This thesis deals with the issue of grounds for notice of termination of employment. It also analyses institutes that are closely related to this issue, like termination of employment in general, notice of termination and its requisites, protective periods, or employer's obligations that arise from notice of termination in certain cases. When evaluating and assessing the legislation it's necessary to keep in mind two legal principles, the principle of flexibility and the principle of protection of the weaker party (the employee). In the legislation of termination of employment and in labour law in general these two principles clash. One of the specifics of labour law is relatively rigid and enforced legislation that tries to equalize the inequalities in the employment relationship between employee and employer by, among other things, tying the possibility of the employer to terminate employee's employment on fulfilling particular material requirements. In practice, this legislation can be perceived as excessively restrictive. In particular, the thesis focuses more closely on these material requirements that need to be fulfilled in order for the employer to be able to terminate the employee's employment. Investigations into long-standing problems in radical polymerization kinetics : chain-length-dependent termination rate coefficient and mode of termination.

The present thesis investigates some long standing problems in radical polymerization (RP). The major aim is to consider the feasibility of using simple techniques to provide more insight into the kinetics of RP. This can contribute to fundamental knowledge of radical polymerizations, particularly with respect to the mode of termination (λ), average termination rate coefficient (<kt>), chain-length dependence of termination (CLDT) and chain transfer through in-depth investigations of the rate of polymerization (Rp) and molar mass distribution (MMD), the latter especially via mass spectrometric (MS) analysis. The termination process was first investigated. Observation of changes of <kt> (or equivalently Rp) and MMD by a variety of factors such as solvent, monomer and initiator concentrations, temperature, pressure and growing radical size were explored. Non-classical kinetics and chain-length dependency of termination were confirmed. Accessibility of CLDT information was clearly evident. Although observed results meet fully with composite-model expectations, issues such as chain transfer were found to have an effect on the CLDT parameters determined from rate measurements. Specifically, dilute-solution polymerization of methyl methacrylate (MMA) in methyl isobutyrate (MIB) showed evidence of such an effect. Scaling of quantities that are experimentally accessible such as <kt> with DPn yield CLDT parameters in good agreement with what has been reported from recent PLP experiments. This was confirmed for several monomers. The temperature dependence of termination was also investigated and found to show evidence for CLDT. In contrast, the variation of <kt> with pressure did not demonstrate similarly strong CLDT effects. Evidence for and determination of chain transfer to MIB was also obtained. This was followed up by investigations into the important parameter λ using the MS technique. Surprisingly little is known about λ despite its long history and its apparent importance to polymer properties. Firstly, the robustness of using MS was explored, with the method passing numerous consistency checks. Although no large dependence of MS instrument was found, electrospray-ionization mass spectrometry (ESI-MS) provided best resolution. Second, the type of initiator, the initiator concentration and the solvent were found to have no measurable effect on λ, even when chain transfer occurred. In further work, increasing temperature seemed to have an influence on λ, leading to an increase in the proportion of disproportionation. However, pressure was found to have only a small influence on λ. The effect of monomer on λ was also studied. In the final part of this work, a preliminarily investigation into the viability of using Raman spectroscopic techniques to study auto-acceleration, also called the gel effect, for bulk MMA radical polymerization was presented. The results showed the possibility of using such a technique to follow the reaction to high conversion. The effect of temperature and initiator concentration on auto-acceleration were also presented. The outstanding results of this thesis are: (1) The application of CLDT theory to better understand rate results from low-conversion polymerizations. (2) In particular, the use of CLDT principles to explain termination activation energies across a range of monomers. (3) The validation of the MS method for quantitative determination of mode of termination by carrying out an array of consistency checks. (4) Showing that MS results are consistent with CLDT theory. (5) Utilization of the MS method for the first ever reliable measurement of the variation of mode of termination with temperature, pressure and monomer.

History of pregnancy termination as a risk factor for preterm birth, Virginia 2000-20007

Abstract Objectives: The objective of this study was to determine if an association exists between prior induced and prior spontaneous pregnancy termination (PIPT and PSPT) and preterm birth (PTB) of first live births in Virginia. Methods: Data was collected by linking maternal data from Virginia’s live birth and fetal death registries. All first live, singleton births occurring in Virginia from 2000-2007 were analyzed. Logistic regression models that controlled for various demographic, medical and obstetric history factors were used to determine associations among prior pregnancy termination types. Results: Compared with women who had no history of previous pregnancy terminations, women who had 1 (OR = 1.1, 95% CI 1.31, 1.53), 2 (OR = 1.2, 95% CI 1.12, 1.24) and 3 or more (OR = 1.4, 95% CI 1.07, 1.13) total prior pregnancy terminations had an increased odds of experiencing PTB. Increased odds of PTB were found for women who had 2 (OR = 1.1, 95% CI 1.05, 1.18) and 3 or more (OR = 1.3, 95% CI 1.39, 1.61) PIPTs. Women who reported 1, 2, 3 or more PSPT had PTB odds-ratios of 1.4 (95% CI 1.37, 1.50), 1.7 (95% CI 1.48, 1.98) and 3.0 (95% CI 2.09, 4.22) times, respectively. Conclusion: Two or more PIPT and one or more PSPT were found to be a significant risk factor for PTB of a first live birth in Virginia, and women having 3 or more PSPT had three times the odds of experiencing this outcome. Health practitioners should take this data into account to target research, education and action strategies to those high risk groups of women associated with obtaining induced terminations and to those women more susceptible to spontaneous termination of pregnancy.

1 Abstract This diploma thesis deals with the termination of an employment relationship. Its aim is to aptly depict and characterize individual ways of terminating an employment relationship with a focus on the termination of an employment relationship by labor-juridical acts, also to call attention to some application difficulties and to mention proposals de lege ferenda. Firstly, the thesis is focused on the different areas of labor law, its functions and also on the relation between labor law and civil law. The attention is further paid to the explication relating to the employment relationship as well as to labor-juridical acts and some consequences of their defects. The focus of the thesis lies in the analysis of individual ways of terminating an employment relationship. The employment relationship can be terminated either on the basis of labor-juridical acts, on the basis of a labor-juridical event, or on the basis of official decisions. Claims arising from invalid employment termination Abstract in English language The goal of this Master thesis is to discuss and analyse the law and case law surrounding invalid employment termination and claims arising from such disputes. An unseparable part of this issue is the distinction whether such an action taken by a party is valid, invalid, or putative. In the introducion i describe the goals and themes of this Master thesis in more detail. In the first chapter I describe employment itself, it's features and it's importance in the context of Labour Code. I also discuss the difference between it and other types of labour contracts, and I try to find an answer to why there is such a few cases of parties pursuing legal action in response in invalid termination of these contracts.
