Informační povinnost obci ve vybraných zemích / The duty to inform owed by municipalities in selected countries

Resumé Information duty of municipalities in selected countries In this thesis I have concentrated on the topic of transparency and openness of municipality bodies in the Czech republic, the Slovak republic and the Free State of Bavaria. The legislations in these countries have historically similar grounds, nevertheless, nowadays they show up many distinctions. My concentration was focused on the Czech legislation and legislative proposals, since the topics of open (digital) society, transparent politics and elements of direct democracy are being held as popular key words in the election struggles. The attempts of last three governments were heading almost to the same goals, showing that there is a need to adjust the processes of municipality bodies in terms of enabling citizens to participate and control easily the work of their representatives. These measures were meant to have the effect of decreasing the possibility of corruption at the municipal level. This diploma thesis deals with the latest trends in international commercial arbitration. Specifically, it focuses on transparency in international investment arbitration and third-party funding in international commercial arbitration. The objective of this thesis is to provide a comprehensive interpretation of a gradual development of these trends and to also give potential Czech readers an idea about present hot topics in international arbitration coming mostly from foreign sources of bibliography. The thesis is divided into three chapters. The first chapter dedicates itself to defining arbitration in the context of various dispute resolution methods and provides its basic comparison to international arbitration. At the same time, it offers an insight into the advantages and disadvantages of this type of dispute resolution and it discusses the principles of confidentiality and privacy of arbitration proceedings. The Role of the European Parliament in the Rulemaking Process of the EU Abstract The topic of the thesis concerns the law-making of the European Union. It intends to present the legal framework of the adoption of the adoption of legislative acts and analyse the influence caused by the practice of informal procedures on de facto the situation in this field. Within the organisation structure, the emphasis is placed on the functioning of the European Parliament and within the informal procedures on so-called trilogue negotiations. Firstly, we examine the nature of informal procedures and trilogue negotiations. Secondly, we analyse what the influence of those procedures on the factual state of affairs of the ordinary legislative procedure in the light of its de lege lata concept and thirdly we evaluate the outcome from the EU functioning principles' point of view. After the de lege lata overview and the specification of the trilogue negotiations and other modalities of the informal procedures, we analyse some typical impacts of the trilogue negotiations on the practice of the adoption of legislative acts. Elektronické aukce ve zdravotnictví / Electronic auction in healthcare

Working with the theoretical part focuses on the regulation of electronic auctions in terms of legislation both Czech and foreign, given that we are members of the European Union. Furthermore, the work explains the possible ways to use electronic auctions, which are mostly used in both the Czech Republic and abroad. At work I also am trying to shed light on the current use of auctions on the auction portal Aukro examples, which is widely used by people for personal use. Finally, the theoretical part I try to outline the future development of electronic auctions. The practical part is focused primarily on its activities in the hospital Pardubice Region, Inc. where I introduced the auction. In several examples, visible results, which not only brings centralization entire purchase, but also the use of electronic auctions as a tool for communication and bidding suppliers with the lowest purchase price for a group of hospitals. The work also draws from the Ministry for Regional Development, which is responsible for the preparation of the most important regulations for electronic auctions in healthcare, namely the Public Procurement Act. Electronic auctions are a tool very interesting, because it is the most transparent way of evaluating procurement by parameters rates. Whether if electronic auction in health care and efficient purchase option will be discussed in this work.

Anonymity of shareholders and the associated degree of transparency of the joint- stock company belongs in the field of company law among the most debated issues. Especially in light of the necessary fight againstmoney laundering and financing of global terrorism European legislaton creates extensive modification of the terms which are targeted on uncovering the identity of genuine owners of joint-stock companies. Czech Republic is obliged to transpose these terms into czech law. From this perspective, it is a very dynamic subject that is rapidly evolving and is not analyzed comprehensively. Work is primarily devoted to the description of the institutes in czech private law, which allow to maintain the anonymity of shareholders and degree of their possible identification. The thesis contains also the characteristics of selected public law acts in which is presented strong public interest on the identification of beneficial owners of corporations. The thesis also reflects upcoming changes that will in the near future modify the position of shareholders and their potential unfolding. The main theme of this thesis is an analysis of post-contractual behaviour of selected contractors of public procurement. Processes behind the post-contractual behaviour are succeeding already signed contracts, and can often lead to an undesirable change in contracted price. Indetification of these processes, that lead to increased post-contractual behaviour, is the key element of this thesis. For this purpose, the collection and subsequential analysis of the collected data, i.e. data about completed public procurement, is crucial.

In last decades, we are viewers of the trend, when business informatics adopts and implements general managerial methodology, methods and tools. These are modified in the specific condition of business informatics. We can demonstrate this trend on the follow examples: Corporate Governance, derived IT Governance. Corporate Performance Measurement (CPM), derived IT Performance Measurement (IT PM) or Balanced Scorecard (BSC), derived IT Balanced Scorecard (IT BSC). There is enough scope for all this domains in the Czech written literature. But there is no scope for IT controlling. The main goal of this thesis is verify the Eschenbach concept of controlling can be adopted by business informatics in its specific condition. This diploma thesis also handles about problems and benefits caused by implementation this concept of controlling in business informatics. The main goal is reached by exploration literature, researches, case studies, articles and other paper or electronic essays, when the methods of deduction and synthesis are used for customizing general facts about controlling for IT Governance and IT Management Thesis is divided in three parts: At the beginning of this diploma thesis, there are introduced right assumptions for correct understanding of IT controlling. The benefits of this part we can see in the defining of system attributes of business informatics and comparison IT Management and IT Governance with two theoretical approaches to management control system. By this comparison is verified the possibility to adopt controlling in business informatics. In the second part of this diploma thesis, there is description of author concept IT controlling based on Eschenbach. There is description of main IT controlling function, institutionalization of IT controlling and the role of IT controller in organizational structure. The rest of this thesis is devoted to the concrete IT controlling functions, problems and solving of theirs. These are divides in two categories. The firs one is focused on performance oriented IT controlling. The second one is focused on IT costs oriented IT controlling. This thesis handles about IT controlling complexly. The result of this diploma thesis is author concept of IT controlling based on Eschenbach concept of controlling.

Správa a řízení fotbalu v České republice / Administration and Management of Football in the Czech Republic

The Football Association of the Czech Republic (FACR) board election triggered speculations about the governance of the association last year. Specifically, principles of transparency and democracy in the association were remarked. The aim of the thesis was to assess the level of transparency and democracy in the governance of the FACR and to compare the evaluation of the FACR governance by different stakeholders. A case study research design was chosen. Multiple sources of data collection were combined such as document analysis, media coverage analysis, interviews and a questionnaire survey. Results reveal low democracy of the FACR governance in spite of democratic governance design. Stakeholders do not feel to be involved in governance of FACR and they do not have the oportunity to take part in this process. Stakeholders' perception of transparency was better than the objective assessment of transparency. In particular, the financial transparency was the lowest. Thus, results provide new evidence to assumption that transparency is not enrooted in the society of CEE countries and the perception of transparency is biased.

The main aim of the diploma thesis is to demonstrate different views on transparency and on instruments of strengthening transparency. Using my own developed methodology of evaluation the transparency of municipalities based on criteria analysis the thesis seeks to find out an answer to the research question: How much are municipalities transparent by themselves in the publishing of information to citizens and how easy or difficult is it for citizens to control the administration of the municipality? The thesis is structured into four chapters. The first one deals with theoretical definition of transparency and its instruments, the second one with functioning of municipal government and its possible control mechanisms. The next chapter represents the developed methodology. It served to analyze and evaluate the transparency of the three monitored municipalities in the case study of the Pribram micro region, the last chapter. For processing the case study and followed analysis I used the open data accessible for public on the municipal web portals of Pribram, Dobris and Sedlcany.

The thesis present usage of information technologies in public sector and is focused on e-procurement. The aim is to inform about possible solutions which increase transparency and efficiency of public tenders. It begins with theoretic aspects of public sector, corrupt conduct, assumptions and barriers of implementing information technologies in the public sector. E-procurement is mentioned together with the European and national approach and both are compared. Furthermore, special tools and systems, which are available in the Czech Republic at all levels of public administration, are described. Finally, the closing part illustrates the usage of e-procurement tools in the environment of particular public authority.
