Postavení a působnost vrchního státního zastupitelství v českém trestním řízení / Position and competence of High Public Prosecutor's office in Czech criminal proceedings

The main purpose of this Diploma thesis is to determine the posititon of High Public Prosecutor's office within the Public Prosecutor's office system, especially considering its many times proposed abolition. The thesis deals with historical development of Public Prosecution in the Czech lands that should determine if High Public Prosecutor's office is considered as new institute or if it was part of the system for a long time. The thesis also deals with constitutional regulation of Public Prosecution and statutory regulation of High Public Prosecutor's office in Act on Public Prosecution's office, Code of Criminal Procedure and in regulation no. 283/1993, on Rules of Procedure of Public Prosecutor's office. The thesis also mentions Agreement on the selection and career advancement of Public Prosecutors closed between Chief Public Prosecutors and Ministry of Justice and several General Instructions of the Prosecutors General that specify statutory regulation of High Public Prosecutor's office. Governmental justification for capital punishment in Japan : case study of the de facto moratorium period from 1989 to 1993

Whilst studies on capital punishment in Japan have been conducted by various scholars from various perspectives, empirical research on the de facto moratorium period is largely unavailable. This thesis aims to investigate how consistently the Japanese government justified capital punishment during the execution-free period from 1989 to 1993. Its primary goal is to throw light on the elite-driven nature of the capital punishment system where important decisions are made within the closed institutional dynamic, often irrespective of domestic or international factors. It will also highlight that capital punishment policy has been dealt with by the Japanese government as an issue of law and order, which does not necessarily invite criticism from human rights perspectives. The thesis then proceeds to empirically examine the governmental discourse on capital punishment from 1980 to 2002. It will contend that investigations from an appropriate approach can make clear the elite-driven nature of capital punishment policy in Japan. Finally, it will suggest implications for the international and domestic anti-death-penalty advocates regarding their campaigns over Japan, and reflect on how this thesis can help tackle future research.

Sabendo que existe na sociedade brasileira instrumentos de controle social como os Conselhos Municipais ligados a educação que têm o poder de acompanhamento, proposição e atuação frente a administração pública e figura como o Ministério Público que é um órgão autônomo, independente e defensor da ordem jurídica e de direitos difusos e coletivos, este estudo tem a intenção de compreender e analisar de que forma o Ministério Público, os Conselhos de Acompanhamento e Controle Social do FUNDEB e os Conselhos Municipais de Educação vêm atuando em relação aos Programas Bolsa Creche, Programa Municipal de Educação Básica (PROEB) e Pró-Creche e suas diferentes problemáticas nos cinco municípios do interior do estado de São Paulo indicados em pesquisa anterior. Para isso, utiliza-se a abordagem qualitativa e instrumentos de coleta de dados como entrevista, pesquisa documental e levantamento bibliográfico. Os resultados do estudo demonstram que os Conselhos Municipais de Educação e os Conselhos de Acompanhamento e Controle Social do FUNDEB estão distantes das discussões envolvendo os programas de privatização da educação infantil municipal, sendo que somente uma gestão de um conselho posicionou-se e realizou ações em relação ao Programa municipal. Já no âmbito do Ministério Público vê-se que questões envolvendo os programas de subvenção as instituições privadas de educação infantil foram alvo de inquéritos civis e um Termo de Ajustamento de Conduta que tinha como objetivo a adequação dos serviços prestados pelas instituições contratadas e a absorção de tais matrículas pela rede municipal. / Privatization programs to offer children's education from public grants to private profit institutions were identified in five municipalities in Sao Paulo state until 2009 - Araras, Limeira, Sumare, Hortolandia and Piracicaba - by the research "Municipal strategies for the provision of early childhood education: an analysis of public-private partnerships in the State of Sao Paulo"(ADRIÃO et al., 2009). Publications of the Group of Studies for Research in Educational Policy - GREPPE, indicates that such modality of program compliance to children's education presents caveats regarding the offering conditions and the Brazilian legal perspective. Knowing that in Brazilian society exists instruments for social control such as Municipal Councils related to education which have the ability to follow up, propose and act towards the public administration and figures as the Public Prosecutor's Office, which is an autonomous, independent and legal defender of diffuse and collective rights, this study aims to identify and analyze the standings and performance of such institutions in the five municipalities that develop these programs. For this purpose, qualitative approach and data collection instruments such as personal interview, documentary research and bibliographic survey were used. From the survey and analysis of the data collected, it is noticed that the Municipal Councils of Education and the FUNDEB Monitoring and Social Control Councils are distant from the discussions involving the privatization programs of municipal early childhood education, being that only a single council administration took action regarding the municipal program. In the scope of the Public Prosecutor's Office, it is noticed that issues involving the granting programs of private childcare institutions were the subject of four civil investigations and a Conduct’s Term of Adjustment which had the objective of ensure the compliance of the services provided by the contracted institutions and the acceptance of such enrollments by the municipal network.

This diploma thesis deals with the topic of the competence and organization of the prosecutor's office in criminal proceedings, namely in the Czech Republic and in the Federal Republic of Germany. The institute of the Public Prosecutor's Office is a very important part of the functioning justice system, especially for the protection of justice and society from crime. The given topic can be perceived as very broad, and therefore this work is focused primarily on the comparison of the legislation in selected areas, where the differences that the legislation in question shows. In the legal systems of both states, it is possible to find a number of differences, but also similarities. The thesis is divided into seven logically arranged parts, each of which deals with a specific area of the topic in both comparative states. The first part is devoted to historical development in both states. The second part deals with the current legal regulation of the public prosecutor's office in terms of constitutional and legal anchoring, which is very different in the states. The Diploma thesis deals with problems of Public Prosecution with a focus on Public Prosecution in the Czech Republic. The main purpose of this thesis is to provide information about current condition of Public Prosecution and perform analysis of selected problems. The thesis is divided in to three chapters. The first chapter briefly introduces historical development of bodies of Public Prosecution. The second chapter is devoted to Public Prosecution in the Czech Republic, its legislation, organization, position and role. Knowledge of functioning of Public Prosecution is a necessary prerequisite for understanding the problems that are analyzed in this thesis. The conclusion of the chapter contains a comparative comparison with Public Prosecution in Poland, Finland, Italy and Slovenia. European Public Prosecutor's Office, abstract The European Public Prosecutor's Office (EPPO) has been so far the most ambitious project in the field of Europeanization of criminal law. Criminal law has traditionally been an area where the member states of the European Union are strictly guarding their sovereignty and they are very reluctant when it comes to its harmonization or perhaps unification. This is also the reason why it is important to closely focus on this newly created institution. This is the very first time the EU member states established a body with a competence to investigate and prosecute crimes across countries regardless of national borders. According to the adopted legal framework, the European Chief Prosecutor located in Luxembourg is to focus primarily on crimes affecting the EU's financial interests. The EPPO is to investigate and prosecute these crimes and to represent public prosecution before national courts. The greatest added value of the EPPO should be its independence from national public prosecutor's offices in member states. This dissertation is divided into a general part (chapters 1 through 6) and a specific part (chapter 7). The general part contains chapters devoted to the historical development of public prosecution and the office of the public prosecutor with an emphasis on developments in civil proceedings, primarily after 1989. Further attention is dedicated to a current expert discussion of the constitutional position of the office of the public prosecutor within the system of state power. Explanations are also given for the independence and impartiality of the office of the public prosecutor in a qualitative comparison with the independence and impartiality of the courts. The following part of the dissertation focuses on a description of the framework of the office of the public prosecutor, including the new institution of the Institute of the European Public Prosecutor. The subsequent chapter is concerned with the organisation and staffing of the non-criminal division of the public prosecutor's office on all levels. Novos atores de políticas públicas : a atuação do Tribunal de Contas e do Ministério Público do Rio Grande do Sul na ampliação da oferta de vagas na educação infantil

Com base em instrumentos qualitativos de pesquisa, essa dissertação versa sobre o papel desempenhado pelo Ministério Público e pelo Tribunal de Contas do estado do Rio Grande do Sul no monitoramento da implementação da política nacional de educação infantil traduzida pela meta um, do Plano Nacional de Educação editado em 2014. A proposta da pesquisa foi compreender como atuam essas instituições, que modificações elas sofreram em suas estruturas internas para tal finalidade, e como os seus agentes percebem a política em questão e a sua atuação, além de contrapor esses dados à percepção que os gestores municipais, envolvidos na operacionalização da política em nível local, têm dessa atuação. Para tanto, foram consultados e examinados (por meio de análise de conteúdo) documentos consistentes na legislação sobre educação infantil, assim como portarias, provimentos, convênios, relatórios e circulares informativas elaborados por ambas as instituições. Foram também realizadas entrevistas semiestruturadas com os dois auditores do Tribunal de Contas que atuam na educação infantil, no Setor de Apoio e Supervisão Municipal; com quatro, do total de oito, Promotores Regionais, e com quatro Secretários Municipais de Educação. Examinando-se publicações sobre o Ministério Público e os Tribunais de Contas, a expansão das dimensões do controle das políticas públicas realizado por esses órgãos e o debate sobre judicialização da política, e os confrontando com os dados colhidos no trabalho de campo, constatouse a necessidade de se utilizar outro viés teórico que não fique restrito às categorias de controle/accountability ou judicialização, já que esses órgãos têm desempenhado papel de atores de implementação de políticas públicas formuladas em nível federal, como se pôde perceber no caso de dois dos municípios abordados (Passo Fundo e Caxias do Sul). No caso de Passo Fundo, pode-se citar iniciativa que envolve MP/RS e SMED no sentido da elaboração de uma norma para fixar critérios técnicos mínimos para a autorização do transporte escolar de alunos da educação infantil, na faixa etária entre quatro e cinco anos de idade; e no caso de Caxias do Sul, em razão da existência de ação coletiva cujo objetivo é o aumento de oferta de vagas, a política municipal foi consideravelmente alterada. / Based on qualitative research instruments, this dissertation is about the role played by both Ministério Público and Tribunal de Contas of Rio Grande do Sul when monitoring the implementation of the national education policy brought by “meta um” of the National Education Plan, published in 2014. The proposal of the research was to understand how these institutions work, what kind of institutional changes have been made in their internal structures for such purpose, and how their agents perceive the policy in question. In addition, the perception that the municipal managers, involved in the operationalization of the implementation of the policy in local level, have of the role these institutions play was also taken into account. The research involved the analysis documents consistent in legislation on child education, as well as ordinances, provisions, agreements, information and others, edited both institutions. We also interviewed the two auditors of the Tribunal de Contas, who work in children's education, in the Support and Supervision Sector; four, of the total of eight, Regional Justice Promoters, and four Municipal Secretaries of Education. Examining publications on the Public Prosecutor's Office and the Audit Courts, the expansion of the dimensions of the control of public policies carried out by these bodies, and the debate on the judicialization of the policy, and comparing them with the data collected in the field work, it was verified the need to use another theoretical bias that is not restricted to the categories of control / accountability or judicialization, since these bodies have played the role of actors of implementation of public policies formulated at federal level, as we could notice in two of the municipalities studied (Passo Fundo and Caxias do Sul). In the case of Passo Fundo, we can mention the initiative involving MP/RS and the Municipal Education Secretary consisting in the elaboration of the normative to allow transportation of pre-school pupils in the age group between four and five years, and in the case of Caxias do Sul, because of the existence of a collective action whose objective is to increase the supply of educational vacancies, the municipal policy was considerably altered.
