This Thesis aims to understand the process of the universality of the rural social security system, started with the creation of the special, non-contributive regime, as a social-historic product of the social rights implementation in the rural world. To accomplish this, process were analyzed, as well as the tightness and disputes surrounding the constitution of the social rights in the rural area, mainly related to the contributors. It were examined registries of the happenings in the documentation sources, having in mind that it would not be possible to understand the rights provided on the legislation without the exam of the social struggle for its inscription and effectiveness. Those are made especially between the social agents, institutionalized or not, and the State. To make this research there were defined two methodological procedures, as follow: I) revision of the bibliography available about the thematic, with the aim to determine ways or theoretical approaches that will base the elucidation and dialogs, as well as to set the structure of the field of the theoretical dialog of the Thesis; II) the exam of the historic registries that could express the discussion occurred from 1950 and 1980, identifying the main agents and establishing the relationships between them, related to disputes, continuation and changes in the propositions, as well as the kind of social security drawn along this process. The study is structured in five chapters. The approach is based in the assumption that the social security must be understood as a part of the broad process of building rights in rural areas, that encompasses political disputes between work unions and employer s organizations, that modifies the results of the social security design and its organizational dynamic. The rights are discussed on the first chapter as results of long, tenses and continuous disputes for conceptions and ways of implementation, what implies in selections of agents and demands. On the second chapter are analyzed the dynamics of social protection not regulated by the Rural Worker s Statute. The aim is to understand the scenery and experiences over which are based the demands for social rights in rural areas. It s also an aim of the second chapter the observation of the requisition of implementation for what is covered on the Sugar cane Statute and the process of institution of the Rural Social Service. On the third chapter it is analyzed the flow of law projects that will be the embryo of the legislation promulgate under the title of Rural Worker s Statute. And also, it s discussed the role of the FUNRURAL between 1963 and 1971, what means, during the time that encompasses its creation and regulation. The fourth chapter is related to the discussion of the regulation and implementation of the social security, through the complementary law that creates the PRORURAL. At the end, the fifth chapter discusses the implementation of the special security regimen from the constitutional definition in 1988. The work is finished with considerations about the social process of the constitution of the rural social security and the meaning of its innovative design. / A tem?tica da previd?ncia social rural tem sido amplamente discutida nos dias atuais, especialmente em raz?o do protagonismo econ?mico do(a)s aposentado(a)s e pensionistas no campo que, por meio da institui??o do regime de segurados especiais, colocou em evid?ncia os agricultore(a)s em regime de economia familiar, pescadore(a)s e garimpeiro(a)s artesanais de forma surpreendente a partir dos anos 1990. A presente tese objetiva compreender o processo caracterizado como universaliza??o da previd?ncia rural, ocorrido com a cria??o do regime especial n?o contributivo, como produto s?cio-hist?rico da institui??o dos direitos sociais no mundo rural. Para isso, buscou-se analisar processos, tens?es e disputas em torno da constitui??o dos direitos sociais no campo, em especial os previdenci?rios. Procurou-se examinar os registros de acontecimentos nas fontes documentais, entendendo que n?o se pode compreender os direitos prescritos na legisla??o sem examinar a luta social por sua inscri??o e efetividade. Estas se fazem, sobretudo, na rela??o entre agentes sociais, institucionalizados ou n?o, e o Estado. Para a realiza??o da pesquisa foram definidos dois procedimentos metodol?gicos, a saber: i) revis?o da literatura existente sobre a tem?tica, com o objetivo de delinear caminhos ou aportes te?ricos que sirvam de base para elucida??es e di?logos, bem como de estruturar o campo de di?logo te?rico da tese; ii) exame de registros hist?ricos que pudessem expressar a discuss?o realizada entre os anos 1950 e 1980, procurando identificar os principais agentes e estabelecer rela??es entre eles, em termos de disputas, continuidades e mudan?as nas proposi??es, bem como o tipo de previd?ncia que foi sendo desenhada e consolidada ao longo desse processo. O estudo est? estruturado em cinco cap?tulos. A abordagem tem por esteio a assertiva de que a previd?ncia social rural deve ser entendida como parte de um amplo processo de constru??o social dos direitos no campo, que envolve disputas pol?ticas entre as organiza??es de trabalhadores rurais e de representa??o patronal, com implica??es para a arquitetura da previd?ncia e a sua din?mica de operacionaliza??o. No primeiro cap?tulo os direitos s?o discutidos como produtos de longas, tensas e cont?nuas disputas por concep??es e formas de implementa??o, o que implica a sele??o de agentes e demandas. No segundo cap?tulo empreende-se a an?lise de din?micas de prote??o social n?o reguladas pelo Estatuto do Trabalhador Rural. Busca-se, com isso, compreender o cen?rio e as experi?ncias sobre os quais s?o travadas as lutas por direitos sociais no campo. Tamb?m objeto do segundo cap?tulo ? a observa??o das reivindica??es de implementa??o do previsto no Estatuto da Lavoura Canavieira e o processo de institui??o do Servi?o Social Rural. No terceiro cap?tulo examina-se a tramita??o de projetos de lei que se configurar?o como embri?o da legisla??o promulgada sob o t?tulo de Estatuto do Trabalhador Rural. Al?m disso, discutese o funcionamento do FUNRURAL entre 1963 e 1971, isto ?, no per?odo que compreende a sua cria??o e a regulamenta??o. O quarto cap?tulo destina-se ? discuss?o sobre a regulamenta??o e implementa??o da previd?ncia, atrav?s da Lei Complementar que cria o PRORURAL. Por fim, o cap?tulo cinco discute a institui??o do regime de segurados especiais a partir da defini??o constitucional em 1988. Encerra-se o trabalho tecendo considera??es sobre o processo social de constitui??o da previd?ncia social rural e o significado de seu desenho inovador.

Transfer?ncias governamentais e previd?ncia social rural nas microrregi?es do Rio Grande do Norte, 2010 a 2014

Durante d?cadas esses trabalhadores n?o receberam benef?cios advindos da perda de capacidade laboral, como a Previd?ncia Social, e mesmo as tentativas de inser??o quando n?o surtiam o efeito desejado beneficiavam o trabalhador rural de forma incipiente e parcial. Somente ap?s a Constitui??o Federal de 1988, e com as Leis de Custeio e Benef?cio da Previd?ncia Social (Lei 8.212 e 8.213 de 1991), os benef?cios previdenci?rios puderam ser estendidos de forma mais universalista aos trabalhadores do meio rural. Como consequ?ncia desta "abertura" dos benef?cios previdenci?rios tem-se uma eleva??o nos gastos governamentais com aposentadorias, mas, em contrapartida, o impacto direto na vida dos aposentados foi significativo. A melhoria na qualidade da habita??o, a passagem da condi??o de dependente para provedor dentro do domic?lio, aumento da renda das fam?lias de e com aposentados rurais e a melhoria da capacidade produtiva dos estabelecimentos s?o apenas alguns dos benef?cios. Diante disso, muito se tem estudado sobre o impacto redistributivo das aposentadorias rurais devido a transfer?ncia da renda de regi?es economicamente mais ricas do Brasil pra o Norte e principalmente para o Nordeste, uma vez que essas transfer?ncias tem representado um impacto na economia de pequenos munic?pios, sobretudo dessa regi?o (Nordeste). O estado do Rio Grande do Norte, det?m um dos maiores percentuais de benefici?rios da Previd?ncia Social Rural sobre a popula??o total, quando comparado com outros estados da regi?o Nordeste. Ademais, grande parte dos aposentados desse segmento no estado encontram-se em pequenos munic?pios que n?o ultrapassam vinte mil habitantes. De posse dessas informa??es esse estudo pretende investigar a dimens?o que as aposentadorias rurais representam para as 19 microrregi?es do Rio Grande do Norte entre os anos de 2010 e 2014. Para isso, ser? utilizada uma abordagem quantitativa, comparando dados da Previd?ncia Social Rural, obtidos atrav?s da Lei de Acesso ? Informa??o (12.527/2011), com outros dados secund?rios relativos ?s microrregi?es como o Fundo de Participa??o dos Munic?pios (FPM), Produto Interno Bruto (PIB) e alguns programas sociais e de financiamento como o Programa Bolsa Fam?lia (PBF), o Programa de Aquisi??o de Alimentos (PAA) e o Programa Nacional de Fortalecimento da Agricultura Familiar (PRONAF). / Workers in the Brazilian countryside were historically excluded from various public policies. For decades, these workers did not receive benefits from the loss of work capacity, such as Social Security, and even the attempts to insert such benefits, if not well performed, would only help the rural worker in an incipient and partial way. Only when the Federal Constitution of 1988 was over, and with the Laws of Cost and Benefit of Social Security (Law 8,212 and 8,133 of 1991), social security benefits could be extended in a more universalistic way to rural workers. As a consequence of this "opening" of social security benefits, government spending on pensions increases, but, in addition to that, the direct impact on the lives of retirees was significant. The improvement in the quality of housing, the transition from dependent status to provider within the household, the increasing income of families of and with rural retirees and the improvement on productive capacity of establishments are just some of the benefits. Furthermore, much has been studied about the redistributive impact of rural pensions, transferring income from economically richer regions in Brazil to the North and mainly to the Northeast. As well as the impact that these transfers have on the economy of small towns, especially in this region. The state of Rio Grande do Norte has one of the highest percentages of Rural Social Security beneficiaries over the total population when compared to other states in the Northeast. Therewithal, most of the retirees of this segment in the state, are in small towns that do not exceed twenty thousand inhabitants. With this information, this study intends to investigate the extent to which rural pensions represent for the 19 micro-regions of Rio Grande do Norte between 2010 and 2014. In order to accomplish this, a quantitative approach will be used comparing data from Rural Social Security, obtained through the Law on Access to Information (12,527 / 2011), with other secondary data on micro-regions such as the Municipal Participation Fund (FPM), Gross Domestic Product (GDP) and some social and financing programs such as Bolsa Fam?lia (PBF), the Food Acquisition Program (PAA) and the National Program for Strengthening Family Agriculture (PRONAF).
