The technology breakthroughs into the most varied fields of science, make ir possible extraordinary sains to mankind. In relation to communication flow it has not been different. Cyberspace was created whose digital-electronic devices opened up to a new dimension to unrestict access to information. As well as to the most varied forms of interpersonal communication. This new reality rise up a deep reflextion into the subject of new forms of criminality in the virtual net. On the other hand it highly influences in the dynamics of surveillance of the modus operandi of the criminal groups and the taking of evidence, especially, what concerns transnational criminality, whose anonymity and privacy which the virtual world makes possible it is almost a guarantee of free practice of ilicit activity and its consequent impunity. The juridic base over such tools, should never be justified by emergencial doctrines but surely in the demonstration of the reality that we interact in a society under the new concept of justice and equality whose efficacy in the prevention and repression to criminality is inexorably based on the permissiveness of the use of modern techiniques of survaillance under the taking of evidence, voice and image, of the most varied systems of information and communication flow. So, the necessity of stabilishing a balance of the national juridic laws facing the global juridic reality backed by a Democratic State of law under a continuous conception of the principle of human being dignity / A análise histórico-jurídica da disciplina monitoramento de sinais, corroborada pelo estudo dos diversos institutos legais corolários a ela, frente a um conturbado cenário globalizado tecnológico, em um período de forte instabilidade política das instituições públicas, cujos riscos sociais são potencializados em uma sociedade de informação, sob o inevitável choque de obscurecimento da própria essência humana, resume o conjunto de fatores que dificultam os parâmetros racionais a serem estabelecidos em uma proposta de regulamentação jurídica da matéria. As inovações tecnológicas nos mais variados ramos da Ciência, possibilitaram ganhos extraordinários para a humanidade. Em matéria de fluxo das comunicações, não foi diferente. Nasceu o ciberespaço, cujos dispositivos eletrônico-digitais, viabilizaram uma nova dimensão no acesso irrestrito à informação, como também, às mais variadas formas de comunicação interpessoal. Essa nova realidade impõe uma profunda reflexão na disciplina das modernas formas de criminalidade na rede virtual. Por outro lado, influi sensivelmente, na dinâmica da investigação do modus operandi dos grupos criminosos e na consequente colheita de prova, em especial, no tocante à criminalidade transnacional, cujo anonimato e privacidade que o mundo virtual propicia, é quase que uma garantia da livre prática da atividade ilícita e da consequente impunidade. O amparo jurídico sobre tais instrumentos, não deve jamais se justificar em doutrinas emergenciais, mas sim, na demonstração da realidade que convivemos em uma sociedade sob uma nova concepção de justiça e igualdade, cuja eficácia na prevenção e repressão à criminalidade, inexoravelmente, recai sobre a permissividade do emprego de modernas técnicas de monitoramento, mediante colheita de dados, voz, imagem e dos mais variados sistemas de fluxo comunicacionais e informacionais. Torna-se, assim, imperiosa a necessidade de estabelecer um equilíbrio do ordenamento jurídico nacional frente à realidade jurídico global das nações, amparadas em um Estado Democrático de Direito, sob a constante concepção do princípio da dignidade da pessoa humana

The Right to Privacy In The War On Terror: Constitutional Questions In Eavesdropping By The U.S. Government

In October 2001 , President George W. Bush issued an executive order authorizing the National Security Agency (NSA) to conduct secret wiretapping of telephone communications between U.S. citizens and terrorist suspects overseas in the wake of the September 11th terrorist attacks. The program, later called the Terrorist Surveillance Program (TSP), remained secret until December 2005, when the New York Times revealed the existence of the TSP. In January 2006, the American Civil Liberties Union (ACLU) filed suit in the United States District Court for the Eastern District of Michigan, claiming that the NSA's surveillance program violated the First and Fourth Amendments of the U.S. Constitution, as well as the separation of powers doctrine. The government argued that the program met constitutional scrutiny under the "special needs" doctrine warrant exception. Additionally, the Bush administration asserted that Congress specifically gave the President permission to authorize the program by its passing the Authorization for Use of Military Force (AUMF). This thesis analyzes the constitutionality of the domestic surveillance program by discussing the constitutional questions that the NSA's program elicits under the Fourth Amendment. Also, this thesis reviews the legality of the TSP under the Foreign Intelligence Surveillance Act (FISA). After an analysis of the Supreme Court's jurisprudence in Fourth Amendment, privacy, and eavesdropping cases, this thesis concludes that the NSA' s warrantless eavesdropping program most likely violates the Fourth Amendment and the separation of powers doctrine. Further, this thesis asserts that the TSP is illegal under the FISA and that the Executive lacks statutory authorization.
