In hierdie skripsie is op die belangrike kwessie van onafhanklike waarborge of
waarborge betaalbaar op eerste aanvraag (‘demand guarantees’) gefokus.
Onafhanklike waarborge speel ’n groot rol in internasionale handel en word dikwels
as die ‘lewensbloed van handel’ beskou. ’n Onafhanklike waarborg kan beskryf word
as ’n persoonlike sekuriteitsonderneming waaronder ’n bank die betaling van die
onafhanklike waarborg aan ’n begunstigde belowe, indien die prinsipaal nie sy
verpligtinge ingevolge die onderliggende kontrak nakom nie.
’n Fundamentele beginsel van onafhanklike waarborge is die
onafhanklikheidsbeginsel
(die ‘autonomy principle’ of ‘independence principle’). ’n Probleem wat dikwels in
regspraak voorkom ten opsigte van onafhanklike waarborge, is die vraag oor
wanneer ’n finansiële instelling aanspreeklikheid mag vermy, met ander woorde op
watter uitsonderings tot die onafhanklikheidsbeginsel die bank aanspraak kan maak.
Suid-Afrikaanse howe aanvaar dat die onafhanklikheidsbeginsel van onafhanklike
waarborge in sekere gevalle deur die bank (die borg) geïgnoreer mag word. Bedrog
is een so ‘n uitsondering en die uitsondering van onregmatigheid begin ook
aansienlik meer aandag geniet in die howe.
As navorsingsontwerp is die leerstukgebonde metodologie gebruik ten einde die
kwessies wat in die mini-verhandeling aan bod kom te ondersoek. Akademiese
artikels, wetgewing en regspraak is geraadpleeg en bespreek Daar is verder ook
vergelykend te werk gegaan deur die Engelse regspraak te betrek..
Gebaseer op die geraadpleegde bronne word daar tot die gevolgtrekking gekom dat
Suid-Afrika die streng benadering tot die bedroguitsondering tot die
onafhanklikheidsbeginsel volg. Die kwessie van die onregmatigheid van die
onderliggende kontrak moet egter nog baie aandag kry. Onregmatigheid as
uitsondering is nog in sy kinderskoene en daar is steeds baie onsekerheide ten
opsigte van die presiese toepassing daarvan, die tipes onregmatigheid en die
bewyslas wat vereis word. Tot dusver is daar geen regspraak in die Suid-Afrikaanse

The Basel Committee on Banking Supervision has defined operational risk, legal risk and compliance risk. However, the definitions might not be adequate for countries with a hybrid legal system, such as South Africa. This study aims to provide a practical solution to the problems faced by countries with a hybrid legal system wishing to comply with the Basel Committee’s standards. It is argued that compliance, compliance risk and regulatory risk should all be viewed as constituent components of legal risk, and in turn necessarily also of operational risk in a hybrid legal system. Legal risk is a wide concept which includes all aspects of a legal system, while compliance risk is a narrower concept which only includes the codified aspects of a legal system. Legal risk therefore includes compliance risk. Compliance with the Batho Pele principles in a primary health care context / Idah Deliwe KhumaloKhumalo, Idah Deliwe January 2010 (has links)
In this study the focus is on Batho Pele (a Sotho translation for 'people first'), an initiative to get people that work in the public services to be service orientated and to strive for excellence towards continuous service delivery improvement (SA, 2004a:8). Batho Pele consist of a framework with two primary functions that apply to this study; service delivery to people as the customers (patients in this study) and the possibility to hold individual public servants (health care personnel in this study) accountable for poor service delivery. This, in fact, implies that poor performance lead to poor service delivery; thus, compliance with the Batho Pele principles plays a pivotal role to improve quality health care service delivery.
The purpose of the study was to make recommendations to enhance the current compliance with the Batho Pele principles in a Primary Health Care (PHC) context that would positively improve quality care and patient satisfaction. A non–experimental, quantitative, descriptive study was undertaken within the philosophical framework of the Batho Pele principles as well as the Patients‘ Right Charter. All participants completed a structured questionnaire to determine the level of compliance with the Batho Pele principles as experienced by the patients and viewed by the health care personnel in a PHC context. The data collected, was analysed using descriptive statistics. Four PHC clinics were involved, situated at Umzinyathi District Health in the Kwazulu Natal (KZN) Province of South Africa. The study included two patient–population samples, based on convenience; the participants that visited the clinics (n=132) and the participants visited by the researcher at home (n=101). Fifty– six (n=56) health care personnel who voluntary agreed to participate in the study were an all–inclusive sample.
The findings revealed that the patients in the study felt more secure to answer the questions on their experiences regarding compliances with the Batho Pele principles at home and this could be an important consideration when conducting patient satisfaction surveys. It was also clear that patients were more dissatisfied than health care personnel in most questions asked regarding their experience on the compliance with the Batho Pele principles in a PHC context.
Recommendations were made in the light of what was contained in the study that can serve as a starting point to address identified shortcomings in nursing practice, nursing education and nursing research. / Thesis (M.Cur.)--North-West University, Potchefstroom Campus, 2011.

Compliance with the constitutional norms and principles for democratic public administration at rural secondary schools in the Chris Hani West District, Eastern Cape ProvinceRalane, Maureen Khanyiswa 02 September 2020 (has links)
Abstract is in English, Xhosa and Afrikaans / By means of a qualitative multiple case study, I investigated the compliance of the administrations of three rural secondary schools in the Chris Hani West District, Eastern Cape Province with the constitutional democratic principles of cooperation, accountability and transparency. I consulted legal sources to identify provisions dealing with the implementation of these principles and to create a framework for data analysis and interpretation. Fieldwork commenced with a document analysis of relevant school documents, followed by focus groups with members of representative councils of learners, school management teams and school governing bodies. I concluded with semi-structured interviews with principals.
