Postavení a působnost vrchního státního zastupitelství v českém trestním řízení / Position and competence of High Public Prosecutor's office in Czech criminal proceedings

The main purpose of this Diploma thesis is to determine the posititon of High Public Prosecutor's office within the Public Prosecutor's office system, especially considering its many times proposed abolition. The thesis deals with historical development of Public Prosecution in the Czech lands that should determine if High Public Prosecutor's office is considered as new institute or if it was part of the system for a long time. The thesis also deals with constitutional regulation of Public Prosecution and statutory regulation of High Public Prosecutor's office in Act on Public Prosecution's office, Code of Criminal Procedure and in regulation no. 283/1993, on Rules of Procedure of Public Prosecutor's office. The thesis also mentions Agreement on the selection and career advancement of Public Prosecutors closed between Chief Public Prosecutors and Ministry of Justice and several General Instructions of the Prosecutors General that specify statutory regulation of High Public Prosecutor's office. Development of the Prosecutor's Office in Trutnov district in years 1949 - 1993 Abstract Presented work deals with origin, development and activity of District Prosecutor's Office in Trutnov in years 1949 - 1993. Time frame of this work is defined by the beginning of the year 1949, when District Prosecutor's Offices were originated as whole new type of public prosecutor's offices, and by the end of the year 1993, when whole new legal regulation of public prosecutor's offices was accepted, which no longer had roots in communist Czechoslovakia. Governmental justification for capital punishment in Japan : case study of the de facto moratorium period from 1989 to 1993

Whilst studies on capital punishment in Japan have been conducted by various scholars from various perspectives, empirical research on the de facto moratorium period is largely unavailable. This thesis aims to investigate how consistently the Japanese government justified capital punishment during the execution-free period from 1989 to 1993. Its primary goal is to throw light on the elite-driven nature of the capital punishment system where important decisions are made within the closed institutional dynamic, often irrespective of domestic or international factors. It will also highlight that capital punishment policy has been dealt with by the Japanese government as an issue of law and order, which does not necessarily invite criticism from human rights perspectives. The thesis then proceeds to empirically examine the governmental discourse on capital punishment from 1980 to 2002. It will contend that investigations from an appropriate approach can make clear the elite-driven nature of capital punishment policy in Japan. Finally, it will suggest implications for the international and domestic anti-death-penalty advocates regarding their campaigns over Japan, and reflect on how this thesis can help tackle future research.

Sabendo que existe na sociedade brasileira instrumentos de controle social como os Conselhos Municipais ligados a educação que têm o poder de acompanhamento, proposição e atuação frente a administração pública e figura como o Ministério Público que é um órgão autônomo, independente e defensor da ordem jurídica e de direitos difusos e coletivos, este estudo tem a intenção de compreender e analisar de que forma o Ministério Público, os Conselhos de Acompanhamento e Controle Social do FUNDEB e os Conselhos Municipais de Educação vêm atuando em relação aos Programas Bolsa Creche, Programa Municipal de Educação Básica (PROEB) e Pró-Creche e suas diferentes problemáticas nos cinco municípios do interior do estado de São Paulo indicados em pesquisa anterior. Para isso, utiliza-se a abordagem qualitativa e instrumentos de coleta de dados como entrevista, pesquisa documental e levantamento bibliográfico. Os resultados do estudo demonstram que os Conselhos Municipais de Educação e os Conselhos de Acompanhamento e Controle Social do FUNDEB estão distantes das discussões envolvendo os programas de privatização da educação infantil municipal, sendo que somente uma gestão de um conselho posicionou-se e realizou ações em relação ao Programa municipal. Já no âmbito do Ministério Público vê-se que questões envolvendo os programas de subvenção as instituições privadas de educação infantil foram alvo de inquéritos civis e um Termo de Ajustamento de Conduta que tinha como objetivo a adequação dos serviços prestados pelas instituições contratadas e a absorção de tais matrículas pela rede municipal. / Privatization programs to offer children's education from public grants to private profit institutions were identified in five municipalities in Sao Paulo state until 2009 - Araras, Limeira, Sumare, Hortolandia and Piracicaba - by the research "Municipal strategies for the provision of early childhood education: an analysis of public-private partnerships in the State of Sao Paulo"(ADRIÃO et al., 2009). Publications of the Group of Studies for Research in Educational Policy - GREPPE, indicates that such modality of program compliance to children's education presents caveats regarding the offering conditions and the Brazilian legal perspective. Knowing that in Brazilian society exists instruments for social control such as Municipal Councils related to education which have the ability to follow up, propose and act towards the public administration and figures as the Public Prosecutor's Office, which is an autonomous, independent and legal defender of diffuse and collective rights, this study aims to identify and analyze the standings and performance of such institutions in the five municipalities that develop these programs. For this purpose, qualitative approach and data collection instruments such as personal interview, documentary research and bibliographic survey were used. From the survey and analysis of the data collected, it is noticed that the Municipal Councils of Education and the FUNDEB Monitoring and Social Control Councils are distant from the discussions involving the privatization programs of municipal early childhood education, being that only a single council administration took action regarding the municipal program. In the scope of the Public Prosecutor's Office, it is noticed that issues involving the granting programs of private childcare institutions were the subject of four civil investigations and a Conduct’s Term of Adjustment which had the objective of ensure the compliance of the services provided by the contracted institutions and the acceptance of such enrollments by the municipal network.

This diploma thesis deals with the topic of the competence and organization of the prosecutor's office in criminal proceedings, namely in the Czech Republic and in the Federal Republic of Germany. The institute of the Public Prosecutor's Office is a very important part of the functioning justice system, especially for the protection of justice and society from crime. The given topic can be perceived as very broad, and therefore this work is focused primarily on the comparison of the legislation in selected areas, where the differences that the legislation in question shows. In the legal systems of both states, it is possible to find a number of differences, but also similarities. The thesis is divided into seven logically arranged parts, each of which deals with a specific area of the topic in both comparative states. The first part is devoted to historical development in both states. The second part deals with the current legal regulation of the public prosecutor's office in terms of constitutional and legal anchoring, which is very different in the states. The Diploma thesis deals with problems of Public Prosecution with a focus on Public Prosecution in the Czech Republic. The main purpose of this thesis is to provide information about current condition of Public Prosecution and perform analysis of selected problems. The thesis is divided in to three chapters. The first chapter briefly introduces historical development of bodies of Public Prosecution. The second chapter is devoted to Public Prosecution in the Czech Republic, its legislation, organization, position and role. Knowledge of functioning of Public Prosecution is a necessary prerequisite for understanding the problems that are analyzed in this thesis. The conclusion of the chapter contains a comparative comparison with Public Prosecution in Poland, Finland, Italy and Slovenia. European Public Prosecutor's Office, abstract The European Public Prosecutor's Office (EPPO) has been so far the most ambitious project in the field of Europeanization of criminal law. Criminal law has traditionally been an area where the member states of the European Union are strictly guarding their sovereignty and they are very reluctant when it comes to its harmonization or perhaps unification. This is also the reason why it is important to closely focus on this newly created institution. This is the very first time the EU member states established a body with a competence to investigate and prosecute crimes across countries regardless of national borders. According to the adopted legal framework, the European Chief Prosecutor located in Luxembourg is to focus primarily on crimes affecting the EU's financial interests. The EPPO is to investigate and prosecute these crimes and to represent public prosecution before national courts. The greatest added value of the EPPO should be its independence from national public prosecutor's offices in member states. Independence, expertise, and a cross-border competence should save dozens to hundreds of billions of Euros to the EU's - and nationals - budgets. As an institution of this nature, the Prosecutor's Office will be highlighted in the research from a resolutive erspective of its attributions, in order to investigate whether it is possible to act as a promoter and coordinator of the public sphere in arenas constituted by the institution itself or by others that have, in their functions, the task of defending social interests. The assumption of this work is based on the overcoming of the consciousness paradigm by the language paradigm and it has the communicative action like the tool to reach satisfactory levels of effectiveness of popular participation. The theoretical reference of the work is the Jürgen Habermas’ perception about deliberative democracy, especially based on the theory of communicative action. The research will be part bibliographical, which will be added to a field research to evaluate cuts of some projects of the Prosecutor's Office of Maranhão. First of all, aspects of the constitution of the contemporary and intersubjective public sphere will be approached in which actors that make up a material political representation of society and its interest groups interact between themselves, giving importance to the role of local associativism, new social movements and their networks inside of the process of formation and improvement of public policies of social interests. The text will deal with the phenomenon of popular participation in the face of philosophical paradigms and emphasize the necessary attention with the modalities of speech acts that hatch in the public sphere, so that the results of communicative action are not misrepresented, in order to ensure that collective deliberations in the public spaces of discussion obey the criteria of a democratic proceduralism that intend itself adequated according the Habermas' theory. Establishing the bases for the affirmation of deliberative democracy based on communicative action, reasons will be exposed to believe that the Prosecutor's Office, as an institution dedicated to defending social interests and holding horizontal accountability power, can exercise an important role in mediation between interests of civil society and the administrative system, including the creation of a forum within its institutional functions where the bases of communicative action can be guaranteed and coordinated by its members. The text will also address a way of assessing the effectiveness of the influence and normativity of popular participation before the political system in the cycle of public policy formation. An ideal conformation of the relationship between society and the system will be suggested, so that to guarantee administrative responsiveness between what the former wishes and what the latter offers as social welfare. Some stabilization factors of this ideal conformation will be suggested, which can be activated by the Prosecutor’s Office service. In this sense, the work will make a content analysis in two project cutbacks supported by the Prosecutor’s Office of the State of Maranhão to demonstrate how these stabilizing factors should be promoted and what their limits are. This analysis will be carried out from the data collection of the Prosecutor's Office with the purpose of analyzing the processes in which it will be verified if the means used by the Institution have achieved the goals set forth in the constitution of the cutbacks of the respective projects. The bibliographical research on the theoretical reference of the work and the documentary analysis of data collected at the Prosecutor’s Office of the State of Maranhão will be used as techniques. / Este trabalho pretende investigar a possibilidade de instituições com incumbência de defesa de interesses sociais exercerem um papel mediador entre sistema político e sociedade civil no ciclo de formação ou aperfeiçoamento de políticas públicas. Enquanto instituição com essa natureza, o Ministério Público foi destacado na pesquisa a partir de uma perspectiva resolutiva de suas atribuições, para se investigar se é possível a sua atuação como fomentador e coordenador da esfera pública em arenas constituídas pela própria instituição ou por outras que ostentem em suas funções a incumbência de defesa de interesses sociais. O pressuposto deste trabalho assentou-se na superação do paradigma da consciência pelo paradigma da linguagem e teve na ação comunicativa a ferramenta para se alcançarem níveis satisfatórios de efetividade de participação popular. O referencial teórico do trabalho foi a percepção de Jürgen Habermas acerca da democracia deliberativa, notadamente à luz da teoria da ação comunicativa. A pesquisa foi bibliográfica em parte, que se somou a uma pesquisa de campo para avaliar recortes de dois projetos do Ministério Público do Maranhão. Inicialmente, foram abordados aspectos da constituição da esfera pública contemporânea e intersubjetiva em que interagem atores que compõem uma representatividade política material da sociedade e de seus grupos de interesse, dando-se relevância ao papel do associativismo local, dos novos movimentos sociais e de suas redes no processo de formação e aperfeiçoamento de políticas públicas de interesses sociais. A dissertação tratou do fenômeno da participação popular diante dos paradigmas filosóficos e ressaltou a necessária atenção com as modalidades dos atos de fala que eclodem na esfera pública, a fim de que os resultados da ação comunicativa não sejam deturpados, de forma a garantir que as deliberações coletivas nos espaços públicos de discussão obedeçam a critérios de um procedimentalismo democrático que se pretenda adequado à luz da teoria de Habermas. Estabelecidas as bases para a afirmação da democracia deliberativa à luz do agir comunicativo, foram expostas razões para se acreditar que o Ministério Público, como instituição vocacionada à defesa de interesses sociais e detentora de poder de accountability horizontal, pode exercer importante papel na mediação entre os interesses da sociedade civil e do sistema administrativo, inclusive admitindo-se a criação de um fórum no âmbito das suas funções institucionais em que as bases da ação comunicativa possam ser garantidas e coordenadas por seus membros. A dissertação abordou, ainda, uma forma de aquilatar a efetividade da influência e normatividade da participação popular diante do sistema político no ciclo de formação de políticas públicas. Foi apresentada uma conformação ideal da relação entre sociedade e sistema para que se garanta responsividade administrativa entre o que a primeira deseja e o que o segundo oferece a título de bem-estar social. Apresentaram-se também alguns fatores de estabilização dessa conformação ideal, que podem ser ativados pelo Ministério Público. Nesse sentido, o trabalho fez uma análise de conteúdo em recortes de dois projetos sustentados pelo Ministério Público do Estado do Maranhão para demonstrar como devem ser promovidos esses fatores estabilizadores e quais os seus limites. Essa análise foi realizada a partir do levantamento de dados do Ministério Público com o objetivo de fazer uma análise de processos em que se verificou se os meios utilizados pela instituição atenderam aos fins propalados na constituição dos recortes dos respectivos projetos. Foram utilizadas como técnicas, a pesquisa bibliográfica sobre o referencial teórico do trabalho e a análise documental de dados colhidos no Ministério Público do Estado do Maranhão.
