L’objet de cette étude est de mettre en évidence les traits distinctifs de l’institution que désigne le terme « entrée en vigueur de la loi ». Il s’agit d’un ensemble de règles et de pratiques correspondantes qui permettent aux acteurs du système juridique de déterminer avec précision le moment à compter duquel devient obligatoire toute nouvelle loi. Pour qu’une telle détermination soit possible, le système juridique doit consacrer au moins une règle de droit commun, à savoir une règle qui permet de déterminer, à défaut de disposition contraire, la date d’entrée en vigueur de toute nouvelle loi. La consécration d’une telle règle présuppose l’existence d’un critère qui permet de déterminer avec précision le moment où la procédure d’édiction chaque nouvelle loi est achevée. En droit positif français, ce critère est la promulgation. Pour rendre compte de cette fonction de la promulgation, il importe de distinguer entre deux séries de conditions d’entrée en vigueur : les conditions particulières, dont dépend l’entrée en vigueur des lois d’après les règles du droit positif, et les conditions générales, dont la réunion est nécessaire pour qu’il soit en premier lieu possible de consacrer des règles d’entrée en vigueur. Concernant les conditions particulières, l’étude des règles de droit commun montre que, contrairement à une idée communément admise, la publication n’est pas une condition nécessaire de l’entrée en vigueur des lois. S’agissant des conditions générales, il s’avère que l’institution de l’entrée en vigueur présuppose une conception volontariste de la loi et un haut degré de formalisation de la procédure de son édiction. / This study aims at identifying the distinctive features of what is commonly referred to as “entry into force of statutes”. This term refers to a nexus of rules and practices that enable the agents of a legal system to determine in a precise manner the moment every statute becomes legally binding. For that to be possible, there must be at least one general rule that applies to any statute lacking a commencement clause. The existence of such a rule depends on the presence of a criterion that allows establishing the precise moment every bill becomes an enacted statute. In France, the relevant criterion is the formal act, known as promulgation, by which the Head of State signs a bill into law. In order to fully grasp the function thus performed by the act of promulgation, a distinction must be made between two kinds of conditions that can be said to be necessary for a statute’s entry into force. On the one hand, there are the specific conditions set out by the relevant rules of a legal system. On the other hand, there are some more fundamental conditions that a legal system must necessarily meet in order to provide for a general rule governing the entry into force of its statutes. As regards the conditions set out by the relevant rules of the French legal system, it turns out that, contrary to a commonly held idea, the rules in question do not make prior publication a necessary condition for the entry into force of statutes. As regards the aforementioned necessary conditions, it appears that the relevant rules and practices presuppose a voluntarist conception of law and, subsequently, a high level of formalism in the procedure followed for the enactment of statutes.

Hace ya varios años Gamarra dejó de ser ese lugar comercial que producía tantas ventas a lo largo del año. Debido a la fuerte competencia del mercado y la falta de valor agregado en sus productos, el Cluster Textil se encuentra en una grave crisis. El centro de enseñanza y difusión de la Moda propone espacios para estas nuevas necesidades de la zona. No solo se quiere capacitar a sus empleados para que puedan competir en la industria, si no también se busca dotar a Gamarra de espacios que les permitan difundir sus productos y sobretodo sus marcas.
El partido arquitectónico nació por el análisis del entorno, sus aspectos climáticos, accesibilidad y condiciones ambientales. Se buscó en este que se creen espacios integradores los cuales sirvan de conexión entre Gamarra y el Centro, repotenciando a ambos.
El centro de enseñanza y difusión de la moda busca convertir a Gamarra en el Nuevo centro de la Moda metropolitano mediante la capacitación de sus integrantes y la difusión de sus marcas en espacios adecuados y de calidad. / For many years now, Gamarra has ceased to be the go-to commercial destination, with substantial sales and margins throughout the year. Due to strong market competition and lack of added value in its products, the Textile Cluster is currently in a serious crisis. The Fashion Diffusion and Education Center proposes spaces for the new needs in the area. Not only does it want to train its entrepreneurs, so that they can compete in the industry, but also to provide Gamarra with spaces that allow them to diffuse their products and all their brands.
The architectural concept was born from an analysis of the area, its climatic aspects, accessibility and environmental conditions. The concept aims for the creation of integrated spaces between Gamarra and the Center that serve as a connection and empower both.

Constituição de 1988. A partir da promulgação da
Constituição da República de
1988 a doutrina brasileira vem tentado defender a tese de
que os pactos
internacionais de direitos humanos são incorporados de
forma automática ao
direito interno, bastando para tanto sua ratificação no
plano internacional. Os
mesmo autores defendem, ainda, o status de norma de direito
fundamental destes
pactos uma vez incorporados. Partindo dessas duas
assertivas, a presente
dissertação, rejeita o primeiro postulado para afirmar que
o caráter de norma
constitucional das normas internacionais internalizadas
decorre antes de tudo de
seu conteúdo e não da forma de sua internalização. Do mesmo
modo, pugna o
presente trabalho que a adoção do rito tradicional para a
internalização de tratados
internacionais que versem sobre os direitos humanos não
significa outorgar ao
Executivo uma carta branca para postergar a prática dos
atos necessários para a
sua incorporação. Ao final, defende a possibilidade da
intervenção do Poder
Judiciário para assegurar a proteção dos direitos

por tal omissão. / [en] The relationship between International Human Rights Law and
municipal
law in Brazil has taken a new turn with the adoption of a
new Constitution in
1988. Human Rights lawyers and law teachers support the
idea that the new
Constitutional Charter allow for a monistic approach to the
relationship between
International Human Rights Law and municipal law. The
present dissertation
contends that even in the case of a Human Rights treaty the
Brazilian Constitution
demands an act destined to transform International Law in
domestic law. Contrary
to what these Human Rights advocates and theorists believe,
the dualist theory
allows, not only for the International Human Rights Law to
be adopted in Brazil
as material Constitutional Law, but for its prompt adoption
after the entry in
force of any human rights treaty ratified by Brazil. Also,
this dissertation contends
that in those cases that the delay in transforming
International Law in municipal
law harms individual rights, the Judiciary branch can offer
a quick and effective
response.

Cette thèse s’intéresse à l’utilisation par le 43ème président des États-Unis, George W. Bush, des déclarations de promulgation, ces documents écrits qui permettent au président américain de donner son opinion sur une loi qu’il vient de promulguer et dans lesquels il peut faire part de sa réticence à faire appliquer certaines des dispositions de la loi en question car il les juge potentiellement inconstitutionnelles, et ce quand bien même il a accepté de promulguer la loi en question. Une telle pratique peut sembler contraire à l’esprit même de la Constitution américaine, qui contraint le président à « veiller à la fidèle exécution des lois » qu’il promulgue sans lui laisser la possibilité de sélectionner au sein desdites lois les disposions qu’il souhaite ou ne souhaite pas voir appliquées.A travers un travail de comparaison des déclarations de promulgation de George W. Bush à celles de ses prédécesseurs à la Maison-Blanche et une analyse de la capacité théorique et pratique de cet outil présidentiel à influer sur le processus d’exécution des lois, on se proposera de démontrer que les déclarations de promulgation sont davantage l’outil rhétorique d’une affirmation des pouvoirs de la présidence visant à renforcer cette dernière sur le long terme qu’un levier d’action immédiate permettant à la présidence de mettre la main sur l’exécution des lois. / This thesis focuses on the use of presidential signing statements by the Bush 43 Administration. Presidential signing statements are written documents that allow the President to give his opinion of a bill he signed into law and to say that even though he willingly signed the law, he does not necessarily plan on executing all of its provisions as he believes some of them to be potentially unconstitutional. Such a behavior may seem problematic constitutionally speaking as the American Constitution forces the President to « faithfully execute the laws » without affording him the opportunity to pick and choose the provisions he wants to execute.Through a comparison with the signing statements of previous presidents as well as an analysis of both the theoretical and practical capacity of presidential signing statements to allow the President to control the execution of the laws, this thesis will describe signing statements as tools of the rhetorical presidency that allow the executive to assert and defend its constitutional prerogatives in order to strengthen them in the long run, rather than weapons of the administrative presidency with an immediate effect on the execution of the laws.
