The implementation of the Employment Equity Act No. 55 of 1998 in respect of people with disabilities in the Department of Health Kwazulu-Natal : perceptions and experiences of key personnel and people with disabilities.

The study took place in the Department of Health. It involved four districts and the Head Office of the human resource planning component. Its purpose was to explore the extent to which the Employment Equity Act is implemented in respect of people with disabilities by the Department of Health, KwazuluNatal. The experiences and perceptions of employment equity officers and people with disabilities were explored. In addition the document on Gap Analysis on EEA was analyzed. Qualitative methodology guided the explorative descriptive nature of the research. The sample selected for the study aimed at balancing opinions on the subject under investigation. Data was collected through structured questionnaires, in depth interviews and content analysis of the departmental Gap Report on Employment Equity. The main findings revealed that there is a wide gap between the current status quo and achieving the desired objectives of the Act. There is also a lack of awareness among People with disabilities in understanding the legal rights in terms of the Act. This situation weakens stakeholder's participation in implementation of the Employment Equity Act NO.55 of 1998. The main recommendations related to the implementation of intensive training programmes, in order to assist stakeholders to participate effectively in Employment Equity Act programmes. A bottom up approach on implementation of the Employment Equity Act was recommended. Exploration of employment experiences of students with disabilities who have studied at the University of KwaZulu-Natal.

Research studies have indicated that people with disabilities in South Africa and across the world have difficulties in securing employment. The medical approach towards disability contributes to the negative attitudes, ignorance and stereotypes employers have about people with disabilities. The aim of the study was to explore the employment experiences of students with disabilities who have studied at the University of KwaZulu-Natal. The lack of previous research on this issue at UKZN motivated the researcher to undertake this research. Furthermore, since the researcher is a disability officer at UKZN, a number of students with disabilities had raised their employment frustrations with her which gave further motivation to investigate the underlying reasons. A qualitative research method was used to undertake this study. The sample used was an availability sample, comprising 21 interview subjects with disabilities who had graduated from UKZN in the period 2001-2006. An ecosystem perspective was used as a framework to guide the study. The major conclusion of this study is that the majority of participants interviewed had difficulties in securing employment. Employers were reluctant to employ them, apparently fearing that they would not be able to cope on the job and because there might be additional costs incurred if they were employed. Visually disabled study participants also experienced difficulty accessing job advertisements. Inaccessibility of transport to access interviews and workplaces were a further obstacle for participants. The study also discovered that the limited number of subjects offered at high school impacted on the choice of tertiary courses participants wanted to take at the university as a result this caused dissatisfaction with degrees they obtained. The findings in this study are consistent with a number of similar studies which revealed that people with disabilities are confronted with challenges in obtaining work. Exploration of the role of the community response network in Kelowna

The Community Response Network in Kelowna was formed from the policydriven elder abuse committee and as a response to the Adult Guardianship Act of British Columbia enacted in 2000. After the inception of the act that addresses abuse, neglect and self-neglect of adults, the Community Response Network - a community development initiative that was implemented from social policy - was unsure of its role in the community. The purpose of this qualitative research is to assist the network in defining its role in supporting adults who may be vulnerable to harm. What is the role of the Community Response Network? What did the network do in the past? How effective was it? Who should be involved? It was thought that the network would continue to offer education and awareness to community members. Through a purposeful convenience sample of participants in both a focus group and individual interviews, various themes such as structure, values, context and tasks were evident through verbatim analysis. As well, through a feminist analysis, several dichotomies and inconsistencies were interpreted. Recommendations for the network include continuing education and awareness workshops, strengthening linkages in the community, and inviting a diverse group of people to become involved in the committee.

Culture and consciousness of physically disabled persons : the need for drama within the special school curriculum.

This dissertation investigates how disability has been defined, and focuses on the shift in the conception of disability as an individual and medical problem to disabi1ity as a form of social oppression. Starting from an historical perspective the position of disabled persons in society is traced. The advance of disabled persons, from a condition of enforced social invisibility, to one in which they make themselves seen and heard through social movements fighting for their rights, is outlined as an introduction to a record of practical engagement through pedagogy in a concrete South African context. . After examining the way myths and stereotypes continue to perpetuate discriminatory practices against disabled persons, attention is drawn to the representation of disability through negative and positive images reflected in media as discourse. Thereafter, the material conditions that help, construct the confined, isolated position of disabled persons within society are considered. Attention is drawn to the theoretical positions of Foucault, Fanon and Bulhan to understand how disabled persons have been excluded and/ or exclude themselves from active participation in society. In the light of the foregoing, the dissertation argues for the position of drama as a means of developing a positive self-concept and a positive self-image within disabled persons. The utility of drama in fulfilling this need is demonstrated by way of a qualitative analysis of the experience of drama teaching over a period of several years. The use of drama within special education is urged as a learning medium, with drama as performance and drama as a means of consciousness-raising to advocate for the acceptance and recognition of disabled persons within society. In conclusion, the placement, value and organisation of drama within the Special School Curriculum is considered. The dissertation emphasizes the value of drama as part of culture in which children develop, understand and reflect on their social values, and concentrates on their part in the dialectics of change. / Thesis (M.A.)-University of Natal, Durban, 1994.

Passengers' protection and rights in international civil aviation

Air transport is of critical importance to move passengers and cargo from one place to another on a global scale. Subsistence, sustenance, growth and profitability of the air transport industry are dependent on the demand for transport from passengers and cargo as the main sources of revenue of the airline industry. The forces of globalization and liberalization, coupled with the very rapid development of low-cost operators, have tempered the growth and profitability of the aviation industry whilst, at the same time, greatly increasing the consumer (passenger and air freight user) advantages in terms of expanding the gamut of their choices, better quality and lower prices. The ever-expanding markets in the Asia and Pacific region hold great promise for a rapid growth of the aviation industry in years to come. / Currently, the international civil aviation community is faced with many challenges evolving from globalization, liberalization of economic regulations, privatization of airlines and airports, commercialization of government services providers, increasing environmental controls, and the emerge of new technologies. To deal effectively with these challenges and issues will require a high level of cooperation among civil aviation authorities, airlines, airports, and providers of air services and products. Airlines under the new free trade regimes have been exposed to many changes and although GATS has an important role to play in this important field, the convergence of economic, safety, security and environmental issues makes a strong case for keeping regulation in these critical issues under the ICAO aviation umbrella. / As air transport experiences structural, policy and regulatory environment changes, in the era of free trade it would be interesting to critically examine the impact of the aforementioned changes on the rights and protection of passengers. In this relation, it becomes very important to review the international, regional, and national efforts which have been made to enhance consumer protection and also have an important bearing on the rights of airline passengers. The thesis also addresses some emerging, non-traditional consumer protection issues, such as health, racial discrimination and the rights of disabled passengers. / In view of the above, the well-developed consumer protection regimes in the United States and the European Union (EU) would be examined in depth and the results of its analysis would be used to develop a suitable model airline passenger protection in the rapidly expending economies of the Asia and Pacific Region.

Developing an implementation strategy for the free health care policy for persons with disabilities at public hospitals in KwaZulu-Natal.

ABSTRACT This study focuses on the implementation strategy of free health care policy for disabled persons at hospital level in KwaZulu-Natal. Since the introduction nationally, in 2003 of free health care policy for disabled persons, no evaluation has been conducted in KwaZulu- Natal to inform health service managers and the KwaZulu-Natal Department of Health on the implementation of this policy. A provincial implementation strategy is needed for effective implementation of the policy. To date, no such provincial implementation strategy is available and the lack of an implementation strategy for this policy motivated this study. METHODS An exploratory qualitative study design was implemented to elicit information from health service providers and representatives of persons with disabilities to inform the development of an implementation strategy for the free health care policy for disabled persons at public hospitals in KwaZulu-Natal. Data was collected through interviews and focus group discussions. Data was analysed by utilising a thematic approach. RESULTS Respondents reported a variety of understandings with regard to policy context of the Free Health Care Policy for disabled persons, policy content in terms of purpose and eligibility, policy implementers and their roles in implementing the policy, and the implementation process of this policy at state hospitals of KwaZulu-Natal. CONCLUSION There is limited understanding of the Free Health Care Policy among some health service personnel and some disability groups, and this may have contributed to the erratic and poor implementation of the policy at public hospitals in KwaZulu-Natal. Factors necessary for policy implementation such as a communication strategy, guidelines for implementation, assessment of availability of resources, training of implementers, monitoring and evaluation strategy are crucial for effective implementation of any policy including the Free Health Care Policy for disabled persons. / Thesis (M.Med.Sc.)-University of KwaZulu-Natal, Durban, 2013.
