Nelegalus darbas yra aktuali ir daug diskusijų kelianti problema. Visapusiškas šio reiškinio teisinio reguliavimo ypatumų bei kvalifikavimo problematikos atskleidimas, analizuojant teismų praktiką, nacionalinius bei tarptautinius teisės aktus yra būdas tinkamai nustatyti nelegalaus darbo faktą. Lietuvos Respublikos Konstitucijoje įtvirtintas teisės į darbą principas, pasireiškiantis tuo, jog kiekvienas žmogus gali laisvai pasirinkti darbą bei verslą ir turi teisę turėti tinkamas, saugias ir sveikas darbo sąlygas, gauti teisingą apmokėjimą už darbą ir socialinę apsaugą nedarbo atveju. Nelegalus darbas pažeidžia kiekvieno asmens Lietuvos Respublikos Konstitucijoje įtvirtintą teisę į darbą bei visas su šia teise susijusias socialines garantijas. Lietuvos Respublikos Administracinių teisės pažeidimų kodekse nelegalus darbas vertinamas kaip vienas sunkiausių darbo įstatymų pažeidimų, pažeidžiančių imperatyvias įstatymo normas ir žmogaus pagrindines teises. Šiuo pažeidimu padaroma žala ne tik konkrečiam asmeniui, bet ir visai Lietuvos valstybei. Nelegalaus darbo problemą įstatymų leidėjas sprendžia, bandydamas atrasti geriausią šio reiškinio teisinį reguliavimą. / Illegal Work is a very relevant and a lot of discussions upraising problem. A proper way to determine the existence of Illegal Work is to comprehensively reveal the legal regulation of this phenomenon and the classification characteristics of this problem, by analysing the case law, national and international law. The Constitution of the Republic of Lithuania ensures the right to work principle, which expresses the fact, that every person may freely choose a job or business, and has the right to have a reasonable, safe and healthy working conditions, a fair pay for work and a social protection from unemployment. Illegal Work violates every person’s right to work and all the social guarantees, relating this right, which is infixed in the Constitution of the Republic of Lithuania. Illegal Work is considered as one of the most serious Labour Law‘s violations in the Code Of Administrative offences of the Republic of Lithuania, which violates the peremptory rules of law and the fundamental human rights. This violation does harm not only to the individual person, but also to the entire state of Lithuania. Legislator is trying to solve the illegal work problem by finding the best possible legal regulation of this phenomenon.

Darbe nagrinėjamos nelegalaus darbo teisinio reguliavimo Lietuvos Respublikoje problemos. Autorius, remdamasis darbo teisės doktrina, Lietuvos Respublikos teisės aktų ir Lietuvos Respublikos teismų praktika, tarptautinių organizacijų ir atskirų užsienio šalių praktika, analizuoja ir išryškina nelegalaus darbo teisinio reglamentavimo problematiką Lietuvos Respublikoje. Pirmojoje dalyje aptariamos nelegalaus darbo, kaip negatyvaus socialinio reiškinio atsiradimo priežastys, nagrinėjami šio socialinio fenomeno padariniai. Antrojoje darbo dalyje analizuojama nelegalaus darbo reiškinių kontrolės problema Europos Sąjungoje, vertinamos Lietuvos nelegalaus darbo apimtys ir nelegalaus darbo kontrolės sistema. Trečiojoje dalyje analizuojamas nelegalaus darbo kontrolės efektyvumas Lietuvoje, atliekant Lietuvos Valstybinės darbo inspekcijos nelegalaus darbo kontrolės efektyvumo ekspertinį tyrimą, pristatomos nelegalaus darbo kontrolės efektyvumo problemos Lietuvoje sprendimo kryptys. / In Master's thesis there analyzed and evaluated the current situation of the undeclared work control efficiency in Lithuania. The problem – solving directions are specified. In first main part of the thesis there are researched emerge causes of the undeclared work. Analyzed legal and illegal work problematic aspects, undeclared work formation aspects. In the second part of the thesis there are analyzed undeclared work phenomena control problem in the European Union, assessed undeclared work volume and undeclared work control system in Lithuania. In the third part of the thesis analyzed undeclared work control efficiency in Lithuania. Trying to find out the undeclared work efficiency problems, was made an expert survey of the Lithuanian State Labor Inspectorate and finally presented problem – solving directions of the undeclared work control efficiency Lithuania.
