Alternative Dispute Resolution was developed as an alternative to the traditional dispute resolution mechanism, litigation, which had become costly, time-consuming, did not give the parties control over the outcome of their disputes and was generally cumbersome. ADR refers to a variety of techniques for resolving disputes without resort to litigation in the courts. The concept behind the introduction of ADR methods was, inter alia, to reduce the delays and costs associated with litigation; to introduce relatively less formal methods of dispute resolution; to introduce consensual problem solving and empower individuals by enabling them to control the outcome of their dispute and develop dispute resolution mechanisms that would preserve personal and business relationships. ADR processes were thus intended to produce better outcomes all round.
From the time ADR appeared on the scene, its usage has gained international recognition with both common law and civil law countries following the trend. Being faced with similar problems associated with litigation, Zambia has followed the trend and adopted some ADR mechanisms. Most commonly used ADR mechanisms in Zambia are mediation/conciliation, arbitration and negotiation. The legal and institutional frameworks for ADR in Zambia are firmly in place. It is thus, not far fetched to predict a successful future for ADR in which it will enjoy the support of the major stakeholders and play a vital role in justice delivery in Zambia.
This thesis has a section on the conceptual framework for ADR and discusses the development of ADR internationally and some processes in use. It examines selected institutions of justice delivery in Zambia with a view to evaluating their operations and contribution to justice delivery in Zambia. It traces the development of institutions of justice delivery in Zambia from colonial times up to the present and assesses their performance. ADR processes currently in use in Zambia are critically examined and their shortcomings reviewed. The legal and institutional frameworks for ADR and the role they play of providing the supporting structure for ADR in the country are evaluated. Future prospects for ADR are indicated and recommendations for successful implementation of ADR in Zambia are given. / Jurisprudence / LL.D.

High-Resolution Seismics Methods Applied to Till Covered Hard Rock EnvironmentsBergman, Björn January 2005 (has links)
Reflection seismic and seismic tomography methods can be used to image the upper kilometer of hard bedrock and the loose unconsolidated sediments covering it. Developments of these two methods and their application, as well as identifying issues concerning their usage, are the main focus of the thesis. Data used for this development were acquired at three different sites in Sweden, in Forsmark 140 km north of Stockholm, in the Oskarshamn area in southern Sweden, and in the northern part of the Siljan Ring impact crater area. The reflection seismic data were acquired with long source-receiver offsets relative to some of the targeted depths to be imaged. In the initial processing standard steps were applied, but the uppermost part of the sections were not always clear. The longer offsets imply that pre-stack migration is necessary in order to image the uppermost bedrock as clearly as possible. Careful choice of filters and velocity functions improve the pre-stack migrated image, allowing better correlation with near-surface geological information. The seismic tomography method has been enhanced to calculate, simultaneously with the velocity inversion, optimal corrections to the picked first break travel times in order to compensate for the delays due to the seismic waves passing through the loose sediments covering the bedrock. The reflection seismic processing used in this thesis has produced high-quality images of the upper kilometers, and in one example from the Forsmark site, the image of the uppermost 250 meters of the bedrock has been improved. The three-dimensional orientation of reflections has been determined at the Oskarshamn site. Correlation with borehole data shows that many of these reflections originate from fracture zones. The developed seismic tomography method produces high-detail velocity models for the site in the Siljan impact area and for the Forsmark site. In Forsmark, detailed estimates of the bedrock topography were calculated with the use of the developed tomography method.

Towards atmospheric characterisation of exoplanetsFrith, James Michael January 2014 (has links)
This thesis provides a multi-pronged approach towards paving the way for future space and ground based exoplanet characterisation e↵orts as well as providing new analysis of the atmosphere of the exoplanet HD 179949 b. This is done, firstly, by outlining engineering trade studies conducted for the attitude and orbit control system (AOCS) and sun shield for the Exoplanet Characterisation Observatory (EChO) spacecraft (a proposed European Space Agency exoplanet space mission). These trade studies were conducted in collaboration with EADS Astrium. A cold gas system with the possibility of a hybrid system which would include the use of reaction wheels is recommend for the design of the AOCS. For the sun shield, a V-groove cone shield is concluded to provide the best thermal coverage while also providing stay light protection as well as being more mechanically symmetric than other options. Simulations are then conducted to determine the number of transiting planets future surveys should expect to find around stars within 50 parsecs of the sun. This is done by taking the known stars within 50 parsecs and adding a simulated planet population based on current models and observations to each star. Assumptions are made regarding observability of a planetary transit and a Monte Carlo simulation run to gain statistics on the number and type of planetary systems that can be expected to be found. The results of the simulation show a mean expected number of 27 detectable transiting planets within 50 parsecs. Next, using the Position and Proper Motion Extended-L (PPMXL) catalogue, optical and near-infrared colour cuts were used together with a reduced proper motion cut to find bright M dwarfs for future exoplanet transit studies. PPMXL’s low proper motion uncertainties allow this work to probe down to smaller proper motions than previous similar studies. Unique objects found with this method were combined with that of previous work to produce 8479 K < 9 M dwarfs. Low-resolution spectroscopy was obtained of a sample of the objects found using this selection method to gain statistics on their spectral type and physical properties. Results show a spectral-type range of K7-M4V. This catalogue is the most complete collection of K < 9 M dwarfs currently available and is made available here. High resolution spectroscopy and model spectra of planetary atmospheres is then used along with a spectral deconvolution technique to attempt to detect the Doppler shifted signal of the non-transiting planet HD 179949 b. The signal was not detected but new upper limits were set ruling out the presence of TiO down to a log10 ✏0 = -4.09 with 99.9 per cent confidence. Simulations conducted by this work imply a loss of sensitivity occurring possibly due to varying telluric interference or instrumental systematics.

Holoscopic 3D image depth estimation and segmentation techniquesAlazawi, Eman January 2015 (has links)
Today’s 3D imaging techniques offer significant benefits over conventional 2D imaging techniques. The presence of natural depth information in the scene affords the observer an overall improved sense of reality and naturalness. A variety of systems attempting to reach this goal have been designed by many independent research groups, such as stereoscopic and auto-stereoscopic systems. Though the images displayed by such systems tend to cause eye strain, fatigue and headaches after prolonged viewing as users are required to focus on the screen plane/accommodation to converge their eyes to a point in space in a different plane/convergence. Holoscopy is a 3D technology that targets overcoming the above limitations of current 3D technology and was recently developed at Brunel University. This work is part W4.1 of the 3D VIVANT project that is funded by the EU under the ICT program and coordinated by Dr. Aman Aggoun at Brunel University, West London, UK. The objective of the work described in this thesis is to develop estimation and segmentation techniques that are capable of estimating precise 3D depth, and are applicable for holoscopic 3D imaging system. Particular emphasis is given to the task of automatic techniques i.e. favours algorithms with broad generalisation abilities, as no constraints are placed on the setting. Algorithms that provide invariance to most appearance based variation of objects in the scene (e.g. viewpoint changes, deformable objects, presence of noise and changes in lighting). Moreover, have the ability to estimate depth information from both types of holoscopic 3D images i.e. Unidirectional and Omni-directional which gives horizontal parallax and full parallax (vertical and horizontal), respectively. The main aim of this research is to develop 3D depth estimation and 3D image segmentation techniques with great precision. In particular, emphasis on automation of thresholding techniques and cues identifications for development of robust algorithms. A method for depth-through-disparity feature analysis has been built based on the existing correlation between the pixels at a one micro-lens pitch which has been exploited to extract the viewpoint images (VPIs). The corresponding displacement among the VPIs has been exploited to estimate the depth information map via setting and extracting reliable sets of local features. ii Feature-based-point and feature-based-edge are two novel automatic thresholding techniques for detecting and extracting features that have been used in this approach. These techniques offer a solution to the problem of setting and extracting reliable features automatically to improve the performance of the depth estimation related to the generalizations, speed and quality. Due to the resolution limitation of the extracted VPIs, obtaining an accurate 3D depth map is challenging. Therefore, sub-pixel shift and integration is a novel interpolation technique that has been used in this approach to generate super-resolution VPIs. By shift and integration of a set of up-sampled low resolution VPIs, the new information contained in each viewpoint is exploited to obtain a super resolution VPI. This produces a high resolution perspective VPI with wide Field Of View (FOV). This means that the holoscopic 3D image system can be converted into a multi-view 3D image pixel format. Both depth accuracy and a fast execution time have been achieved that improved the 3D depth map. For a 3D object to be recognized the related foreground regions and depth information map needs to be identified. Two novel unsupervised segmentation methods that generate interactive depth maps from single viewpoint segmentation were developed. Both techniques offer new improvements over the existing methods due to their simple use and being fully automatic; therefore, producing the 3D depth interactive map without human interaction. The final contribution is a performance evaluation, to provide an equitable measurement for the extent of the success of the proposed techniques for foreground object segmentation, 3D depth interactive map creation and the generation of 2D super-resolution viewpoint techniques. The no-reference image quality assessment metrics and their correlation with the human perception of quality are used with the help of human participants in a subjective manner.

SAMMANFATTNING Vi har valt att undersöka konflikthantering inom organisationer. Syftet med denna studie är att undersöka hur cheferna hanterar konflikter inom organisationen och hur de upplever detta. Vi menar att detta är ett understuderat ämne som av många olika orsaker bör lyftas fram och undersökas närmre. Konflikter kan få stora ekonomiska konsekvenser exempelvis genom minskad arbetsprestation, sjukskrivningar och så vidare. Konflikter kan också få slitsamma konsekvenser känslomässigt och psykiskt. Konflikter är något som i olika grader förekommer dagligen varför ämnet i allra högsta grad är aktuellt. Det är något alla är inblandade i och som de flesta tycker är obehagligt att hamna i, vår uppfattning är att det kan bero på att få vet hur konflikter bör hanteras och varför de uppstår. Något av det mest anmärkningsvärda i våra resultat var hur lågt stöd som fanns för några av cheferna i dessa frågor. De förväntades veta hur de skulle lösa konflikterna helt själva. Detta visar enligt oss på behovet av större kunskap på området. Vi har intervjuat chefer från olika organisationer och utifrån deras upplevelse analyserat hur de agerat i dessa, för att se om vi kan identifiera de konflikthanteringsstrategier de har använt för att lösa konflikten. Vi har också analyserat vilka konsekvenser konflikten fått samt hur cheferna arbetade förebyggande mot att konflikter skulle uppstå. I den teoretiska referensramens första del redogörs för begreppet konflikt samt omkringliggande råden. I den andra delen är de teoretiska inslagen mer specifikt inriktade med områden som; konflikter inom organisationer, identifiering av olika typer av konflikter, konflikthanteringsstrategier, makt samt kommunikation och ledarstilar. I våra resultat har vi sett att chefer fäster stor vikt vid själva kommunikationen mellan sig och medarbetarna men också hur de har fokus på hur deras medarbetare för sina dialoger sinsemellan. Vi har sett att några av våra informanter inledningsvis avvaktar vid konflikter för att sedan ingripa om konflikten fortsätter. Dessa konflikter påverkade både medarbetare och chefers välmående. Vi har också sett att några av konflikterna har fått konsekvenser i form av att inblandade medarbetare inte får lönehöjningar vid löneutvecklingssamtal och att medarbetaren i vissa fall fått byta arbetsuppgifter till andra uppdrag med tydligare ramar för utförandet. Att gå olika vägar för att avsluta anställningen var en av de konflikthanteringsstrategier vi kunde se. Exempel på förebyggande arbete för att motverka uppkomst av konflikter var: rekrytera medarbetare som passade i arbetsgruppen och samtala regelbundet med medarbetarna. A New High-Resolution Electromagnetic Method for Subsurface ImagingFeng, Wanjie January 2016 (has links)
For most electromagnetic (EM) geophysical systems, the contamination of primary fields on secondary fields ultimately limits the capability of the controlled-source EM methods. Null coupling techniques were proposed to solve this problem. However, the small orientation errors in the null coupling systems greatly restrict the applications of these systems. Another problem encountered by most EM systems is the surface interference and geologic noise, which sometimes make the geophysical survey impossible to carry out. In order to solve these problems, the alternating target antenna coupling (ATAC) method was introduced, which greatly removed the influence of the primary field and reduced the surface interference. But this system has limitations on the maximum transmitter moment that can be used. The differential target antenna coupling (DTAC) method was proposed to allow much larger transmitter moments and at the same time maintain the advantages of the ATAC method. In this dissertation, first, the theoretical DTAC calculations were derived mathematically using Born and Wolf's complex magnetic vector. 1D layered and 2D blocked earth models were used to demonstrate that the DTAC method has no responses for 1D and 2D structures. Analytical studies of the plate model influenced by conductive and resistive backgrounds were presented to explain the physical phenomenology behind the DTAC method, which is the magnetic fields of the subsurface targets are required to be frequency dependent. Then, the advantages of the DTAC method, e.g., high-resolution, reducing the geologic noise and insensitive to surface interference, were analyzed using surface and subsurface numerical examples in the EMGIMA software. Next, the theoretical advantages, such as high resolution and insensitive to surface interference, were verified by designing and developing a low-power (moment of 50 Am²) vertical-array DTAC system and testing it on controlled targets and scaled target coils. At last, a high-power (moment of about 6800 Am²) vertical-array DTAC system was designed, developed and tested on controlled buried targets and surface interference to illustrate that the DTAC system was insensitive to surface interference even with a high-power transmitter and having higher resolution by using the large-moment transmitter. From the theoretical and practical analysis and tests, several characteristics of the DTAC method were found: (1) The DTAC method can null out the effect of 1D layered and 2D structures, because magnetic fields are orientation independent which lead to no difference among the null vector directions. This characteristic allows for the measurements of smaller subsurface targets; (2) The DTAC method is insensitive to the orientation errors. It is a robust EM null coupling method. Even large orientation errors do not affect the measured target responses, when a reference frequency and one or more data frequencies are used; (3) The vertical-array DTAC method is effective in reducing the geologic noise and insensitive to the surface interference, e.g., fences, vehicles, power line and buildings; (4) The DTAC method is a high-resolution EM sounding method. It can distinguish the depth and orientation of subsurface targets; (5) The vertical-array DTAC method can be adapted to a variety of rapidly moving survey applications. The transmitter moment can be scaled for effective study of near-surface targets (civil engineering, water resource, and environmental restoration) as well as deep targets (mining and other natural-resource exploration).

Studiens syfte var att undersöka leg. psykoterapeuters uppfattningar om och erfarenheter av att identifiera och reparera rupturer i den terapeutiska relationen (alliansen) i kognitiv beteendeterapi (KBT). Datainsamlingen bestod av narrativa intervjuer. Den kvalitativa metoden fenomenologisk hermeneutik (Lindseth & Norberg, 2004), där intresset riktas mot den levda erfarenheten, användes vid analys och tolkning av texten. Resultatet visade att de terapeutiska färdigheterna medveten närvaro och metakommunikation används för att identifiera, förebygga och reparera rupturer i alliansen. Slutsatsen är att psykoterapeuternas berättelser bär på den dolda innebörden att alla slags terapeutiska interventioner i KBT samtidigt utgör relationella handlingar, och att ett språk för detsamma är önskvärt. Meningsfullhet och yrkesstolthet kan dessutom tillägnas, om uppmärksamheten vänds från misslyckanden till mod att ta ansvar för det terapeutiska förloppet och relationen. / The aim of the study was to investigate psychotherapists perceptions about and experiences of identifying ruptures in the therapeutic alliance in cognitive behavioural therapy (CBT). The data collection consisted of narrative interviews. The qualitative method, a phenomenological hermeneutical method for researching lived experience (Lindseth & Norberg, 2004), was used in the analysis and interpretation of the texts. The result showed that the therapeutic skills awareness and metacommunication was used to identify, prevent and resolve ruptures in the alliance. The conclusion is that psychotherapists stories carries a hidden meaning of any therapeutic interventions in CBT at the same time constitutes relational actions, and a language for the same is desirable. Meaningfulness and professional pride can also be adopted, by shifting attention from failures, into courage to take responsibility for the therapeutic process and the relationship.

It is a joint paper, presenting initial research completed at the University of California, Berkeley, Center for Extreme Ultraviolet (EUV) Astrophysics using telemetry from the EUV EXPLORER (EUVE) satellite and statistical computation analysis completed by Lockheed Martin. This work was used in identifying suspect "failure precursors." Lockheed Martin completed an exploration into the application of statistical pattern recognition methods to identify FPP events observed visually by the human expert. Both visual and statistical methods were successful in detecting suspect failure precursors. An estimate for remaining service life for each unit was made from the time the suspect failure precursor was identified. It was compared with the actual time the equipment remained operable. The long-term objective of this research is to develop a resident software module which can provide information on FPP events automatically, economically, and with high reliability for long-term management of spacecraft, aircraft, and ground equipment. Based on the detection of a Failure Prediction Process event, an estimate of remaining service life for the unit can be calculated and used as a basis to manage the failure.

Conflict resolution theory and practice have been increasingly criticised for ignoring the centrality of culture in their attempts to find theories and models that are applicable universally, not only across cultures but also across levels of society. Mediation is one form of conflict resolution, which has come to occupy a central position in the resolution of disputes both at international and local levels. At the level of family disputes, family mediation has failed to engage users from different ethnic groups in England and Wales. This thesis explores the hypothesis that culture and, in particular, culturally defined concepts of gender are the important factors determining the success or failure of mediation in divorce disputes.
