Thank you. / Schools and school officials are not immune from the substantial increase in litigation that has occurred over the past few decades in the United States. Public school administrators need to understand the laws that affect their daily decisions and actions. However, most of the available resources on the law are designed for attorneys and other legal experts. The objective of this project is to create a single text for Massachusetts public school administrators that addresses the major legal issues, las and court rulings that apply to their daily decisions and actions. This publication is not designed for attorneys. It is intended to be reader-friendly, and therefore the legal jargon is kept to a minimum. Please note that this text is for informational purposes only and is not intended as legal advice. If you are in need of legal advice, you should contact an attorney. The process for determining the appropriate content for this publication involved initial research on the primary legal issues facing public school administrators, and also interviewing several Massachusetts public school administrators for their input. (A description of the study and the findings is in Appendix A.) Once the subject matters were determined, extensive legal research and analysis were conducted to find appropriate court decisions, statutes, administrative regulations, arbitration rulings and articles relevant to the selected subject areas. When this was done, the dissertation was written covering the following topics: public school administrators' need to understand tre law; an overview of the legal system; issues related to teachers, such as hiring, firing and suspensions; issues related to students, such as student discipline, suspensions and expulsions, and special education; students' constitutional rights; other important matters for school administrators, such as the requirements for reporting abuse, student records and individual liability; and worthwhile resources including contact information. This publication is intended to be a valuable resource for Massachusetts public school administrators. They will obtain an understanding of the relevant laws, and this knowledge will enable them to be more effective administrators and more comfortable in addressing the numerous issues they face on a daily basis. / 2031-01-02

During the fast few years revenue for the support and maintenance of public schools in Utah has become a subject of increasing concern and discussion. Considerable effort has been made on the state level in an attempt to equalize the financial programs among the school districts in the state. Much of this effort has placed its emphasis upon property tax as the major source of school revenue, both on the local level and the state level. Inflationary trends in the national economy have added to the aggravation of this problem. It has become increasingly necessary to seek additional revenue in order to operate the public schools at a satisfactory level. This load has mainly been carried by the property tax.

Virginia Principals and School Law

This study sought to determine Virginia Public School principals' knowledge of school law as it related to the type, length/quantity, and recency of law preparation they received. Other variables measured included how their level of knowledge was associated with their length of administrative experience and with their description of the school community in which they worked.An on-line survey instrument was designed to collect demographic and professional information and to test knowledge of court cases and federal and state statutes. Three hundred and twelve principals completed the survey, representing all grade levels and all regions in the State of Virginia. The principals' knowledge of school law was measured by a forty item true-false test that addressed four key areas of school law selected by a panel of experts: student issues, teacher/administrator issues, tort liability, and church/state relations.The data were analyzed using analysis of variance and post hoc tests. The findings of this study indicated a significant difference of the means, ά =.05, between the principals' knowledge of school law in the category of tort liability and the recency of legal preparation. Principals who received their legal preparation over 10 years ago scored significantly lower on the tort section of the test than those who received their legal preparation only 5-10 years ago. Findings also indicated that principals across all categories of school law displayed only a fair knowledge of school law, earning a mean score of 29.359 out of 40 or 73.3%. The principals' weakest area of school law was in the category of church/state relations. These findings would provide valuable information for the design of principal preparation programs. They would also encourage state educational policymakers and local school divisions to strengthen the professional development of principals on legal matters. / Ed. D.

An assessment of the attitudes of selected respondents toward the standards of quality for public education in Virginia

The purpose of this study was to determine the attitudes of local school board members, division superintendents, local elected officials, state department of education personnel, and state legislators towards the approach taken to improve the public schools in Virginia by the enactment of state mandated standards of quality. A questionnaire was developed and mailed to all division superintendents in Virginia, all the members of the General Assembly, those state department of education personnel responsible for the standards of quality, and random samples of school board members and local elected officials. The questionnaire was designed to determine the respondents' attitudes on the improvement effected by the implementation of the standards of quality, the loss of local control involved, and the attendant increases in local expenditures. Respondents who perceived an improvement were asked if they believed the improvements were worth the costs involved. / Ed. D.
