Dispute Settlement in International Economic Law - Selected Aspects Abstract At the time of the emergence of investor state arbitration, such regulation of states was seen as necessary to protect Western investors from expropriation of their investments by developing states, in which there was an absence of rule of law and the protections that flow from that. The ICSID Center was established primarily to ensure the availability of an assured impartial and independent dispute resolution service. The increase in the number of cases over the years, together with sometimes expansive, unexpected and inconsistent interpretations of International Investment Agreement provisions by tribunals, had triggered a worldwide debate and a number of countries had adopted reform measures. The EU has proposed a Permanent Investment Court to address criticism, aimed at investment arbitration and to be included as a measure under the TTIP. This concept has been also adopted in the CETA, and if successful, is likely to be adopted in other treaty agreements as the European Parliament has expressed a preference for the proposed investment court under the TTIP to be included in other free trade agreements. 63 Recognition and execution of foreign arbitral awards Abstract This thesis deals with the issue of recognition and performance of foreign arbitral awards in the field of private international law. The aim of the thesis is to clarify the distinction between recognition and performance and to focus on the issue of enforceability in judicial and enforcement proceedings. The thesis is divided into four chapters describing individual elements of arbitration and recognition and enforcement of arbitral awards. In the first chapter I deal with the arbitration, which is a prerequisite for the arbitral award. The second chapter defines the arbitral award itself, its particulars, types, and the procedure for its abolition. In the third chapter I dealt with the most important sources in the field of foreign arbitral awards and the last chapter is the most comprehensive. It contains a process of recognition and execution, including denial under the New York Convention, the current issue of the decision-making practice of the Supreme court of the Czech Republic, as well as recognition and enforcement in the territory of Switzerland. The National Quality Award Program, sponsored by the American Healthcare Association National Center for Assisted Living, was implemented to cultivate continuous quality improvement in nursing homes and assisted living facilities. Based upon the Baldridge Criteria for Performance Excellence, the program utilizes a systems-based or Big “Q” approach to quality and requires applicants to examine seven categories of their organizational environment including: 1) leadership, 2) strategy, 3) customers, 4) measurement, analysis, and knowledge management, 5) workforce, 6) operations, and 7) results. The subsequent dissertation examines whether award status is associated with better performance on publicly reported quality measures and financial performance within the nursing home setting. Findings suggest implementation of Baldridge principles may promote improved quality; however, further research is warranted to fully understand the relationship.

This thesis investigated the relationship between Total Quality Management (TQM) practice and hospital performance from 1997 t0 2001 in a Taiwan public hospital. In Taiwan, previous research focused on TQM practice and hospital performance in the manufacturing sector. Earlier research relevant to hospitals emphasised outcomes, such as hospital efficiency. The current study differs from the previous hospital research by examining comprehensive organisational performance, including financial and non-financial performance. The objective was to gain insights into ways in which the managers of hospitals might use the findings to enhance the hospital performance levels. The Malcolm Baldrige National Quality Award (MBNQA) 2001 health care criteria for performance excellence were used as a research instrument to measure TQM practice and hospital performance. Data were collected using triangulation method, that is a self-assessment questionnaire, focus group interviews and documentation that is Government Annual Reports. Multivariate Analysis of Variance (MANOVA) and Multiple Regression Analysis were utilised to analyse data from questionnaires. Findings from focus group interviews were coded and categorised. Findings from documentation were used to verify and validate the progress of hospital performance. The quantitative findings indicated that the demographic characteristics of employees had no significant impact on TQM practice, nor on hospital performance. Elements of TQM, however, were important determinants of overall hospital performance, the more committed the TQM practice, the better the hospital performance. The qualitative findings indicated that, for Hospital A, effective TQM would be accomplished through incremental organisational change. This research makes a contribution to both academic knowledge and hospital practice. It bridges the research gap in the relationship between TQM practice and hospital performance and also offers a solid foundation for future academic research. The study also provides short and long-term recommendations about quality improvement to both the manager and hospital A.

In this thesis I argue that science fiction is not a genre exclusively made up of written texts but a community or series of communities. I examine the science fiction community's engagement with questions of femeninity, masculinity, sex and sexuality over the past seventy years, that is from 1926 until 1996. My examination of this engagement is centred on the battle of the sexes, the lives of James Tiptree, Jr. and the Award named in Tiptree's honour. I make connections between contemporary feminist science fiction and the earliest pulp science fiction engagements with sex and sexuality.

This thesis addresses the argument that TAFE as an organisation has not significantly changed its concept of its purpose and place in Australian society over the last hundred years. It concludes that Industry Award Restructuring may possibly achieve what two world wars, two depressions, one economic boom, international civil rights movements and technological change could not: TAFE may change substantially over the next decade and move from its self-concept as an education institution into an overt training role. Due to award restructuring in industry, new demands will be made on TAFE which cannot be resisted if TAFE is to maintain its position as the primary provider of vocational education/training. In the course of the research it was found that it is possible to carry out direct observation of an organisation or industry without significantly affecting the processes of the organisation. This may be achieved by finding a role which complements, supports or supplements the organisation's objectives, but in which there are no line responsibilities and thus little or no interference. Such a role appears to be that of writer of documents, which gives unlimited access to all parties and sources without influencing either policy or practice. The outputs from the writing tasks are of value to the target organisation, so that the researcher gives as well as takes, and could be described as being in a symbiotic relationship with the organisation. The skill standards and assessment criteria developed during the study are presented as outcomes of a symbiotic case study, and the success of the method is evaluated by comparing the outcomes with those of other Streams of the same industry, which have been working on similar document development tasks over the same time period using traditional methods.
