Valstybė kaip ginčo šalis tarptautiniame komerciniame arbitraže / State as a party to a dispute in International Commercial Arbitration

Šiame magistro baigiamajame darbe analizuojamos valstybės kaip ginčo šalies tarptautiniame komerciniame arbitraže lemiamos teorinės ir praktinės problemos tiriant tarptautinio komercinio arbitražo, arbitražo šalių bei valstybės kaip ginčo šalies tarptautiniame komerciniame arbitraže sampratas. Taip pat analizuojamas galimas įpareigojimų sukūrimas, arbitražinio susitarimo nesudariusioms šalims, valstybės imuniteto tarptautiniame komerciniame arbitraže klausimai bei kiti arbitražo proceso, kuomet viena ginčo šalių - valstybė - ypatumai. Be to, paskutinėje šio magistro baigiamojo darbo dalyje analizuojama Lietuvos Respublikos, kaip ginčo šalies tarptautiniame komerciniame arbitraže, patirtis. / Firstly, in this master thesis the concepts of international commercial arbitration, parties of the arbitration and a state as a party to a dispute in international commercial arbitration are analysed. The analysis of the concept of international commercial arbitration shows that in author’s opinion the concept of international commercial arbitration determined in the Law of Commercial Arbitration of the Republic of Lithuania should be revised. Also the conclusion should be done that the problem of the content of the ‘state’ concept is existing in both – practical and theoretical levels. As the practice regarding this question is not well-established, after the analysis of the existing theories the application of the mixed theory of the concept of the ‘state’ is suggested. Moreover in this master thesis the possibility to bind the non-signatories to arbitration agreement and questions of the immunity of a state in international commercial arbitration are analysed. Those institutes are raising a number of practical problems as on the one hand the threat to bind the non-signatory of the arbitration agreement arises and on another hand the possibility that the award of the arbitral tribunal will not be recognized and/or enforced exists. Magistro darbo tema – viešoji tvarka kaip pagrindas atsisakyti pripažinti ir leisti vykdyti arba panaikinti arbitražo sprendimą. Darbo tyrimo objektą sudaro viešosios tvarkos sampratos analizė, išskirtinį dėmesį skiriant Lietuvoje formuojamos viešosios tvarkos analizei bei tokios sampratos tolimesnio vystymosi galimybėms, taip pat esminiai su šiomis kategorijomis susiję klausimai: teismas turi teisę ar pareigą vadovautis savo ar kitų valstybių viešosios tvarkos samprata? Kokią įtaką viešosios tvarkos sampratai turi Europos Sąjungos (ES) teisė? Ar arbitražas yra susijęs su konkrečia valstybe bei ar turi vertinti tokios susijusios valstybės ar daugelio valstybių viešosios tvarkos turinį ar priešingai – yra nepriklausomas nuo konkrečios valstybės (angl. – seatless) bei turi ieškoti universalios tarptautinės viešosios tvarkos? Kokia yra teismo kontrolės apimtis, kai yra vertinama arbitražo sprendimo atitiktis viešajai tvarkai? Pirmoje dalyje atskleidžiama vyraujanti bei didžiausias vystymosi perspektyvas turinti tarptautinės viešosios tvarkos samprata. Šioje dalyje siekiama analitiškai įvertinti skirtingus požiūrius į viešosios tvarkos kategoriją, taip pat pateikiamas analitinis ir kritinis viešosios tvarkos bei imperatyviųjų teisės normų santykio vertinimas, atskleidžiami pagrindiniai Tarptautinės teisės asociacijos rekomendacijų bruožai, analizuojamos priežastys, kurios nulemia skirtingą viešosios tvarkos taikymo praktiką. [toliau žr. visą tekstą] / This master’s thesis reveals the issue of Public Policy as a Ground for Refusing Recognition and Enforcement or Setting Aside Foreign Arbitral Award. This work provides a comprehensive analysis of public policy. The paper focuses on the analysis of understanding of the notion of public policy in Lithuania. The thesis identifies possibilities of further development of the latter concept. Moreover, the work tackles the main questions related to public policy, such as: does the Court have an obligation or a right to apply national and/or international public policy? How does the EU law affect the concept of public policy? What is the scope of the Courts' control over compliance of the arbitral award with public policy? The first chapter of the thesis presents the dominant concept of international public policy that has the most prominent development perspectives. This part of the paper is focused on analytical evaluation of different attitudes towards public policy category. Along the same lines, critical analysis of the relationship between public policy and strictly imperative norms is provided. Furthermore, the mains aspects of International Law Association recommendations are reflected and prerequisites which determine different application of public policy are analysed. The next chapter displays the influence of the EU law and ECJ practice on the understanding of public policy in the EU Member states and non EU Member states.
