Civil liability for bodily injury in the provision of health services. The purpose of the present thesis is to analyse the issue of civil liability for bodily injury in the provision of health services. This issue is very topical, especially due to the adoption of new private law, which is presented in this work. The new legislation is evaluated and the problems that have occurred or might occur are defined. In addition the legislation of important institutes is compared with previous regulation. The thesis is composed of eight chapters, each of them dealing with different aspects of civil liability. Chapter one defines basic terminology used in the thesis. The next chapter presents the sources of law. Attention is paid to complex relationship between the Civil Code and the Law on Health Services, and also to a new type of contracts established by the Civil Code - agreement on health care. Chapter three mentions the basic relationship of medical law - the relationship between a doctor and a patient, including the reasons for its creation. The transformation from a paternalistic model to a partnership model is also highlighted. Chapters four and five are concerned with civil liability. Notre recherche a pour objet de discuter les stratégies d'alliance entre prestataires de services logistiques (PSL) dans un cluster logistique chinois. Nous nous focalisons sur les impacts des caractéristiques d'un cluster sur le maintien d'une alliance. En utilisant la méthodologie qualitative, nous avons mené les entretiens avec les acteurs dans quatre clusters logistiques de la province de Guangdong qui est la plus développée en Chine. Les résultats de cette thèse nous ont permis d'abord d'avoir un premier panorama des motivations des PSL d'entrer dans un cluster logistique, ainsi également des motivations et des défis d'une stratégie d'alliance entre PSL. Nous mettons en évidence ensuite que la proximité géographique entre PSL favorise le choix de partenaires fiables et compétents et la coordination d'une alliance. De plus, les réseaux sociaux « Guanxi » permettent un contrôle informel des comportements opportunistes et aussi la construction de la confiance dans l'alliance. Enfin, l'attention portée par les pouvoirs publics sur le cluster logistique a un impact positif indirect sur le contrôle informel d'une alliance entre PSL. Nos contributions enrichissent le corps théorique de l'alliance horizontale entre PSL et du cluster logistique, et offrent des arguments pour aider des PSL à choisir d'entrer dans les clusters logistiques et à former des alliances au sein de ces clusters logistiques. En prenant compte les caractéristiques culturelles et politiques de la Chine, nous avons réalisé une recherche exploratoire sur ce sujet qui manque encore dans les études spécialisées. / The present research aims to discuss the strategies of alliance between logistics service providers (LSP) in a Chinese logistics cluster. The study focus on the impact of the characteristics of a cluster on the maintain of an alliance. With the principe of qualitative methodology, we conducted interviews with principal actors in four logistics clusters of Guangdong Province which is the most developed province in China. There are several results of this thesis. First of all, it gives an overview of the motivations of LSP to enter a logistics cluster, also the motivations and challenges of a strategic alliance between LSP. Then the results show that geographical proximity between LSP promotes coordination of an alliance and the choice of reliable and competent partners. In addition, the social networks "Guanxi" could be source of informal control of opportunistic behavior and build confidence. Finally, the attention paid by the government on the logistics cluster has an indirect positive impact on the informal control of an alliance between LSP. As theoretical contributions, this research enrichs the aspect of alliance between LSP and logistics cluster and offers arguments to help LSP choose logistics cluster and form strategies alliances within these logistics clusters. Taking into account the cultural and political characteristics of China, an exploratory research was conducted on this topic which is still lacking in the literature.

Measuring and Improving the Quality of Experience of Adaptive Rate Video

Today's popular over-the-top (OTT) video streaming services such as YouTube, Netflix and Hulu deliver video contents to viewers using adaptive bitrate (ABR) technologies. In ABR streaming, a video player running on a viewer's device adaptively changes bitrates to match given network conditions. However, providing reliable streaming is challenging. First, an ABR player may select an inappropriate bitrate during playback due to the lack of direct knowledge of access networks, frequent user mobility and rapidly changing channel conditions. Second, OTT content is delivered to viewers without any cooperation with Internet service providers (ISPs). Last, there are no appropriate tools that evaluate the performance of ABR streaming along with video quality of experience (QoE). This thesis describes how to improve the video QoE of OTT video streaming services using ABR technologies. Our analysis starts from understanding ABR heuristics. How does ABR streaming work? What factors does an ABR player consider when switching bitrates during a download? Then, we propose our solutions to improve existing ABR streaming from the perspective of network operators who deliver video content through their networks and video service providers who build ABR players running on viewers' devices. From the network operators' point of view, we propose to find a better video content server based on round trip times (RTTs) between an edge node of a wireless network and available video content servers when a viewer requests a video. The edge node can be an Internet Service Provider (ISP) router in a Wi-Fi network and a packet data network gateway (P-GW) in a 4G network. During the experiments, our solution showed better TCP performance (e.g., higher TCP throughput during playback) 146 times out of 200 experiments (73%) over Wi-Fi networks and 162 times out of 200 experiments (81%) over 3G networks. In addition, we claim that the wireless edge nodes can assist an ABR video player in selecting the best available bitrate by controlling the available bandwidth in the radio access network between a base station and a viewer's device. In our Wi-Fi testbed, the proposed solution saved up to 21% of radio bandwidth on mobile devices and enhanced the viewing experience by reducing rebufferings during playback. Last, we assert that software-defined networking (SDN) can improve video QoE by dynamically controlling routing paths of video streaming flows based on the provisioned networking information collected from SDN-enabled networking devices. Using an off-the-shelf SDN platform, we showed that our proposed solution can reduce rebufferings by 50% and provide higher bitrates during a download. From the perspective of video service providers, higher video QoE can be achieved by improving ABR heuristics implemented in an ABR player. To support this idea, we investigated the role of playout buffer size in ABR streaming and its impact on video QoE. Through our video QoE survey, we proved that a large buffer does not always outperform a small buffer, especially under rapidly varying network conditions. Based on this finding, we suggest to dynamically change the maximum buffer size in an ABR player depending on the current capacity of its playout buffer for improving the QoE of viewers. During the experiments, our proposed solution improved the viewing experience by offering 15% higher average played bitrate, 70% fewer bitrate changes and 50% shorter rebuffering duration. Our experimental results show that even small changes of ABR heuristics and new features of network systems can greatly affect video QoE. However, it is still difficult for video service providers or network operators to evaluate new ABR heuristics or network system changes due to lack of accurate QoE monitoring systems. In order to solve this issue, we have developed YouSlow ("YouTube Too Slow!? - YouSlow") as a new approach to monitoring video QoE for the analysis of ABR performance. The lightweight web browser plug-in and mobile application are designed to monitor various playback events (e.g., rebuffering duration and frequency of bitrate changes) directly from within ABR video players and calculate statistics along with video QoE. Using YouSlow, we investigate the impact of the above playback events on video abandonment: about 10% of viewers abandoned the YouTube videos when the pre-roll ads lasted for 15 seconds. Even increasing the bitrate can annoy viewers; they prefer a high starting bitrate with no bitrate changes during playback. Our regression analysis shows that bitrate changes do not affect video abandonment significantly and the abandonment rate can be estimated accurately using the rebuffering ratio and the number of rebufferings. The thesis includes four main contributions. First, we investigate today's popular OTT video streaming services (e.g., YouTube and Netflix) that use ABR streaming technologies. Second, we propose to build QoS and QoE aware video streaming that can be implemented in existing wireless networks (e.g., Wi-Fi, 3G and 4G) and in SDN-enabled networks. Third, we propose to improve current ABR heuristics by dynamically changing the playout buffer size under varying network conditions. Last, we designed and implemented a new monitoring system for measuring video QoE.

SERVICE PROVIDERS PERSPECTIVE ON THE UNIQUE NEEDS OF SEXUALLY EXPLOITED WOMEN AND CHILDREN IN THE INLAND EMPIRE

The purpose of this qualitative research study was to explore and expose the needs of sexually exploited women and children. The participants were recruited from a few non-profit agencies in the Inland Empire area. This study found one of the most underlying challenge facing the participants when working with sexually exploited victims was the unavailability of resources, particularly, shortage of transitional housing for them. Another finding that featured prominently in the study was related to a need for continuous training and education for the service providers in order to stay current with trends. The study also identified the rapport building challenges faced by service providers and the risk of re-traumatization for these victims and proper types of treatment for these individuals. This study recommends that the policymakers work with other key stakeholders to provide resources to these service providers in addition to providing a favorable environment. The collaboration should also include the law enforcement agencies and the judicial officers to protect the victims from further suffering. Furthermore, the study suggests that attention should be placed on the development of awareness campaigns and stronger voices of support and advocacy for these victims.

Foetal alcohol spectrum disorder: The development of guidelines to inform policy

Philosophiae Doctor - PhD / Introduction: Maternal alcohol consumption during pregnancy can result to birth defects, which may be developmental, intellectual and physical. Fetal alcohol spectrum disorder (FASD) is a term used to describe an array of disorders related to alcohol consumption during pregnancy. FASD is a severe public health problem globally, with South Africa having the highest prevalence (29 to 290 per 1000 live births). What makes the FASD problem severe in the country is rife of maternal risk factors and widespread binge drinking during pregnancy. There is no policy specifically addressing FASD despite being pervasive in South Africa. Government programmes to prevent and manage FASD remain limited and fragmental across relevant departments. Herein, we aimed to conduct a multi-method study with a modified Delphi approach to developing a guideline to inform the development of a comprehensive and multi-sectoral policy for the prevention and management of FASD. Method and analysis: We used a modified version of the World Health Organization’s approach to guideline development in three phases. In phase 1, we conducted four different studies to design the initial guideline prototype. The studies include an in-depth interview with policymakers and a focus group with relevant service providers on policy requirements for FASD, a document review of policies on FASD and a scoping review of various interventions employed for the prevention and management of FASD. The second phase involved using the initially developed guideline prototype to engage with the local and international experts on FASD for improvement on the content. In the third phase, we refined the prototype using a modified Delphi approach. Framework method and content analysis were used to analyse the qualitative data while the Statistical Package for Social Science (SPSS) software was used to analyse the quantitative data.

Supply Chain Integration of LSPs : Real-life insights into how and why logistics companies integrate with their customers

Problem: In today’s competitive business world, companies are faced with challenges due to increasing competition, changes in customer demands, new technologies, and globalization. Due to these changes, competition does not take place between single companies anymore but rather whole SCs. To cope with such challenges, more and more companies focus on SCI. Business managers and academics emphasize the potential of integration. However, existing literature shows a gap concerning the integration of LSPs. In this thesis, LSPs are divided into three different types; carriers, intermediaries, and 3PL providers. Due to differences in their business focus and the deriving logics, their way of integrating with customers will likely differ. Hence, based on these differences and the gap in literature concerning the integration of LSPs, this thesis focuses on an investigation of two carriers, two intermediaries, and two 3PL providers. Purpose: The purpose of this Master thesis is to explore how and why LSPs integrate with their main customers. Therefore, motivators and obstacles, advantages and disadvantages, as well as the extent of integration and possible integration approaches are investigated. Method: This qualitative study makes use of a case study strategy which includes six companies. Data is gathered from semi-structured interviews and documentary secondary data. The findings are analyzed using a two-stage process. First, a comparison of the findings for each of the three types of LSP is conducted. Second, a cross-analysis among carriers, intermediaries, and 3PL providers is performed in order to identify similarities and differences. Conclusions: The findings of this thesis reveal integration of technologies and systems, flows, and relationship evaluation as approaches for LSPs. Further, LSPs integrate externally, upstream and downstream in terms of intermediaries and 3PL providers and downstream in regards to carriers, and on different levels ranging from relatively shallow in case of carriers to deep in terms of 3PL providers. Moreover, LSPs are motivated by factors such as competition, differentiation, and business safety, whereas aspects such as resource investments and customer power differences present potential obstacles. Furthermore, LSPs benefit from integration, e.g. due to improved problem-solving ability, expansion of business, and better responsiveness to market changes. In contrast, aspects such as increased customer expectations, the risk of sunk costs, and dependence present potential disadvantages for LSPs.

The Role of Logistics Service Providers in the Logistics Firms' Supply Chain

Competition amongst companies in the global market has resulted in increased production of goods and services. Enterprises are now faced with the challenges of shipments of raw materials, spare parts from vendors, and the finished goods to consumers. Logistics companies are springing up to tackle transportation and other logistics problems. There are various logistics companies such as logistics intermediaries, carriers and third party logistics service providers in the market which are in one way or the other competing and at the same time cooperating within the supply chain in order to fulfill their assignments to their customers. Third party logistics service providers are experiencing rapid growth because of the advanced demand of services such as the desire to reduce lead time, inventory management, outsourcing, and a host of other functions. Not much has been written on the logistics firms. Besides, most studies on logistics firms and the third-party logistics providers focus more on such aspects like their skills, services, and their relationships with their customers. The purpose of this thesis is to analyze the logistics service providers’ roles within the logistics firms’ supply chain by identifying how the expected roles are performed. In the frame of reference, the author searched several books and articles that are relevant within the scope of the thesis topic. Both qualitative and explorative data collection methods are used in the thesis and these involve conducting interviews, and reading the accounts of other people concerning the thesis topic. The conclusion shows that logistics service providers are able to perform their roles through vertical and horizontal cooperation with other firms and with other logistics firms respectively. Besides, logistics firms do live up to their roles. Carriers and the logistics intermediary now perform more roles than what people think they do, because networks connection and the urge to remain competitive make them to take up value-added services. Third-party logistics service providers add values for their customers through their value-added services in various ways such as time and place utility including tracking and tracing the goods to ensure that they are delivered.
