Judicial management in South Africa : its origin, development and present day practice and a comparison with the Australian system of official management

Includes bibliography. / Judicial management is a system which aims at rehabilitating a company which has got into difficulties and in normal circumstances would be wound-up if the system did not exist. When judicial management was introduced into South African companies' legislation in 1926, it was unique to South Africa. It was subsequently adopted by Rhodesia who based their companies' legislation on the South African companies' legislation and in the early 1960's a similar system, known as Official Management, was introduced into Australian Companies' legislation. This dissertation looks at the origins of judicial management and traces its development over the years to the present day, and its incorporation into other spheres of legislation, namely, Banking legislation Building Society legislation and Insurance legislation. It examines in detail the present system of Judicial Management and Official management and highlights the deficiencies in and recommends improvements to the Judicial Management provisions of the South African Companies Act.

Classifying and assessing the effectiveness of judicial procedures in Mississippi Community Colleges

This study classified and compared the judicial procedures that mirrored the criminal justice system with judicial procedures that were less formal and more student-oriented. The judicial procedures of Mississippi’s Community and Junior Colleges are the focus of the study. Each school’s judicial procedure was classified and placed on a continuum based upon its formality. Formality was determined by analyzing the terminology, characteristics and structure of an institution’s judicial procedure. After each school’s judicial procedure was classified, various outcomes (total number of cases adjudicated, total number of appeals filed, number of sanctions overturned by appeal, the rate of recidivism, and lawsuits filed against the institution that were related to a judicial hearing) were studied to determine which type of judicial procedure was most effective in adjudicating students. The results of the study indicated that there was no significant difference between judicial procedures that were highly legalistic and resembled the criminal justice system and those judicial procedures that were less formal and more student development oriented. Furthermore, it was determined that high formality institutions adjudicated more students than both low and medium formality institutions. Finally, it was discovered that a judicial procedure that had a combination of legalistic principles and student development theory would be the most effective method of adjudicating students.

La tesis tiene por objeto revisar el actual sistema de actos de comunicación procesales y aportar soluciones que permitan mejorarlo. El estudio ha procurado abarcar toda la normativa y todos los tipos existentes en el derecho procesal español, ya se dirijan a la partes, otro órgano judicial, una administración pública o cualquier otro ente o individuo, con la única excepción de las comunicaciones internacionales. El primer capítulo se ocupa de centrar la figura objeto de estudio y analizar su tratamiento en la doctrina constitucional con especial atención a la tesis de la indefensión material, la cual se cuestiona y critica. El segundo capítulo examina el ámbito subjetivo, objetivo y los elementos formales de las comunicaciones. Un punto importante del mismo lo conforma la designación del lugar de realización de las comunicaciones, en especial, el domicilio, del demandado y los medios empleados en su localización, lo que resulta fundamental para impedir que un proceso se desarrolle sin su conocimiento. El tercer capítulo se consagra al análisis de las distintas modalidades de transmisión de la comunicación, con especial atención a los modernos medios técnicos de comunicación como el fax o el correo electrónico, cuya utilización regula de forma novedosa, la ley de enjuiciamiento civil 1/2000. La eficacia e ineficacia de los actos de comunicación se deja para el cuarto capítulo, en el cual tienen cabida temas como el perfeccionamiento, régimen de nulidad y subsanación, los medios de impugnación y reparación que pueden hacer valer los afectados por comunicaciones defectuosas y el régimen de responsabilidad derivado por la omisión o el mal funcionamiento de los mismos. El estudio finaliza con la inclusión de unas conclusiones y una propuesta de reforma legislativa.
