Le tiers requérant et l’altération du recours pour excès de pouvoir en droit de l’urbanisme / The third party and the alteration of the action of annulment in urban planning law

Le recours pour excès de pouvoir introduit par les tiers fait l’objet de transformations de plusieurs natures et l’urbanisme est un domaine dans lequel la mutation est particulièrement frappante. Estimé attentatoire à la stabilité des autorisations d’urbanisme, ce « procès fait à un acte, d’utilité et d’ordre publics » a été amendé, en grande partie par le législateur, dans le sens d’une plus grande sécurisation et subjectivisation. Par ce fait, il peut désormais être décrit comme altéré dans la mesure où les caractères constitutifs de ce monument du contentieux administratif tendent à s’effacer face à de nouveaux impératifs. La fermeture de l’accès au prétoire ainsi que l’évolution profonde de l’office du juge urbanistique conduisent ainsi à interroger la permanence d’un recours pour excès de pouvoir en urbanisme. Or, le processus d’altération du recours pour excès de pouvoir se heurte à des obstacles qui empêchent toute dénaturation de ce dernier. La pertinence d’un recours en légalité, objectif et ouvert demeure certaine tant ces caractères permettent de pallier les défauts du droit de l’urbanisme et l’absence de moyen alternatif de contestation de la décision administrative. En outre, le recours en urbanisme ne peut adopter le régime d’aucun autre recours, le conduisant irrémédiablement vers l’hybridation de son régime. / Actions of annulment by third parties are undergoing various transformations, most strikingly in the field of urban planning. Perceived as prejudicial to the stability of urban planning permissions, this “deed put on trial, of public utility and nature,” was amended, mostly by legislators, towards greater security and subjectivity. Consequently, it can henceforth be described as somewhat distorted, inasmuch as the constitutive characteristics of this pillar of administrative litigation tend to fade in the face of new priorities. The closing of the access to the courtroom as well the radical evolution of the urban planning judge’s function raise questions about the enduring nature of the action of annulment in urbanism. Yet, the alteration process of the action of annulment runs into obstacles that prevent any denaturation of it. The relevance of a legal appeal, objective and open, remains unquestioned in light of the degree to which its characteristics enable to overcome the flaws of urban planning law, and the absence of alternative means to appeal the administrative ruling. Moreover, appeals in urban planning law cannot adopt any other appeal’s legal rules, which inevitably renders its own system hybridized.

O presente trabalho tem como objeto de análise os Mapas de Lei dos marcos urbanísticos da cidade de São Paulo. Objetivo é verificar como os mapas têm sido utilizados para a aplicação da legislação urbanística e em que medida o Mapa se torna o efetivo vínculo normativo na aplicação da lei. Busca-se aferir qual foi o papel atribuído ao Mapa no decorrer dessas legislações e qual a sua posição dentro da estrutura jurídica e urbanística. Para isso iremos avaliar os mapas dos planos diretores e zoneamento da cidade de São Paulo dividindo-os em três períodos, determinados pela vigência de cada plano: o Plano Diretor de Desenvolvimento Integrado de 1971 (PDDI), o Plano Diretor Estratégico de 2002 e o Plano Diretor Estratégico de 2014. / The object of this master\'s thesis is the Maps of Urban Landmarks Laws of São Paulo\'s city. Aim is to verify how the maps have been used for the application of the Urban Legislation and in what extent the Map becomes the effective normative link in the application of the Law. It seeks to study the role assigned to the Map in the course of these legislations and what its position within the legal and urban structure. For this purpose, we will evaluate the Maps of the master plans and zoning laws of the city of São Paulo, dividing them into three periods, determined by the validity of each plan: the Integrated Development Master Plan of 1971 (PDDI), the 2002 Strategic Master Plan and 2014 Strategic Master Plan.

Initially, the analysis differentiates the Urban Law from the Right to the City. In the sequence, it focuses on the urban cleaning in the context of the Social State and its effectiveness, analyzing the normative treatment of the topic in the context of the Brazilian legal system, including individual and concrete standards produced by the Courts of Auditors in implementing indirect execution of these services. The main objective is to defend the need of redefine of the concepts of effectiveness of such services through the adoption of a control based on principles, requirements, assumptions, indicators of public health, quality of life and environmental sustainability, emphasizing the elements and functions of the city, prescribed in the Federal Constitution, the National Solid Waste Policy and the City Statute. It is evaluated the role of the Welfare State in urban cleaning and solid waste management, understood as socio-environmental goods of economic value, capable of transforming cities into "healthy living spaces", accomplishing of social rights, of happiness and of sustainable economic development. It defends also Urban clean-up and solid waste management are therefore advocated as a constitutive element of the Right to the City and, at the same time, guarantee instrument of leisure, education, housing, movement, employment and income in a sustainable urban environment. Urban cleaning and solid waste management must be able to assure the inhabitants of the town, physical and mental health, as well as quality of life in all its aspects / O cerne do presente estudo é a limpeza urbana e a gestão de resíduos sólidos nas cidades brasileiras de grande porte, a exemplo de Salvador e Bogotá, na Colômbia, como elemento constitutivo do Direito à Cidade. Inicialmente, a análise diferencia o Direito Urbanístico do Direito à Cidade. Em sequência, enfoca a limpeza urbana no contexto do Estado Social e sua efetivação, analisando o tratamento normativo do tema no âmbito do sistema jurídico brasileiro, inclusive de normas individuais e concretas produzidas pelos Tribunais de Contas em sede de controle da execução indireta destes serviços. O objetivo central é defender a necessidade de ressignificação da eficácia dos referidos serviços por meio do controle de efetividade a partir de princípios, requisitos, pressupostos, indicadores de saúde pública, de qualidade de vida e de sustentabilidade ambiental, enfatizando os elementos e funções da cidade, prescritas na Constituição Federal, na Política Nacional de Resíduos Sólidos e no Estatuto da Cidade. É avaliado o papel do Estado Social na limpeza urbana e na gestão dos resíduos sólidos, compreendidos como bens sócio-ambientais de valor econômico, capazes de transformar as cidades em “espaços de vida saudável”, de concretização dos direitos sociais, da felicidade e de desenvolvimento econômico sustentável. Defende-se, então, a limpeza urbana e a gestão dos resíduos sólidos como elemento constitutivo do Direito à Cidade e ao mesmo tempo instrumento garantidor do lazer, da educação, da habitação, da circulação, do emprego e da renda, em um meio ambiente urbano sustentável. La performance urbanistique sous la condition d'une réforme totale : recherche visant un droit de l'urbanisme performant en Haïti / The urban aplanning and development performance under the condition of a comprehensive reform : research for a performing urban plannning law in Haïti

Cette thèse établit la conditionnalité de la performance urbanistique à une réforme totale. Elle révèle un syndrome d'inefficacité générale dont le traitement des symptômes est indispensable à un tel objectif. Le spectre des symptômes inclut principalement les missions publiques problématiques, les principes et modèles de base inadéquats, une législation d'urbanisme incompatible avec les objectifs de performance urbanistique, ainsi que les pratiques déviantes ou anarchiques d'aménagement et d'équipements publics. Cette thèse montre en outre l'état de délaissement de nombreux aspects d'urbanisme au libre-arbitre des personnes privées et des organisations non gouvernementales. Les hypothèses de solutions proposées englobent un remodelage total des structures de gouvernance publique, un réglage du droit de l'urbanisme sur une théorie de performance la moins altérable possible, l'édification des préalables théoriques et structurels de la performance, ainsi qu'une réforme spécifique porteuse de la performance du droit de l'urbanisme. Cette thèse identifie divers exemples de performance susceptibles de participer au processus de cette réforme et présente une démarche méthodologique de théorisation et de mise en œuvre d'un tel droit de l'urbanisme en Haïti. Elle explique, de plus, les énormes défis de la performance de ce droit par rapport au système politique et juridique. On y trouve aussi plusieurs propositions pour le relèvement de ces défis, pour la résorption des divers obstacles identifiés, ainsi que pour l'établissement d'un système global de performance apte à porter durablement celle du droit de l'urbanisme. / This thesis establishes the conditionality of an urban planning and development performance upon a comprehensive reform in Haiti. It highlights a general inefficiency syndrome whose treatment is essential for such purpose. The range of symptoms mainly comprises problematic government tasks, inadequate basic models and principles, an urban planning law incompatible with objectives in terms of urban planning and development performance, along with anarchic and deviant practices in development and public facilities. Furthermore, this thesis outlines the state of many aspects of urban planning left to the free will of private individuals and non-governmental organizations. Hypotheses of solutions involve a complete remodeling of public governance structures, an urban planning adjusted upon a performing theory as little alterable as possible, some well-made theoretical and structural prerequisites of performance, as well as a specific reform promising a performing urban planning law. This thesis also identifies various performance examples likely to participate in this reform process and presents a theorization and implementation methodological approach of such an urban planning law in Haiti. It also explains the tremendous challenges for the performing urban planning law in relation to the political and legal system. Several propositions are included aimed at answering various challenges, removing a number of identified barriers and establishing a global management system suitable for accomplishing sustainable performance in urban planning law.
