To this end, the following question was sought: what is the conception of human nature that underlies criminal law? Aiming to insert the law in life, the stories of Joel and Elias were initially presented and then their respective victims, Ana and Luna. In order to establish a bridge between these stories, the law and the theories left by Freud, psychoanalysis was used as theory and method. The conceptions of human nature, law, perversion and psychopathy were thus studied and, in this process, it was possible to find resonances between the cases and Freudian concepts. Furthermore: through an interpretive work, an understanding about the stories was constructed. It was thus understood that, although the laws on rape crimes retain a conception of human nature close to that formulated by Freud, in guiding by the assumption that human beings are aggressive and sexual, they miss important discoveries revealed By psychoanalysis, which relate to the cleavage of the Self, to refusal, to the stability of perversion, and to the peculiarities of the Super-Self. Because of these findings, it was concluded that psychoanalysis has much to contribute to the development of penal practices that are more beneficial to society / Este estudo teve como objetivo analisar, fundamentado na psicanálise de Freud, as leis que tratam dos crimes de estupro presentes no Código Penal, utilizando como ilustração dois processos já arquivados, cujos réus foram condenados por cometerem delitos sexuais. Com este objetivo, procurou-se responder a seguinte indagação: qual é a concepção de natureza humana que subjaz à legislação penal? Visando inserir a lei na vida, foram apresentadas, inicialmente, as histórias de Joel e Elias e de suas respectivas vítimas, Ana e Luna. A fim de estabelecer uma ponte entre estas histórias, a lei e as teorizações deixadas por Freud, empregou-se a psicanálise como teoria e método. Estudaram-se, assim, as concepções de natureza humana, Lei, perversão e psicopatia e, nesse processo, foi possível encontrar ressonâncias entre os casos e os conceitos freudianos. E, mais do que isto: por meio de um trabalho interpretativo, construiu-se um entendimento sobre as histórias. Compreendeu-se, desse modo, que, embora as leis sobre os crimes de estupro guardem uma concepção de natureza humana próxima à formulada por Freud, ao se orientar pelo pressuposto de que os seres humanos são agressivos e sexuais, escapam a elas descobertas importantes reveladas pela psicanálise, as quais se relacionam à clivagem do Eu, à recusa, à estabilidade da perversão e às peculiariaridades do Super-eu. Em razão destas constatações, concluiu-se que a psicanálise tem muito a contribuir para o desenvolvimento de práticas penais mais benéficas para a sociedade
