The theoretical reference will be elaborated from the following works: History of the Madness in the Classical Age, Discipline and Punish: The Birth of the Prison and Microphysics of the Power. We will consider Foucault's analyzes on the treatment of insanity and governmentality in the constitution of mental health policies. It will be sought to analyze the forms of controls and the various legal technical devices that are used against persons classified as unimputable or semi-imputable. Also, we will present the different professional experiences and ananalysis of the mental health management in the State of Maranhão, based on the public policy proposals in this area, verifying the fragility of the care proposals regarding the quantity and quality of care offered In the substitutive services of mental health proposed by the Law Antimanicomial, as well as, the treatment of the madness in Brazil like process of domestication. We will adopt the bibliographic review as a research method from a descriptive character. Finally, the results obtained and the importance of establishing strategies to promote procedural and administrative speed will be presented for the effectiveness of the needs of the asylum population. / Esta dissertação consiste em uma pesquisa sobre as práticas discursivas e o processo de desinternação de pessoas que entraram em conflito com a lei por efeito de graves sofrimentos psíquicos, tendo por referência e base as obras de Michel Foucault, bem como os seus diversos comentadores. O referencial teórico será elaborado a partir das seguintes obras: História da Loucura na Idade Clássica, Vigiar e Punir e Microfísica do Poder. Serão consideradas as análises de Foucault sobre o tratamento da loucura e a governamentalidade na constituição das políticas de saúde mental. Buscar-se-á analisar as formas de controle e os diversos dispositivos técnicos, jurídicos, judiciais e clínicos que são utilizados às pessoas classificadas como inimputáveis ou semi-imputáveis. E ainda, apresentaremos diversas vivências profissionais e uma análise da gestão da saúde mental no Estado do Maranhão, a partir das proposições de políticas públicas nesta área, verificando a consistência das propostas de atendimento, no que se refere à quantidade e à qualidade dos cuidados oferecidos nos serviços substitutivos de saúde mental propostos pela Lei Antimanicomial, bem como o tratamento da loucura no Brasil como processo de domesticação. Adotaremos a revisão bibliográfica como método de pesquisa a partir de um caráter descritivo. Por fim, serão apresentados os resultados obtidos e a importância do estabelecimento de estratégias de promoção da celeridade processual e administrativa para a eficácia do atendimento às necessidades da população manicomial.
