A CDB não propõe a proteção da biodiversidade por meio de sua intocabilidade, traduzida pela idéia de conservação, ao contrário, promove a inserção de uma perspectiva preservacionista de proteção do meio ambiente que inclui a diversidade social e determina o respeito, preservação e manutenção dos conhecimentos, inovações e práticas dos povos indígenas, com estilos de vida tradicionais que sejam relevantes para a biodiversidade. Assim, a presente dissertação tem como objeto de estudo a proteção dos conhecimento tradicionais dos povos indígenas, inclusive no ordenamento jurídico brasileiro, a partir das disposições da Convenção sobre Diversidade Biológica, como marco jurídico e de seus reflexos em outros tratados internacionais conexos. O trabalho terá por objetivo, a análise dos pontos mais polêmicos suscitados nas discussões em torno da regulamentação da preservação e conservação da biodiversidade e dos conhecimentos tradicionais a ela associados, enfatizando a atuação dos povos indígenas, como novos protagonistas sociais, no âmbito da CDB. _______________________________________________________________________________ ABSTRACT / At present The Convention on Biological Diversity (CDB) is the most important international treat on environment as it includes all the components of biodiversity and looks through the preservation of natural resources and their use in sustainable ways. The CDB does not propose the protection of biodiversity by means of its untouchability, translated by the idea of preserving. On the contrary it promotes the insertion of a protection perspective of the environment that includes the social diversity and determines the respect, preservation and maintenance of the indigenous peoples, knowledge, innovations and practices, with traditional styles of life that are important for the preservation of biodiversity. Thus, the present thesis has as its object of study the protection of the indigenous peoples, including The Brazilian Legal System, according to the Convention of Biological Diversity , as a legal landmark, and its consequences in other similar international treats. The purpose of the work is the analysis of the most controversial points coming out in discussions about preservation of biodiversity and the traditional knowledge associated emphasizing the performance of indigenous peoples as new social protagonists in the scope of the CDB.
