Due to government intervention the inhabitants of Rainy River First Nations were deprived of the material resources available to many Canadians. In 1914, the federal government established a community reserve that consisted of peoples from eight separate and distinct communities, which directly contravened Treaty Three. The paper (through interviews, observation and textual analysis) provides a critical overview of the community's land claims settlement and reclamation process, and struggle for sustainability in the twenty-first century. In addition, it examines the manner that land-culture, human resources and capital resources may be applied to revitalize the community through community development and economic strategies.

Crown--First Nations relationships: a comparative analysis of the Tsawwassen Final Agreement and Tsilhqot'in v. British Columbia.

This thesis explores contemporary Crown - First Nations relationships in British Columbia through a comparative analysis of the Tsawwassen First Nation Final Agreement and the court decision in Tsilhqot’in Nation v. British Columbia. The comparative analysis considers First Nations’ claims to land, rights and jurisdiction entering the processes of treaty and litigation with respect to how the claims are modified as a result. The reduction of land and limitations placed on claims through treaty and trial are indicative of the quality of the relationships the provincial Crown pursues with First Nations. Given the historic injustices of denying Aboriginal rights and title in BC, the province’s history of colonization requires a new relationship to be just and equitable. The Crown’s pursuit of economic certainty overwhelms the potential for justice to be achieved, which are both fundamental aspects requiring balance for a healthy relationship to be established. The outcome of the analysis reveals the Crown’s ongoing colonization of First Nations in British Columbia. As a result, this thesis attempts to offer a decolonized view of these relationships and some solutions for moving forward by placing the onus of responsibility squarely on the people of British Columbia to demand change from our provincial government. / Graduate

HFD:s Peru-domar : Förhållandet mellan skatteavtal och intern rätt

Lagstiftningen om skattefrihet på kapitalvinster på näringsbetingade andelar samt RÅ 2004 not. 59 innebar startskottet för en ny typ av skatteplanering som kom att kallas Peru-upplägg. Skatteavtalet med Peru utnyttjades och stora skattevinster i de aktuella bolagen var följden. Skatteverket uppmärksammade detta och skatteavtalet med Peru sades omgående upp. I Peru- domarna underkändes slutligen två av dessa upplägg. Med utgångspunkt i Peru-domarna behandlar denna uppsats förhållandet mellan intern skatterätt och skatteavtal samt förekomsten i HFD av resonemang om rättshandlingars verkliga innebörd. Utgångspunkten är juridisk metod men uppsatsen innehåller även av komparativa och rättspolitiska moment. Ända sedan OMX-domen meddelades 2008 har viss osäkerhet förelegat avseende den interna skatterättens förhållande till internationella skatteavtal och vilken av dessa som har företräde vid en eventuell kollision. Den första frågan som behandlas i denna uppsats är om HFD i Peru-domarna satt svensk intern rätt framför skatteavtalet med Peru och detta därmed brutits. HFD undvek i Peru-domarna denna problematik som efter OMX-domen debatterades flitigt i doktrinen. Den andra frågan i uppsatsen är om HFD använde sig av det som kommit att kallas verklig innebörd/genomsyn i Peru-domarna. Inom skatterätten kan detta sägas innebära att beskattning skall ske på grundval av rättshandlingarnas verkliga innebörd oavsett den beteckning de åsatts. Slutsatsen i uppsatsen kombinerar svaren på de båda frågorna. Genom att använda sig av verklig innebörd/genomsyn kunde problematiken lösas genom vanligt skatteavtalstolkning. Det var därför aldrig nödvändigt för HFD att ta ställning i den laddade frågan om skatteavtalens relation till intern rätt. För att komma till slutsatserna granskas praxis och doktrin kring dessa frågor likväl som skatteavtalsrättens uppbyggnad i stort. I sökandet efter svaren avhandlas även intressanta principiella och rättspolitiska frågor.
