International electricity industry has encountered many external changes in recently years, like the surge of electricity liberation. Moreover, the issue of energy and green-environment has been a global concern. When facing changes, organizations often adjust their strategies to deal with them. And a good performance evaluation system is a bridge that links the strategy and operation in this process. Performance management is an indispensable part of long-term development strategy. It can not only transfer executive¡¦s vision into strategy and action plans but also lead the organization to its initial objectives. This research takes into account the differences of nature and operating environment between electricity industry and private corporations and wants to discuss the performance evaluation system and indicators of electricity in changing environment. After considering the relevant literatures and international practical methods, this research comes up with a performance-evaluation dimension based on industrial value-chain, including manufacturing, supplying, sales and service, and social responsibility. This method takes into account the organization¡¦s mission and vision, and its industrial attribute. Moreover, the consideration of social responsibility is the biggest contribution of this research because it can echo the hiking environmental concern in recent years. In the final simulation result, we can find out that it can, compared with the real grades, reveal the nature of public utility and match the characteristic of stability.

L’expropriation pour cause d’utilité publique est une opération par laquelle l’administration peut contraindre un individu à lui céder sa propriété, dans un but d’utilité publique, moyennant une juste et préalable indemnité. En droit français, la procédure d’expropriation est répartie en deux phases, la phase administrative qui relève des autorités administratives et la phase judiciaire qui relève de la compétence du juge judiciaire. En ce qui concerne la législation iranienne, celle-ci se fonde seulement sur la phase administrative. Ici, les autorités administratives bénéficient d’une grande marge de manœuvre. Par contre, le rôle du juge y est très marginal. Afin d’améliorer le droit iranien, il serait nécessaire de modifier la législation à la fois sur le fond et sur la forme et en particulier de codifier, avec plus de logique et de cohésion des textes dispersés et tout ce qui touche l’expropriation. Par ailleurs, il serait temps de moderniser et de reconnaître les institutions juridiques inconnues du droit iranien qui renforcent la valeur de la propriété privée et qui garantissent l’intérêt public face aux abus de pouvoir. A ce sujet, le droit français pourrait inspirer la législation et la jurisprudence iraniennes. / The expropriation for public utility is a process by which the government can compel a person to give him his property in a public purpose, subject to fair and prior compensation.Under French law, the expropriation procedure is divided into two phases, the administrative phase which falls administrative authorities and the judicial phase within the jurisdiction of the ordinary courts. Regarding the Iranian law, it relies solely on the administrative phase. Here, the administrative authorities enjoy a wide margin of maneuver, but the judge's role is very marginal.To improve the Iranian law, it is necessary to amend the legislation on both the substance and the form and particularly to codify, with more logic and coherence of scattered texts and everything related expropriation. Moreover, it is time to modernize and recognize unknown legal institutions in Iranian law that reinforce the value of private property and guarantee the public interest against the abuse of power. In this regard, the French law could inspire Iranian legislation and law.

A Study of Performance Management of Public Utilities-A Case Study of Taiwan Water Corporation

The performance management of public utilities becomes significant because public utilities provide essential resources and services for people¡¦s daily lives. In this research, we focus on public water utility and take Taiwan Water Corporation as a case study to establish an appropriate performance management system for public utility. We refer to other public water utilities abroad and employ best practice in our case company. Therefore, we demonstrate the performance management of public utilities comprise production-related and finance-related aspects including 6 goals which are production, customer, workplace, environment, cost and profit goal and generalize 18 KPIs to examine the performance of Taiwan Water Corporation. The result suggests that Taiwan Water Corporation underperformed in recent years due to the achievement rates of 18 KPIs decreased gradually; however, its incentive bonus increased inversely. We presume that the current performance management involving goal setting, assessment standards, and reward system of Taiwan Water Corporation exists contradiction and inadequacy. Finally, we can learn from best practice that the performance assessment of public utility should be divided into production-related and finance-related aspects including six goals. Besides, the evaluation of reward system is suggested to connect with company¡¦s vision, mission and goal for causal relationship so that the team priority and individual priority are simultaneous and possess goal congruence.
