Title IX of the Educational Amendments of 1972: Level of Implementation in Texas Public Schools

Using a survey and case study formats, this study focused on the level of understanding and implementation of Title IX relating to Texas public school students. The survey focused on the degrees of principal understanding and the compliance with the statute. Additional areas of study analyzed the impact of such factors as principal gender and school level on understanding and implementation. The case study examined the degrees of implementation for a district that had experienced civil rights action and one that had not.

Title VII: sex discrimination in higher education

Federal employment law designed to assure equal employment opportunity for faculty has only been applicable to higher education since 1972. Prior to 1972, the higher education world, moreover, was immune from the most comprehensive federal employment law, Title VII of the Civil Rights Act of 1964. However, Title VII was amended in 1972 to include education institutions. Ever since the protection of the civil rights law was extended to higher education, faculty employment discrimination litigation has increased. The reality of this phenomenal growth in litigation is clear, the potential for judicial intervention in academic decision making is undeniable, and reliance on the judicial process is increasingly becoming common. Thus, no institution of higher education may consider itself immune from the possibilities of litigation, nor immune from the decisions handed down by the courts. The main focus of this study was a legal one, which necessitated a heavy concentration upon the historical and current state of employment discrimination law, specifically, Title VII of the Civil Rights Act of 1964. The study was conducted by using a combination of legislative analysis and legal research methods. The legal research methods used in this study included the same problem-solving processes as other traditional research methods: (1) collecting data; (2) analysis; and (3) interpretation. The main purpose of this study was to examine, analyze, and summarize legislative history and case law relevant to Title VII, and sex discrimination in higher education. In summary, although Title VII prohibits discrimination on the basis of race, color, religion, sex and national origin, the issues surrounding women faculty and sex discrimination is probably the fastest growing area of litigation for administrators on the university campus. Therefore, this study was an attempt to examine the employment discrimination issues and developments pertaining to sex discrimination only. College and university administrators may find this study useful for: (1) examining Title VII, and its amendments; (2) examining sex discrimination case law; and (3) utilizing the research for developing procedures, policies and guidelines to minimize potential lawsuits. / Ed. Politicians' attitudes toward the equal rights amendment: a study of the West Virginia and Virginia state legislatures

The purpose of this study was to explore politicians’ attitudes toward the Equal Rights Amendment. It was hypothesized that certain social, background and political variables would influence the politicians’ attitudes toward ratification or rejection of the Equal Rights Amendment. Data were collected from legislators and former legislators from the states of West Virginia and Virginia. Approximately 70.2 percent of the 195 delegates and former delegates responded to the survey. The findings indicated that the social, background and political variables under investigation were not related to politicians’ attitudes toward the Equal Rights Amendment. Further, lobbying efforts in both states were generally ineffective. The general lack of relationships among the variables toward the Equal Rights Amendment was considered to be influenced by the traditional one-party political control of the state of Virginia. / Master of Science

Window dressing? : women, careers and retail management

Via the submission of six published papers, this thesis draws together the body of work by Broadbridge on retail management and women’s careers. It reveals the factors that continue to be problematic for women’s careers and why in 2010 they continue to be under-represented in the retail management hierarchy. A contextual background to the selected papers is provided in three chapters which summarise some wider issues for the non specialist reader: an introduction to career development models, the gendered processes in management and a contemporary overview of retail employment in the UK. Of the six papers presented, each adopts a different theoretical perspective and so cumulatively a comprehensive understanding of the reasons for women’s continued under-representation in retail management positions is gained. The overall findings from the papers indicated that the main reasons for women’s and men’s differential experience in the retail management hierarchy can be located in issues of male control. Retail management is male dominated, male identified and male centred. This can present itself in a variety of different ways, and through overt or covert means of behaviour and underlying organisational cultures. Key theoretical contributions to the thesis are located in three sets of theory: the sexual division of labour and the organisation of retail work; the gendered retail career, and work-life balance and multiple role demands. Empirical and methodological contributions come from the corpus of data and the use and refinement of a mixed methods approach to understanding the subject area.

Gender representation trends and relations at the United States Naval Academy

This study employed quantitative and qualitative methods to examine gender trends and the quality of gender interactions at the United States Naval Academy (USNA). In addition to gender, midshipmen demographics, experiences, personality types, interests, and graduation outcomes were compared within and across gender for graduation years, 1980, 1985, 1990, 1995, 2000, and 2004. Representation of women has increased to the current high of around 16%. Further, the data revealed similarities and differences between men and women in terms of their non-gender characteristics. Women's SAT scores and Cumulative Quality Point Ratios (QPRs) are on par with the men's. Proportionally, women are more likely to be extroverts and varsity athletes than are men. Women are less likely to be technical majors. Women are being afforded leadership experiences to the same extent as men. Perceptions regarding gender relations and cohesion were assessed through focus groups conducted with 110 midshipmen. Although gender representation has increased, and the Administration is credited with improving the explicit climate, there does not yet exist a completely gender-neutral or women "friendly" climate. The preponderance of findings regarding gender interactions at the Naval Academy suggests that male midshipmen have yet to fully accept female midshipmen. The Naval Academy must continue to confront the subsurface issues and dynamics persisting amongst male and female midshipmen. Recommendations include making an institutional commitment to improving gender interactions and company cohesion, securing alumni cooperation, and involving midshipmen in improving the gender climate.

Rose or thorn? : a black South African woman's account of working in a male-dominated environment

D.Phil. / The major part of what is known about women in leadership positions, and the challenges they are facing, is based on studies conducted in first-world countries. There clearly is a gap in the literature in terms of studies that focus on female leaders in Africa. Much has still to be said about the role that cultural practices and prejudices play in hampering the growth and progress of these women. This authentic study of a South African Zulu female manager provides a unique insight into the way she negotiated the challenges of climbing the corporate ladder in a male-dominated environment. Its postmodernist approach challenges the writer to use herself as a research subject while applying the principle of reflexivity in stepping back and analysing lived experiences from a researcher‟s perspective. In opening up her innermost feelings to the world, the researcher reveals who she really is, and how she, as a Zulu woman, wife, mother, and manager, negotiated her way between her own traditional culture and the Western corporate world. This creates real challenges to the researcher, as she has to keep sliding between being the subject and being the researcher at the same time. This narrative of "self" is recreated through interviewing people who had been part of the researcher‟s life during the period which was the focus of the study as well as the researcher recalling significant events. The research focuses on the challenges of being a minority leader in a South African workplace. The resistance to a black female as their superior by black males is highlighted, as is the manner in which these cultural prejudices result in discrimination against women by members of their own culture. The research also illuminates the impact of legislation aimed at transforming the local workplace and the leadership fraternity in a post-apartheid South Africa.

A critical analysis of the representations of gender and sex in newspaper reports on HIV and AIDS

D.Phil. / The aim of this study is to critically analyse representations of gender and sex in newspaper reports on HIV and AIDS in the hope of improving messaging around HIV and AIDS. Within the scope of this study observations are made at the conclusion of each case study so as to inform prevention campaigns and media on more appropriate ways of representing gender and sex and HIV and AIDS. These observations serve as guidelines to inform journalists and civil society on how better to message HIV and AIDS and sexuality. Mutual recognition is used as the theoretical standpoint for understanding sexuality by emphasizing the premise of respect for self and other. Mutual recognition is used as the critical lens to rethink gender beyond constructions of masculinity and femininity, race, class and sexuality; looking for the moments and opportunities for recognition between both masculine and feminine subjects as well as for narratives on sameness and difference beyond race, class and sexuality. Mutual recognition is also the way forward for resisting phallogocentrism and shifting representation away from the workings of male hegemony. The theoretical framework used in this study is based on feminist psychoanalysis and feminist media interpretation. Special mention is given to the work of Jessica Benjamin, Donna Haraway and Jane Flax; on account of their reception of Freudian theory of the oedipal complex showing ways of rethinking the oedipal complex and gender differentiation. Foucault’s work on representation shows how we can rethink language to better serve the notion of mutual recognition, placing importance on concepts such as respect, responsibility and caring for self and other in ways that go beyond race/ethnicity, class, sex/gender or sexuality. Eros and thanatos (life and death drives) is nuanced to highlight how jouissance or the ‘little death’ (orgasm) is a way of resolving the tension between these opposing drives by shifting discourse away from sex and taboo or death towards sex and pleasure and thus emphasizing eros and mutual recognition. The study is concluded with a set of guidelines for representing gender and sex in relation to HIV and AIDS. It is significant to note that this is a qualitative study that, which makes use of textual analysis and seeks to offer a measure of transparency and accountability to the interpretation of selected texts.

Gender, poverty and recreation in Lenasia : an agenda for change

M.A. / This research report seeks to examine and analyse the role of recreation and leisure in improving the quality of life of women. The critical areas of poverty alleviation and the engendering of self sufficiency and empowerment through appropriate and goal directed programming and strategies will be investigated. Gender relations and hegemonies that govern women's choices will be critically explored with the assumption that women's participation and enjoyment of leisure are dependent on economic capacity and decision making freedom. The underlying aim of recreation is seen to provide an avenue for women to address these inequalities, find means to alleviate poverty, and learn skills for personal growth and enhancement of quality of life. The perceptions that women have of their leisure needs and the constraints to realising those needs are reflective of the amount of, freedom of choice that women are able to exercise. The relationship between freedom to experience leisure and social and ideological constraints to other social aspects of women's lives are important considerations. This research argues that lack of participation in recreational activities is indicative of a range of inequalities experienced by women. Data for this research has been collected from questionnaires and focus groups and contextualised within a feminist framework with a view to effect change in the understanding of recreation's role in the empowerment of women and the establishment of programmes that address inequalities and social problems.
