Composite property rights and boundary-treading resistance: a case study of C county in Eastern Sichuan

1.1\xThis thesis studies land expropriation disputes from the angle of property right, exploring its origins from the relationships between township (town) government and villagers, village collective and villagers, and different villagers, focusing on peasants' resisting low land expropriation compensation instead of their fighting against land expropriation. Specifically, this research will discuss three questions. What is the nature of property right? How had the landed property rights been regulated and adjudicated? How do women gain and loss their land rights and interests?;1.2\xIn terms of the nature of property right, two kinds of idea are widely spread in academic circle; the first follows a materialist-legalist viewpoint and considers property rights as a bundle of rights, whereas the second adopts a constructivist perspective and considers property rights as a network of social relations. With defected land institutions and peasants' complicated social life, both of the two ideas cannot provide a suitable explanation for some new phenomena in land expropriation disputes, leaving a gap between property right theory and practice. Building on the foundation of Zhang Xiaojun's (2007) idea of "multiple property rights" and drawing upon Pierre Bourdieu's discussion of capitals, this research will propose the idea of "composite property rights" to systematize the discussion. This concept examines the transformation of symbolic, social, and cultural capital into economic capital, and in turn the transformation of economic capital into property rights. In so doing, I hope to provide a better framework for understanding the mechanisms through which various capitals can be mobilized to "realize" the landed property rights.;1.3\xSince this research regards composite property rights as the nature of property right, the answer of the second research question then transfers into: what are the characteristics of the practical logic of composite property rights? Basing the rationale of resistance on peasants' local perception of land rights, peasants explore an action strategy, boundary-treading resistance. This concept reveals their tactics on three different relationships. First, as to the relation with the state, the peasants' resistance treads on state laws and land institution by taking advantage of their capitals. Second, in terms of the relation with local government and developers, their strategies rely on probing counterparty's loopholes, treading on boundaries of administrative enforcement of policy. Third, in regard to the relation among villagers or familial relationship, their behaviors challenges the village rules and traditions, treading on the boundaries of traditional moral principles.;1.4\xIn order to use the two concepts, this research specifically analyzes women's striving for land rights and interests. After building a framework of membership, this research transfers the third research question into a specific one: since rural land is owned by rural collective economic organization, how can an individual become its member? In sum, women's tactics include (1) taking full advantage of village collective's self-contradictory decision which admits their huji but refuses their cuji, (2) revoking their previous promise, and (3) exploring the loophole of household register management. During their striving for membership, they utilize their various capitals: (1) they use money as deposit to get villagers meeting's support, or gift to gain cadre's favor, to move in/back their huji, (2) with their relatives' help, they can get information and other support.;1.5\xBy attaching all kinds of capitals to the property right transformation from economic capital to economic property right, peasants' resources can be transformed into capitals; and these capitals enter their citizen life, alleviating their pauperization. At the same time, boundary-treading resistance characterizes land-lost peasants as peasant-citizens who keenly take petty advantage of others and merely try to be smart, so their resistance has a long way to catch up with safeguarding rights of citizen.

Valuation of Mortgage Servicing Rights With Foreclosure Delay and Forbearance Allowed

We develop a bivariate binomial model to price Mortgage Servicing Rights (MSRs). Our model is an improvement over previous MSR pricing models by explicitly incorporating the realistic assumptions that there are additional costs involved in servicing delinquent loans. In addition to the Hilliard et al. mortgage-pricing tree, we extend additional sub-branches to model the borrower's decision of prepayment, cure, and foreclosure after a loan becomes delinquent. We then investigate how the value of the Mortgage Servicing Right varies with interest rate volatility, house price volatility, delinquency options, deficiency judgments, default penalties, forbearance periods, and speed of adjustments factors.

Does Zimbabwe view social security as a right?

This research examines the attitude that Zimbabwe portrays towards the protection, promotion and enforcement of the right to social security. Zimbabwe did not have a Constitution that provided for the realisation of the right to social security before 2013. With the enactment of the 2013 Constitution, many people now have a chance to enjoy economic, social and cultural rights (including social security) which ordinarily was not possible in the past. Provision of the right to social security plays a pivotal role by assuring human dignity for people when they are faced with circumstances such as the deteriorating and unpredictable economic situation in Zimbabwe in recent years. This study uses academic textbooks, journals, legislation, international treaties, newspaper reports and other sources of literature to analyse Zimbabwe’s outlook on social security and examines the structures, policies and institutions put in place to enforce the right to social security. The Constitutional provisions for social security are also analysed in the light of international instruments’ provisions of social security to find out if they are adequate and effective in the protection and promotion of social security in Zimbabwe. The study also examines the national polices; the national commission for human rights and the courts to determine their efficacy in their administration of the right to social security. The Constitution of Zimbabwe states that when provisions of the declaration of rights and any legislation such as the provisions for the right to social security are being interpreted, international law and all treaties and conventions that Zimbabwe is a party to must be taken into consideration. Thus, in this study the application and influence on the enforcement of the right to social security by international law and all the treaties and conventions that Zimbabwe is a party to, are scrutinised. Budgets mirror the government’s values and can be reflective of the attitude that a State has towards a priority. Les métamatériaux sont des matériaux artificiels devenus très attractifs du fait de leurs propriétés électromagnétiques atypiques. Les structures CRLH (Composite Right Left-Handed) à ondes de fuite en particulier, permettent d’effectuer un balayage angulaire très important sur une large bande passante. Toutefois l’état de l’art montre qu’il faudrait un très grand nombre de cellules pour atteindre une efficacité de rayonnement acceptable. Vue la demande récurrente des nouveaux systèmes de transmission d’avoir des antennes de faible encombrement, il serait plus intéressant de trouver de nouvelles architectures d’antennes utilisant ces structures CRLH. L’objectif de la thèse est en premier lieu d’avoir une connaissance approfondie du comportement électromagnétique des structures CRLH. Afin de tirer profit de leurs propriétés électromagnétiques atypiques, de nouvelles architectures d’antennes inspirées des structures CRLH sont proposées. Ces nouvelles antennes permettent de réaliser différents types de diagrammes de rayonnement (large ouverture angulaire, faisceau étroit, double polarisation). Elles sont caractérisées grâce à une modélisation analytique qui aura été validée auparavant par la simulation électromagnétique. / Metamaterials are artificial structures with unusual electromagnetic properties. Composite Right-Left Handed (CRLH) radiating structures are very attractive antennas because of their scanning capability and wideband performances. However crlh lines must contain a large number of cells in order to have sufficient radiation efficiency. Due to the recurring request of having small antennas in new communication systems, new designs based on crlh structures must be found. The first objective of this thesis is to have full knowledge of electromagnetic properties of crlh structures. To take advantages of atypical electromagnetic behavior of CRLH structures, new CRLH based antennas designs are proposed. These new inspired antennas could produce different radiation patterns (with large beamwidth, narrow beam, double polarization). Analytical model, previously validated by electromagnetic simulator, is used to characterize the new proposed antennas.

"Let us build an ark!" : Jonas De Geer and the negotiation of religion within radical nationalism

This thesis illuminates meaning(s) of religion in a Swedish radical nationalist context. The empirical study is based on a critical text analysis of author Jonas De Geer, key ideology producer of Swedish radical nationalism. The research questions concern how the publications of Jonas De Geer, during the period 1996-2016, address issues related to religion and Christian imagery. The primary aim of the thesis – to study how the concept of religion is understood, negotiated and used in a Swedish radical nationalist context – is enunciated through an examination of how identity and antagonists are construed through the notions of religion in the material, and how these concepts change over time. An applied text analysis, informed by critical discourse analysis and corpus linguistics, constitutes the methodological framework of the study. The empirical analysis suggests that Christianity and national identity are construed as intertwined and natural, while Judaism is portrayed as the primary antagonist. Additionally, Islam and modernist ideals are depicted as weapons used by Jewish influence to dominate the West. Drawing on these empirical implications, the study concludes that religion functions as a racist configuration in De Geer's symbolic universe.
