The purpose of this thesis is to compare the S.A. law of enrichment with the German BGB, to answer the question whether both systems are so similar that in both of them a general enrichment action could exist. Before this question can be answered in the affirmative, it has to be investigated whether, first of all, a basic structural similarity of these two Romanistic legal systeas exist and (secondly), whether the BGB recognizes a general enrichment action. The coaparison would be fairly easy if one could say that at least the basic principles of each system were of a firmly developed and undisputed nature. But this is far from true! Voluminous works have been written not only concerning the law of enrichment in general, but even concerning each specific element of enrichment liability. I do not intend to add another compendium to this huge number. Nor do I intend to discuss the actio negotiorum gestorum. This thesis is aimed at giving a short outline of both systems of unjustified enrichment, and elaborating basic principles of enrichment liability; thereafter the difference between the two systems will be highlighted by examples and, finally, special attention will be paid to the problem of a general enrichment action.

A análise da tinta de um documento é extremamente importante para o estudo de diferentes aspectos, como adulterações e determinação da recentidade. Esses aspectos podem ser estudados analisando a tinta e o papel tanto fisicamente quanto quimicamente. Portanto, o desenvolvimento de uma técnica para a análise de tintas de caneta esferográfica e a determinação da recentidade de um documento é interessante para a Ciência Forense. No Brasil, cientistas forenses enfrentam todos os dias diversos casos que requerem a análise de tintas de caneta esferográfica, e não se tem nenhuma técnica onde a determinação da idade de uma tinta é possível. Os casos mais comuns onde há a necessidade da recentidade de um documento são fraudes em recibos de pagamento e de quitação de dívidas, preenchimento e assinatura de contratos, adulteração em documentos e em cheques. Neste trabalho, é discutida uma nova metodologia para a análise de tintas de canetas esferográficas e a sua utilização na determinação da recentidade de uma amostra de tinta de caneta esferográfica. Foram analisadas periodicamente amostras provenientes de diferentes países, como Estados Unidos, Canadá, Peru, Japão, Espanha e Grécia. Com os resultados obtidos, foram construídas curvas de degradação do solvente em função do tempo de preparo. Com as curvas, obtiveram-se as equações logarítmicas relativas. As equações propostas mostraram ser capazes de distinguir a idade relativa de uma tinta, com 20% de variação em relação ao valor teórico. in English The purpose of this master's thesis is to introduce a reader into some legal aspects of foreign investment in Australia. And especially those which can be crucial for a foreign investor when contemplating about investing in Australia. The thesis is divided into 6 chapters. The first chapter introduces the topic of foreign investment and the thesis itself. The second chapter familiarizes with the key terms in international investment law, namely, investor (both a natural and legal person) and investment (in economic and legal sense). The third chapter describes the legal framework governing foreign investment in Australia. It provides an overview of domestic and also international legislation. The fourth chapter then deals with admission and establishment of investment in Australia. It covers how this issue is regulated in investment treaties and in domestic legislation, where the most important piece of legislation is Foreign Acquisitions and Takeovers Act. Further, this chapter describes the concept of foreign person and the national interest test. The concept of the national interest test is important as all foreign investments which are notifiable actions are assessed by the Treasurer against the national interest test, which, however, is not defined in legislation. The diploma thesis deals with the issue of product placement and its legal aspects in the Czech republic. It analyses all the legal regulations, which strike upon product placement. The thesis also contains real law cases and two examples of contracts in this field. The author presents her own proposals and recommendations of how should product placement be regulated.
