This diploma thesis is a comprehensive and up-to-date review of public private partnership (PPP) infrastructure projects at the municipal level in Germany. Public private partnerships use the know-how and the skills of the private sector for the construction and operation of infrastructure and for the long-term provision of public services. The overall goal of this thesis is to discuss the municipal government's approach to PPP infrastructure projects. The theoretical part of this thesis includes informations and fundamental characteristics of public private partnership project types and the most widely used financial instruments in Germany, as well as the obstacles, challenges and prospects of success for the PPP Programme. The thesis further deals with the legislation and the institutional framework of this cooperation, including the establishment of the Partnerschaften Deutschland und other PPP units in central and local government to promote and manage projects. In particular we focus on the possibility of the involvement of private partners in public private partnerships to clear the backlog of investment and to satisfy local authority investment needs. The empirical part of this work describes the efficient, beneficial and cost-effective delivery of what is currently one of Germany's biggest PPP projects in the field of public- sector building construction: refurbishing, financing and operating the 90 schools in the district of Offenbach in the south of Hesse.

Esse Projeto, denominado Solução Educacional para o Ensino Médio, foi criado por meio de uma parceria celebrada entre a Secretaria de Estado de Educação do Rio de Janeiro e o Instituto Ayrton Senna e objetiva proporcionar melhoria na qualidade da educação ofertada no Ensino Médio da rede estadual de educação do estado do Rio de Janeiro. O Ensino Médio tem sido uma preocupação constante na política educacional do Brasil e a busca da melhoria na qualidade dessa modalidade tem se revelado de suma importância. Isso é fundamental na medida em que a escola atualmente se depara com novos desafios, entre eles o de estabelecer condições mais adequadas para a formação do jovem perante os desafios do século XXI. A metodologia utilizada foi o estudo de caso de caráter qualitativo e quantitativo, com diferentes técnicas de coleta de dados: análise documental do Projeto Solução Educacional para o Ensino Médio, pesquisa bibliográfica, entrevista com os gestores, professores e alunos da escola, na busca de compreender a dinâmica dos processos constitutivos, envolvendo um diálogo do pesquisador com a realidade estudada. Este estudo foi desenvolvido à luz das reflexões de teóricos como Zabala (1998), Britto et al (2013) e Delors (2012) que abordam temas como a formação do cidadão para o século XXI e Saviani (2010) e Neves (2005) que tratam de políticas educacionais para o Ensino Médio, entre outros. Os resultados da pesquisa apontam que, para a expansão do Projeto para outras escolas da rede, há a necessidade de formação de novos Gestores e o aprimoramento da formação dos professores, haja vista a dificuldade apontada pelos mesmos na fase inicial de implementação do Projeto. Os resultados também revelaram, entre outras questões, a necessidade de uma aproximação efetiva da escola com as famílias, tendo em vista a importância dessa integração para o Projeto e considerando a inexistência de ações que promovam essa aproximação. A formação de gestores e professores e a integração da escola com as famílias culminaram na proposta do Plano de Ação sugerido nesta pesquisa. / The present dissertation, has the outer to investigate the perception of the involved actors in a pilot project, implementing in a high school of the state of Rio de Janeiro, wich privileges the development of socioemotional competence per a curriculum integrated by means of verify their challenges for a extension of project in other schools managed by state, for the purpose of development actions. This project denominated educational solutions for the high school was invented by means of partnership created between an education secretary of the state of Rio de Janeiro and "Instituto Ayrton Senna" has the objective afford progress in the quality of education at high school manage by the education state of Rio de Janeiro. The high school have been a constant concern in the educational politic of Brazil, and the search to progress in quality of this modality been revealed very apportante. There is a fundamental for a school actualy who have a new prespective with new challenges, between them implant conditions more appropriative for the young formation in front of the distresse in century XXI. The metodology been used was the study case of character of quantity and quality with differents tecniques of colect by date: documental analysis of the educational solution project for high school, bibliographic search interview wich managers, teachers and students of school in pursuit to realize the dynamics constitutive process involving a dialogur by research with the reality studed. This study was developed with reflexions by theorics like, Zabala (1998), Britto et al (2013) and Delors (2012) wich appoach themes like the formation of the citizen for the century XXI and Saviani (2010) and Neves (2005) wich attend the educations and politics for high school. The results of this search point for the expansion of project for others school managers by the state, there is a necessity of formation about new manager and approach of formation teachers. By the difficulty of the search project implementation. The results also reveals other questions like they necessity of a afetive aprocimation at the school with parents. The importance of this project integration is the action that will promote this aprocimation. The formation of the managers teachers and the school integration with the parents consolidate on the propose plan of actions, sugested in this search

La gestion des ports par une entite publique : aspects européens et environnementaux / The management of harbours by a public entity : European and environmental aspects

Autrefois abris pour les navires en perdition, les ports sont devenus de véritables places portuaires comprenant des zones industrialo-portuaires. Portes ouvertes sur le monde, les ports sont au centre des échanges commerciaux des Etats et constituent un atout non négligeable dans le commerce extérieur de ceux-ci. Les différentes lois et réformes portuaires ont amené le législateur français et les acteurs portuaires à recentrer les missions de chacun au sein de la place portuaire afin que nos ports réussissent le défi de la concurrence imposée par nos voisins du Bénélux notamment, et répondent également aux contraintes environnementales que l'Europe imposent aux ports. En france, les ports ont toujours étaient considérés comme des services publics avec une dualité qui se traduisait par un service administratif pour les missions régaliennes et un service industriel et commercial pour les missions plus commerciales telles que l'outillage. La vision française du service public portuaire apparaît dès lors dépassée et la France doit s'adapter à une harmonisation de la gestion de ses ports aux normes européennes. La réforme de 2008 a transféré l'outillage à des entreprises privées, permettant aux ports de se réorganiser autour de l'aménagement et la gestion. Il convient de considérer le port comme au centre de la chaîne des transports commerciaux et une gestion intégrée de ces derniers apparaît nécessaire, impliquant un développement de nos ports côté terre, avec des dessertes terrestres, fluviales et ferroviaires qui seront une réponse à la concurrence. La multimodalité des ports est un axe de travail que la France doit mettre en place et est en cours de construction, avec une prise en compte de l'environnement au coeur de chaque projet. La France dispose d'une grande façade littorale jusqu'ici peu ou mal exploitée. La politique portuaire commence à devenir une des priorités des dirigeants nationaux et permettra à la France de (re)trouver sa vocation maritime jusqu'ici trop longtemps ignorée. / In the past shelters for ships in iniquity, harbours true port places consisting of industrialo-port zones became. The reform of 2008 transferred tools to private firms, allowing the harbours to reorganize itself around development and management. It is necessary to consider the harbour as in the center of the chain of the commercial transport and an integrated management of these last appears necessary, implicating a development of our harbours side earths up, with of the Earth, fluvial and rail services which will be an answer to competition. The multimodality of harours is a working which France must set up and is under way of building, with a catch in count of environmentin the middle of every plan. France disposes big facede coastal region here not much or badly exploited. Port policy begins becoming one of the preferences of the national leaders and will allow in France of (re)to find itsmaritime vocation which for the time being too much for a long time ignored.
