The thesis deals with the problem of domestic violence and its prevention. The first part of the thesis focuses on defining the key notions necessary to understand speci-fic characteristics of domestic violence. The next part of the thesis concentrates on con-temporary legal regulations on domestic violence, progress up to now, and this is being followed up by suggestions de lege ferenda on the end of the thesis. The essential part of the thesis deals with prevention and tries to present improvement suggestions.

The crime of theft under s. 205 of the Criminal Code Theft is a traditional offence against a property and it is the most frequent offence in Czech Republic. A statistic of the thefts committed in 2011 compared to the other offences against a property is attached to this dissertation work. Every criminal offence in Czech Criminal law must be established by a statute. Theft is regulated in section 205 of the Criminal Code. Theft is unique for its duality of body of an offence. Subsection 1 regulates the basic form of the theft, whilst subsection 2 regulates recidivism. The following subsections 3-5 deal with circumstances in which more severe sanctions might be applied. The basic element of theft is wrongfulness. Only a wrongful act might be regarded as a crime. The wrongfulness might be presumed from various statutes and branches of law other than Criminal law (e.g. Civil law, Constitutional law). The other element of a theft is its body of an offence. It consists of an object, objective side, subject and subjective side. The object of the theft is value against which the offender's action is aimed. Theft's object is proprietary right of an owner. Psychological Profiling of an Offender The purpose of the thesis is to describe and demystify the subject of offender profiling, also called criminal profiling or psychological profiling. Criminal profiling is one of key disciplines of forensic psychology which approximately in the last twenty years became recognized as a helpful investigative tool for resolving difficult criminal cases. The thesis is structured into four chapters, each one covering different aspect of criminal profiling. First chapter defines criminal profiling, its basic premises, formation and history, different approaches to profiling and possible uses of profiling. Second chapter focuses on practical use of criminal profiling. The thesis describes psychological profiling of an offender, which is a method used for investigating serious criminal acts. It was developer in the United States of America, particularly on the FBI ground, and is based on creating an image of probable unknown offender. The goal of the thesis is to provide readers with basic information about what is psychological profiling and how the process works. The paper is divided into five chapters. First, opening chapter is divided into three parts. In the first one, the reader can find information about the term psychological profiling, how it is defined and what is it for. Second part contains information about history of the method including some about the development in the Czech Republic. The third part describes offences suitable for profiling and those which are not. The second chapter is focused on creating the profile. Differences in Offending Patterns between Adolescent Sex Offenders High or Low in Callous and Unemotional Traits

Adolescents commit nearly one-fifth of the sex crimes each year. Among those offenders exists a group of adolescent sex offenders with callous and unemotional (CU) traits who seem to show a more severe pattern of sexual offending. The current study attempts to test the importance of these traits by comparing adolescent sex offenders high or low on CU traits based on victim and offense characteristics, and offending history. A sample of 150 detained adolescents with a current sexual offense conviction were assessed through self-report, clinical interview, and file review. Results indicated that after controlling for a history of antisocial behaviors, the high CU group was more likely to have a greater number of victims, use more violence with victims, and engage in more offense planning than the low CU group. The high CU group was also more likely to offend against both strangers and family.

This diploma thesis deals with the criminalistic method of psychological profiling of an offender. Psychological profiling consists in analyzing the offender's behavior. This analysis is used to create an offender profile that contains offender's likely characteristics. Such a profile is intended to help investigators narrow down the range of suspects, or contribute to the success of investigations by refocusing the investigative strategy. The aim of this thesis is to present a balanced view of the method of psychological profiling and to critically evaluate the possibilities of its use for improving the quality of investigative practice. The thesis is divided into three chapters. The first chapter first defines this method, including basic theoretical approaches and bases. Domestic violence offenses: The influence of victim-offender relationship on prosecutorial and judicial decision making

Thesis advisor: Thomas O'Hare / Domestic violence is a widespread social problem impacting an estimated 6.2 million women in the United States each year (Department of Justice, 2008). The purpose of this study was to determine the existence, prevalence, and degree of disparity in prosecution and sentencing based on domestic violence status, victim-offender characteristics, and victim-offender relationship. The study specifically looked at cases of assault and battery, which is the most prevalent type of offense in domestic violence (Buzawa, Buzawa, and Stark, 2012; Payne & Wermeling, 2009). This study utilized simple random sampling, involved an archival analysis of court records, and examined a ten-year period (2000-2010) at Salem District Court in Essex County, Massachusetts. This investigation found that the likelihood of a case not being prosecuted was affected by whether or not it was a domestic violence incident. Fifty-five percent of domestic violence cases resulted in dismissal, while only 45% of the non-domestic violence cases were dismissed. If prosecuted, 84% of domestic violence cases resulted in a suspended sentence, while only 21% of the non-domestic violence cases that were charged resulted in a suspended sentence. The results also showed that the degree of social closeness between a victim and offender influences the likelihood that a case will be prosecuted. For instance, an offender who assaults a family member or an acquaintance is more likely to be prosecuted than one who assaults an intimate partner. In addition, among prosecuted cases, domestic violence offenses resulted in shorter sentences and less severe sanctions relative to other offenses. The most significant implication of this study is that domestic violence victims continue to receive unequal treatment by the criminal justice system. The aim of my thesis is disclosing reasons of delinquency from the view of the offender. In the first chapter I focused on basic terms such as what is criminology, criminality, and what defines an offender. In the second chapter I summarized the relevant criminological theories. The next chapter is about typologies of offenders. The fourth chapter, I pay attention to the term "personality", it's structure, term BASIC ID and the motivation of delinquency. The last chapter deals with juvenile criminality, which increased exponentially after the Velvet Revolution in 1989.

Examining Perceptions of Sex Offenders as Influenced by Gender Variations and Rape Myth Acceptance

abstract: While there is a good amount of research focused on sex offenders as a whole, only a limited number of studies examine variations within these offenders, how people view the variations, and why their opinions may differ. This study focuses on the interconnections among gender norms, rape myth acceptance, and the perception of sex offenders by administering an online student survey. The survey measured rape myth acceptance and adherence to traditional gender roles to see how they affected perceptions of sex offenders. Perceptions were measured using vignettes that were varied by gender and the situation described. Results showed that higher rape myth acceptance would decrease the blameworthiness of the offender, that the offender was seen as more blameworthy when the offender was a male, and that women tended to see the offender as more blameworthy than men did. The type of sexual situation did not have an impact on blameworthiness, nor did adherence to gender roles. The findings support past research that suggests that rape myth acceptance can impact people’s opinions about offenders in sexual situations and specifically that these opinions differ depending on the gender of the offender. With some offenders being viewed as more blameworthy than others, it is necessary to examine sex offense laws to see how they may disproportionately affect some offenders and implement harsher punishments than the public may deem necessary. / Dissertation/Thesis / Masters Thesis Criminology and Criminal Justice 2018

SOCIAL WORK STUDENTS' PERCEPTIONS OF SEX OFFENDERS

Social workers who choose to work in the field of child welfare will almost unavoidably be exposed to sexual trauma. This requires that social workers are prepared to understand and work with those who have been sexually abused, as well as the perpetrators of sex crimes. The purpose of this study was to explore social work students’ perceptions of sex offenders since it is anticipated that they will work with the sex offender population at some point in their careers. Exploring this topic could help future social workers gain valuable knowledge related to recognizing barriers that may exist when working with sex offenders. To study social work students’ perceptions of sex offenders, quantitative data were collected using a fifty item online survey instrument that was distributed via the Qualtrics website. In addition, t-tests, ANOVA, and Chi-square analysis were conducted using the SPSS analytical software program version 21. The findings of this study suggest that there were no significant differences between participants’ gender regarding their perceptions of sex offenders. Furthermore, the study found that overall, social work students’ perceptions are that there are more male sex offenders than female and juvenile sex offenders. The findings of this study suggest that further research is needed in order to explore social work practitioners’ perceptions of sex offenders since there is a likelihood that social works will work with this population at some point in their careers.
