimento de Mobilização dos Professores de Goiás (MPG). Com relação ao Sintego, foram observados o contexto de sua gênese, desenvolvimento e crise, que se aprofunda nas décadas de 1990 e seguintes, em um contexto mundial de reestruturação produtiva do capital e de um aprofundamento da abertura das sociedades periféricas ao capitalismo mundial. Com relação ao MPG, é abordada sua origem no contexto neoliberal, como um movimento de oposição à direção política dada pelo Sintego ao movimento dos trabalhadores em educação.
