Este objetivo é buscado sempre pela mistura ou dialética de dois elementos ou dimensões. Em primeiro lugar, a exploração dos argumentos existentes na teoria do direito. Em segundo lugar, a relação destes argumentos com aqueles apresentados em campos da filosofia da linguagem. Nossa hipótese é a de que o estudo deste debate e desta relação nos mostra que a teoria dos desacordos de Dworkin é a melhor explicação do problema, mas, ao mesmo tempo, as teorias adversárias escolhidas utilizam de diversos elementos metodológicos que representam avanços que foram realizados na filosofia geral, como a perspectiva dos planos proposta por Michael Bratman. Tentamos demonstrar esta hipótese por meio da análise de quatro autores e suas influências. Estes autores são Ronald Dworkin, H. L. A. Hart, Jules Coleman e Scott Shapiro. Por meio desta análise, esperamos demonstrar como os fundamentos das teorias propostas foram se modificando da filosofia da linguagem para outros campos e qual é o estado da teoria do direito com este avanço. Como resultado, defendemos que a hipótese está certa e que mesmo sem ter a melhor capacidade explicativa, as novas teorias do direito precisam ser melhor analisadas e seus ganhos melhor considerados. / This work has as general objective to analyze the influence of philosophy of language on the Hart – Dworkin Debate and the overcoming tried by the planning theory of Scott Shapiro, focusing the theoretical disagreements. This objective is always sought by the mixture of two elements. In the first place, the exploration of the existing arguments in legal theory. Secondly, the relation of these arguments to those presented in fields of general philosophy. Our hypothesis is that the study of this debate and relationship show us that Dworkin's theory of disagreements is the best explanation of the problem, but at the same time the opposing theories chosen are using several methodological elements that represent advances that have been made in general philosophy, such as the perspective of the plans proposed by Michael Bratman. We attempt to demonstrate this hypothesis through the principal analysis of four authors and their influences, namely Ronald Dworkin, H.L.A. Hart, Jules Coleman, and Scott Shapiro. Through this analysis we hope to demonstrate how the foundations of the proposed theories have been changing the focus from philosophy of language to other fields and which is the state of legal theory with this advance. As result, we defend the point that the hypothesis is right and even without the best explanatory capacity, the new theories of law need to be better analyzed and their earnings better considered.

Raz and His Critics: A Defense of Razian Authority

Joseph Raz has developed a concept of authority based on the special relationship between reasons and action. While the view is very complex and subtle, it can be summed up by saying that authorities are authorities insofar as they can mediate between the reasons that happen to bind their subjects and the subjects’ actions. Authorities do this by providing special reasons via directives to their subjects. These special reasons are what Raz calls “protected reasons.” Protected reasons are both first-order reasons for action and second-order “exclusionary reasons” that exclude the subject from considering some reasons in the balance of reasons for or against any action. I first make clear what Raz’s view of authority is, and I then defend this view from some contemporary critics.

This is a study of Chava Shapiro, a woman writer, born in 1876 in the Ukraine, who died in 1943 in Nazi Czechoslovakia. It describes her conventional Hasidic upbringing, her successful rebellion against it and her subsequent studies in Switzerland which led to a career in Hebrew journalism. It follows her return to Russia in 1914, her escape to Czechoslovakia after the pogroms of 1919 and 24 years later her tragic end in Terezin. / Dominating the study is the well-known Hebrew writer, Reuven Brainin, 1862-1939, with whom Chava Shapiro fell in love and who exerted an extraordinary influence on her life. / Using original, never before published materials from the Jewish Public Library Archives in Montreal, the study seeks to define the woman as a feminist and a Hebrew writer.

This paper presents a stability analysis of the sensor data which is collected by QTAGG from alarge ocean going ship and using the stability results, introduces some information about howthe measurements that come from the sensors can be improved and how reliable they are. In thetheoretical part, some background information is given mainly based on British Standard(BS)ISO 19030 which was published in November, 2016. This source basically includes someinformation about the measurement of changes in hull and propeller performance of a vessel.Using the theoretical information, in the implementation part, the necessary methods areimplemented in python programming language on a real life data set of a vessel which is givenfrom QTAGG company. To measure the stability of the parameters in the data, we loosenthe filters of the parameters and observe how they respond to the technical changes. In orderto understand how loosen the filters can be made, a reference speed-power curve is createdby using a curve fitting method, and after creating a performance indicator by utilizing thereference curve, Anderson-Darling and Shapiro-Wilk tests are used to measure the stability ofthe performance indicator. Besides these numerical tests, some visual methods such as Q-Qplot and histogram plot are also used in this process. Finally, we could provide stability resultsby using both our theoretical knowledge and the practical implementation.

Impact of unbalancedness and heteroscedasticity on classic parametric significance tests of two-way fixed-effects ANOVA tests

Classic parametric statistical tests, like the analysis of variance (ANOVA), are powerful tools used for comparing population means. These tests produce accurate results provided the data satisfies underlying assumptions such as homoscedasticity and balancedness, otherwise biased results are obtained. However, these assumptions are rarely satisfied in real-life. Alternative procedures must be explored. This thesis aims at investigating the impact of heteroscedasticity and unbalancedness on effect sizes in two-way fixed-effects ANOVA models. A real-life dataset, from which three different samples were simulated was used to investigate the changes in effect sizes under the influence of unequal variances and unbalancedness. The parametric bootstrap approach was proposed in case of unequal variances and non-normality. The results obtained indicated that heteroscedasticity significantly inflates effect sizes while unbalancedness has non-significant impact on effect sizes in two-way ANOVA models. However, the impact worsens when the data is both unbalanced and heteroscedastic. / Statistics / M. Sc. (Statistics)

An Assessment of the Performances of Several Univariate Tests of Normality

The importance of checking the normality assumption in most statistical procedures especially parametric tests cannot be over emphasized as the validity of the inferences drawn from such procedures usually depend on the validity of this assumption. Numerous methods have been proposed by different authors over the years, some popular and frequently used, others, not so much. This study addresses the performance of eighteen of the available tests for different sample sizes, significance levels, and for a number of symmetric and asymmetric distributions by conducting a Monte-Carlo simulation. The results showed that considerable power is not achieved for symmetric distributions when sample size is less than one hundred and for such distributions, the kurtosis test is most powerful provided the distribution is leptokurtic or platykurtic. The Shapiro-Wilk test remains the most powerful test for asymmetric distributions. We conclude that different tests are suitable under different characteristics of alternative distributions.
